Thomas & Winey TOONE to Samuel GARNER 1819

Mecklenburg Co., VA Deed Bk 18, pp. 111-112:

This Indenture made this 21st day of August 1819 between Thomas Toone & Winny his wife of the County of Mecklenburg and State of Virginia of the one part and Samuel Garner of the same County & State of the other part. Witnesseth that the said Thomas Toone for and in consideration of the sum of ninety three pounds fifteen shillings to him in hand paid by the said Samuel Garner the receipt whereof is hereby acknowledged has given, granted, bargained & sold aliened enfeoffed and confirmed and doth by these presents give grant bargain sell alien enfeoff and confirm unto him the said Samuel Garner one certain tract or parcel of land lying and being in the County aforesaid and containing sixty two and one half acres and bounded by the lands of the estate of John Barnes, Francis Hamner? Thomas Toone and James Garner Senr To have and to hold the said tract or parcel of land to him the said Samuel Garner and his heirs forever, and the said Thomas Toone doth covenant and agree to and with the said Samuel Garner to warrant & forever defend the title to the said tract or parcel of land against the claims or demands of all persons whatsoever. In Witness whereof the said Thomas Toone & Winny his wife have hereunto put their hands & affixed their seals the day and year above written.

Stokes magistrates of the said County do certify that Thomas Toone a party to the within deed hath duly acknowledged the same before us on the 21st day of August 1819 & desired us to certify the same to the Clerk of the County Court of Mecklenburg in order that the same may be recorded. Stokes Justices of the peace in the said County do hereby certify that Winny Toone wife of Thomas parties to the written conveyance to Samuel Garner bearing date on the 21st August 1819 and hereto annexed personally appeared before us in our said County, and being examined by us privily and apart from her husband and having the deed aforesaid fully explained to her, she the said Winny Toone acknowledged the same to be her act and deed and declared that she had willingly signed sealed and delivered the same, and that she wished not to retract it. This indenture made and entered into the 4th day of March 1824 Between Elizabeth Toone widow of the late William Toone dec'd, George Toone and Joannah Lewis his wife Tavner Toone Jnr. and Rebecca his wife and John Toone of the first part and Samuel W. Pattillo of the second part, all of the County of Mecklenburg and state of Virginia Witnesseth that whereas the aforesaid Elizabeth, George, Tavner, & John Toone have this day sold unto the aforesaid Samuel W. Pattillo the tract of land whereon they now reside containing one hundred and ninety nine acres and three fourths of an acre, be it more or less, for the sum of seven hundred dollars, the receipt whereof is hereby acknowledged, hath bargained and sold, and by these presents do bargain and sell, give grant and confirm unto the said Pattillo, his heirs Executors administrators and assigns the aforesaid tract of land which is bounded by the lands of Augustine Smith Elizabeth Baskervill and Elizabeth Farrar & is the same land given by the will of the late William Toone dec'd aforesaid the said Elizabeth Toone for and during her natural life and afterward to go to his and her children, George, Tavner, and John Toone, which said will is of record in the office of the County Clerk of the County aforesaid (Mecklenburg, reference being thereunto had [sic] will more fully appear. To have and to hold the aforesaid tract of land with all and singular its rights, privileges and appurtenances unto him the said Samuel W. Pattillo and his heirs and assigns forever, and the said Elizabeth George and Joannah Lewis his wife, Tavner and Rebecca his wife and John Toone, for them & also their heirs, Executors and administrators do by these presents warrant and forever defend the right title and Interest of the aforesaid tract of land unto him the said Samuel W. Pattillo, his heirs Executors, administrators and assigns against themselves their heirs, Executors and administrators and all and every person or persons whatsoever – In testimony whereof the said Elizabeth, widow of Wm. This Indenture made the 10th day of July one thousand eight hundred and twenty eight between Thomas Toone and Winny his wife of the County of Mecklenburg of the one part, and William Bacon and Lyddall Bacon of the sec. part, and Richard Russell of the third part. Whereas the said Thomas Toone and Winny his wife is justly indebted to the said Richard Russell in the sum of one hundred and thirty five dollars and five cents to be paid on the first day of August one thousand eight hundred and twenty eight as by a bond bearing date on the 5th day of July in the year 1828 more fully appears (?) or which debt the said Thomas Toone and Winny his wife is willing and desir. to secure. Now this Indenture witnesseth that for and in consideration of the premises and also for the further consideration of one dollar of lawful money of Virginia to the said Thomas Toone and Winny his wife on hand paid by the said Wm Bacon and Lyddall Bacon at and before to ensealing and delivery of third presents the receipt whereof is hereby acknowledged he(?) that said Thomas and Winny has conf. hath given granted bargained sold claimed enfeoffed released and confirmed and by these presents doth give grant bargain sell claim enfeoff release and confirm to the said William Bacon and Lyddall Bacon their heirs and assigns forever all that tract or parcel of land lying and being in the County of Mecklenburg in the State of Virginia containing sixty and more or less and bounded by the lands of James Garner, Richard Rufus and Frances Barnes and to following (sic) property to wit all his household & kitchen furniture 3 head of cattle 12 head of hogs & plantation for with all and singular the appurtenances to the said tract or parcel of land belongs or in any wise appertaining (sic) and all do (sic) estate right title of the said Thomas Toone and Winny his wife in and to the said granted or intended to the hereby granted tract or parcel of land and premises, To have and to hold the said hereby granted tract or parcel of land and premises with its appurtenances with the said William Bacon and Lyddall Bacon ? have ? ? ? of forever and the said Thomas Toone and Winny his wife for themselves their heirs their admors and assigns forever and the said Thomas Toone and Winny his wife doth hereby covenant promise and agree to and with the said William Bacon and Lyddall Bacon their heirs Exors admors and assigns forever in manner and form following that is to say that the said Thomas Toone and Winny his wife their heirs Exors and admors (word or words missing) the aforesaid tract or parcel of land and premises with its appurtenances and the said William Bacon and Lyddall their heirs exors admors and assigns against all persons whatever shall and will warrant and forever defend by these presents upon trust nevertheless that the said William Bacon and Lyddall Bacon their herids exors and admors shall permit the said Thomas Toone and Winny his wife to remain in quiet and peaceable possession of the said tract or parcel of land and premises with its appurtenances and take do (sic) profits thereof to his own use until default of payment be made of said sum of money one hundred and thirty five dollars & 5 cents either in the whole or in part and then upon this further trust that they or either of them or the survivour (sic) of them or the heirs exors admors or assigns of such survivor shall and will so soon after the happening of such default of payment as they or any or either of them or the survivor of them or the heirs exors admors and assigns of such survior may think proper or the said Richard Russell his Exors admors or assigns shall request sell the said tract of land and premises with the appurtenances or such part of the hereby granted premises as the trustee or trustees or the representatives hereby authorized to act shall think sufficient for the purpose and shall think proper to sell to the highest bidder for ready money at public auction after having ? the time and place of sale at their own discretion and giving twenty days' notice thereof in one or more of the newspapers printed in Richmond and also notified the same by advertisement is to be set up at the door of the Courthouse of Mecklenburg County one some (sic) court day previous to the day of sale and ? of the money arising from such sale shall after satisfying the charges thereof and other expences (sic) attending the premises pay the said Richard Russell his heirs admors and assigns the said sum of one hundred and thirty five dollars and five cents with interest which may thereon lawfully have accrued and the balance of any shall pay the said Thomas Toone and Winny his wife their heirs, exors or admors or assigns but of the whole of said sum of money one hundred and thirty five dollars and five cents shall be paid off and discharged the said Richard Russell his heirs exors admors or assigns on or before the 1st day of August, one thousand eight hundred and twenty eight when the same is payable so that no default of payment of the said sum of one hundred and thirty five dollars and five cents be made them this Indenture to be void or else to remain in full force and virtue, In witness whereof the said parties to these presents have hereunto set their hands and seals the day and year above written.

Burwell and Abram Keene Justices of the peace in the County aforesaid in the state of Virginia do hereby certify that Thomas Toone a party to a certain deed bearing date the 10th July 1828 and hereunto annexed personally appeared before us in our County aforesaid and acknowledged the same to be his act and deed and desired as to certify the said acknowledgement to the Clerk of the County Court of Mecklenburg in order that the said deed may be recorded.

Mary A. VAUGHAN, widow of Thos. VAUGHAN, to Edward H. TOONE

Deed Book 27, pp. 560-561

This Indenture made and entered into this the 23rd day of June 1838. By and between Wm Townes and Edward R. Chambers of the first part and Edward H. Toone of the second part all of the County of Mecklenburg. Witnesseth that whereas the county court of Mecklenburg by a decree in chancery rendered at January court 1836 and by an amended decree rendered at February 1836 constituted and appointed the said Edward R. Chambers and Wm Townes Commissioners, to sell the real estate held by the late Mary A. Vaughan as her dowr in the estate of her deceased husband Thomas Vaughan and the said Wm Townes and Edward R. Chambers in execution of the said decree did on the 15th day of February 1836 sell at public auction on a credit of one and two years five hundred and thirty four acres part of the said [word missing, apparently] and the said Edward H. Toone begin the highest bidders became the purchaser thereof at the price of one dollar and seventy nine cents per acre and the said county of Mecklenburg by a final decree rendered at June court 1838 ratified and confirmed the said sale and ordered that the said Wm Townes and Edward R. Chambers should by deed with special warranty convey the said land to the said Edwrd H. Toone. Now in consideration of the premises and for and in consideration of nine hundred and fifty five dollars and 86/100 in hand paid by the said Edward H. Toone to the said Wm Townes and Edward R. Chambers the receipt of which is hereby acknowledged, they the said Wm Townes and Edward R. Chambers Commissioners as aforesaid have bargained and sold by these presents doth bargain sell align(?) convey and confirm unto the said Edward H. Toone his heirs and assigns forever one certain tract or parcel of land lying in the county of Mecklenburg containing five hundred and thirty four acres be it more or less it being part of the dower land assigned to and held by the late Mary N.[sic] Vaughan widow of Thos. Vaughan, the metes and bounds of which may be seen by the report of the Commissioners who divided the estate of the said Thos. Vaughan. To have and to Hold the said land with all the rights privileges and appurtenances to the same belonging or in any use appertaining to him the said Edward H. Toone his heirs and assigns forever to his and their only proper use benefit and behoof forever free from the claim challenge and demands of all and every person whatsoever and the said Wm Townes and Edward R. Chambers doth for themselves and their heirs covenant to and with the said Edward H. Toone that a good and sufficient title to the said land to him the said Edward H. Toone his heirs and assigns forever. They will forever warrant and defend against all persons claiming by through or under them. In testimony of all and singular they have hereunto set their hands and seals the day and date first above written.

This indenture made this 8th day of April 1846 between Thomas Toone of the first part and Zach. Bugg of the second part and Richard Russell of the third part. Whereas the said Thomas Toone is justly indebted to the said Richard Russell in the sum of three hundred and thirty two dollars and sixty eight cents as by a bond bearing date on the 1st day of April 1846 which add (sic) with the legal interest thereon accruing the said Thomas Toone is willing and desirous to secure. Now this indenture witnesseth that for and in consideration of one dollar lawful money of Virginia to the said Thomas Toone in hand paid by the said Zac Bugg at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged he the said Thos Toone hath given granted bargained sold aliened enfeoffed released and confirmed and by these presents doth give grant bargain sell alien enfeoff release and confirm to the said Zac Buggs his heirs and assigns forever all that tract or parcel of land lying and being the County of Mecklenburg in the state of Virginia containing forty acres be the same more or less and bounded by the lands of Francis Barnes Charles H. Robertson and Asa Garner with all and singular the appurtenances to the said tract or parcel of land belonging or in any wise appertaining and all the estate right title and interest of said Thomas Toone in accd ? to the said granted or intended (grantee or intendee?) to be hereby granted tract or parcel of land and premises to have and to hold the said hereby granted tract or parcel of land and premises with it appurtenances unto the said Zac Bugg, his heirs and assigns forever to the only proper use and behoof the said Zac Bugg his heirs and assigns forever and the said Thos Toone for himself his heirs Executors and Administrators doeth hereby covenant promise and agree to and with the said Zach Bugg, his heirs and assigns forever in manner and form following that is to say that the said Thos Toone his heirs Executors and Administrators the aforesaid tract or parcel of land and premises with their appurtenances s? the S? Zac Bugg, his heirs and assigns against all persons whatsoever shall and will warrant and forever defend by these presents . Upon trust nevertheless that the said Zac Bugg, his heirs and assigns shall permit the said Thos Toone to remain in quiet and peaceable possession of the said tract or parcel of land and premises with its appurtenances and take the profits thereof to his own use until default be made in the payment of the said sum of three hundred thirty two 68/100 dollars either in the whole or in part and then upon the further trust that the said Zac Bugg his heirs or assigns shall and will so on after the happening of such default of payment as he the said Zac Bugg his heirs or assigns may think proper or the said Richard Russell his Executors Administrators or assigns request well the said tract of land and premises with the appurtenances for ready money at public auction after having fixed the time and place of sale at their own un? And given ten days notice thereof and out of the monies arising, from said sale shall after satisfying the charges thereof and all other expenses attending the premises pay to the said Richard Russell his Executors Administrators or assigns the said sum of three hundred and thirty two 68/100ths dollars with the interest which may thereon lawfully have accrued and the balance if any shall pay to the said Thos Toone his heirs or assigns. But if the whole of the said sum of three hundred thirty two 68/100ths dollars shall be fully paid off and discharged to the said Richard Russell his Executors Administrators or assigns then this indenture to be sold or else to remain in full force and virtue. In witness whereof the said parties to these presents have hereunto set their hands and affirm their seals this day and year first above written.

This Deed made the 18th day of November in the year eighteen hundred fifty six between Andrew J. Toone and Sarah J. his wife of the first part and Richard Russell of the second part all of the County of Mecklenburg & State of Virginia Witnesseth that in consideration of the sum of two thousand dollars in hand paid the receipt whereof is hereby acknowledged the said Andrew J. Toone his wife do grant unto the said Richard Russell all the right title & Interest in a certain tract of land lying & being in the upper end of the County of Mecklenburg & State of Virginia containing two hundred & eleven acres be the same more or less & bounded by the lands of Charles McCutcheon, William Loafman, Thomas Brame, William Hunbridge, and David G. Smith, and that they will generally warrant the property hereby conveyed. Witness the following signatures & seals this the day & year above written.

Toone acknowledged the said writing to be her act and declared that she had willingly executed the same, and does not wish to retract it.
