William E. EAVES owed a mortgage to Thomas HARRIS (d/ 1893)
for $850 and also a second mortgage owed to his grandfather,
William H. EAVES for $500.
SALE was held 23 Dec 1893 on the premises; high bidder was:

William H. EAVES and William E. EAVES filed objections stating
the sale failed to represent their mortgage and the mortgage had
been fully paid before the sale and James H. HARRIS had promised
to deliver the note to them. In addition, the mortgage was
transferred to Dr. John NICODEMUS.
John P. RAMSBURG also testified for them and stated Mr KANODE
had given Wiliam E. $50 to pay HARRIS and ask for an extention
to Jan 3rd in which he agreed.
Further, Dr. NICODEMUS agreed to lend William E. $700 to pay
the mortgage.
On Jan 3, Mr KANODE, William E. EAVES & wife met Mr NORWOOD
(HARRIS' council) whereby Mr KANODE stated he wanted to buy
the property but wanted a clear title and
was so promised. Mr KANODE paid Mr NORWOOD $150 cash,
$700 from Dr. NICODEMUS
and the other $50 having previously been paid to HARRIS.
Mr NORWOOD wrote a release and receipts in full payment of
the mortgage and prepared a deed from William E. EAVES and wife
to William E. KANODE which was at once executed and put on record.
The mortgage and the note with releases were then sent by Mr.
NORWOOD to Mr HARRIS at Liberty requesting him to sign the
releases and send them to Mr. KANODE at Daysville.
Dr. NICODEMUS also stated he understood the 1st mortgage
would be released.
Instead, Mr HARRIS brought the papers back to Mr NORWOOD
and said he didn't understand, that since he was the assignee,
the mortgagee should be transferred to him.
On Jan 10, Mr NORWOOD found the 2nd mortgage and advised
Mr HARRIS to erase the release and assign the mortgage to
Dr. John D. NICODEMUS and was then done.
The court ruled conveyance to James H. HARRIS would enable
him to give a good title to William E. KANODE who could then
give a 1st mortgage to Dr. NICODEMUS.
Trustee to convey the deed to James H. HARRIS was Frank E.
NORWOOD, Esquire.
