Decides Against Plaintiff


Judge KIRWAN has handed down a decision in the case of A. J. EBENREITER, undertaker of Plymouth vs. Edward RILEY, in which the garnishee proceedings against George SHARPE of Waldo are dismissed.

A dispute arose over the payment of a bill for services at the funeral of the mother-in-law of Mr. RILEY. In the former suit, judgement was entered against the defendant. Later Mr. and Mrs. RILEY disposed of some land to George SHARPE and the money involved in the transaction was garnisheed. The case was tried in the justice court at Plymouth and later an appeal taken to the circuit court. The decision is to the effect that the transaction involves both parties, Mr. and Mrs. RILEY, and the debt incurred was against Mr. RILEY only. H. J. ROONEY of Plymouth appeared for the plaintiff and VOIGHT & VOIGHT of this city for Mr. RILEY.
