I, Thomas N. Gregory of the city of Richmond being of sound and disposing mind do make this my last will and testament, as follows

1st Having given my Daughter Elizabeth her portion during her lifetime, and she being now dead, I give to her five living children one hundred dollars to be equally divided between them. The hundred dollars I thus bequeath is now in the hands of P. G. Eubank the Farther of said children to be paid to them when they shall have attained their majority.

2. The remaining of my estate both real and personal I wish to be divided equally between my three sons, namely Jno. E. S. Gregory, Jos. F. L. Gregory and David J. Gregory save that I wish reasonable deduction made from the share of Jno. E. S. Gregory in favor of my two younger sons inasmuch as the said Jno. E. S. Gregory has received his education. I also direct that Jno. E. S. Gregory shall receive his share as soon as the estate can be properly divided.

3rd I also request that my Brother Josephus Gregory shall take the Guardianship of my two younger sons, J. F. L. Gregory and David J. Gregory without security for said Guardianship

4th I do hereby appoint my Brother Josephus Gregory my executor without security to this my last will and testament. Given under my hand and seal this the 29th day of March Eighteen hundred and fifty-six.

At a Circuit Court of the City of Richmond for the trial of Civil Causes held June 11th 1856.

The Last will and Testament of Thos. N. Gregory deceased was produced in court and proved by the oaths of F. W. Roddey and Geo. H. Lee two of the attesting witnesses thereto Whereupon it was ordered that the said will be recorded. And on the motion of Josephus Gregory the executor named in the said will, who made oath according to Law, and entered into and acknowledged a bond in the penalty of Eight thousand Dollars conditioned as the Law directs but without security (it being authorized by the said will that none be required of him) certificate was granted him for obtaining a probat (sic) of the said will in due form
