Catoctin Mountain Iron Company of Frederick County vs Creditors & Stockholders - Sale of Real Estate - Equity #6881 - May 1898 Catoctin Mountain Iron Company of Frederick County was incorporated on 15 Nov 1888. Business was digging and smelting iron ores and the manufacture of pig iron at the iron furnaces, long known as the Catoctin Furnace, which consisted of 10,000 acres; also had property in Frederick City. Management was entrusted to Thomas GORSUCH, one of the largest stockholders and promoter; however, he died in the summer of 1896 and had invested much of his own money in the company. The company is now in debt of about $50,000. of which $26,000 is due to the estate of Thomas GORSUCH and $7,000 to $10,000 is due to George HOUCK; also a lien in favor of the sisters of John Baker KUNKEL, a former owner of the real estate. Total Capital Stock, $90,000. Since the death of Thomas GORSUCH, the furnaces have been idle. The stockholders have voted to dissolve the company and sell off the assets, appointing George HOUCK, Harry P. GORSUCH (sec) and Frank C. NORWOOD as receivers. LAND: Tract #1 - Catoctin Furnace, 7,000 acres, on Frederick-Emmitsburg Turnpike, at base of Catoctin Mountains, 3 miles south of Thurmont, a station on the Western Maryland Railroad and terminus of the Monocacy Valley Railroad leading from Thurmont to the furnace, also 12 miles north of Frederick City. Sarah C. WARNER and husband Samuel C. WARNER - Sale of Real Estate - Equity #7264 & 4937 - Oct 1900 Petition originally filed by Jacob J. HOUCK in 1883, but Jacob J. HOUCK died 1900, testate, naming his widow as Valeria E. and leaving her all his estate and rights. Exec/ Hamilton LINDSAY Witnesses: Roscoe C. WHITE, Horatio WATERS [Will CES-1, 61; written 22 Aug 1899; filed 16 Oct 1900] LAND - 70.25 acres, 2.5 miles from Libertytown, on road from Mapleville to the Liberty Road. Improved with a 6-room, 2-story log and weatherboarded house with basement, a log and weatherboarded ground barn with wagon shed attached, two corn cribs, meat house, wood shed, apple orchard and well near the house; farm divided into 6 fields and has two springs. HOWEVER - this land had been deeded to Jacob's first wife, Ann Elizabeth HOUCK; and she and her husband Jacob J. HOUCK conveyed a Deed of Trust to their daughter, Emma HOUCK, in trust for her and their other children, with life estates to both parents; and upon their deaths, to be sold and profits divided evenly among all their children - Sep 1877 [TG-8, 246]. Previously the property belonged to George CLINE who died intestate and, on 13 Nov 1874, his widow and children became the heirs. Power of Attorney was granted to William WARNER [TG-2, 271], who was authorized to sell the property, 2/3 to be paid and the other 1/3 to be paid after the death of the widow CLINE when it would be distributed to the heirs of George CLINE. The property was then sold to Ann Elizabeth HOUCK. Ann Elizabeth HOUCK died and Jacob later married Valeria E. HOUCK. After Emma HOUCK died in Aug 1882, who was the original trustee, Valeria E. HOUCK applied to replace her, but never posted bond; this being in Oct 1883. She then took possession of the property and sold off much of the timber, amounting to $2,000 without ever filing any report. Since the property was originally Ann Elizabeth HOUCK's, Valeria E. HOUCK had no legal interest in the estate as her husband only had a life estate. Sarah C. WARNER and husband Sameul C. WARNER made application to appoint John E. HOUCK and John S. NEWMAN as trustees to manage the sale of the property. The new trustees stated the trust was for children of Jacob J. & Ann E. HOUCK. Years after Ann died, Jacob remarried. His 2nd wife, Valeria E. HOUCK, was in a strained and hostile relationship with Jacob's children & grandchildren. Valeria E. HOUCK was removed as trustee and court appointed John S. NEWMAN and John E. HOUCK as trustees. SALE was held 23 Feb 1901 at Carter's Store in Libertytown; high bidder was: - Samuel M. POOLE at $13/acre; $918.94; Subject to the right of the widow & children of George CLINE; and tenant Thomas E.
