went AWOL 7/28/63 near Sprryville, Rappahannock Co., while unit en route from Winchester to Montpelier. Arrested by 12/11/63 when returned to unit. Courtmartialed, guilty desertion by 3/8/64. Sentenced to be shot in front of bde. 7 days after publication of courtmartial order. Execution suspended 3/16/64 pending review of evidence of enl. in 63d Va. Inf. Regt. Death sentence remitted 3/25/64 when he was ordered returned to unit. Evidence "creates a reasonable doubt" whether he "previously enlisted in Co. E 63rd Va. Regt. And never been discharged therefrom." Captured Spotsylvania C.H. 5/12/64. POW Ft. Delaware 5/20/64 to 6/7/65 when released on oath 5'10", dark complexion, brown hair, blue eyes in 1865.
