HAYS, age 55, Baltimore City - claimed he was born in the house on Lot #10 and can remember it from childhood; his father had died when he was a baby and he was the only child. His mother had been living on Lot #10 and 11, both being enclosed by one fence, but the house is on Lot #10. Taxes on the property were paid by him. One of the tenants had been William BERNARD who paid the rent to him. - John L. JORDAN, age 48, Brunswick - Mrs HAYS and her son had occupied the lots when I first knew them, 30-35 years, until her death. It was always referred to as the 'Hays lot' until a few years ago when a person named JOHNSON claimed a portion of them. He never knew anybody else claiming title and had lived ther since 1852. - Patrick M. WEST, age 70, Brunswick - Had been there 60 years and claimed the lots were owned by the HAYS family. He stated Catharine (Ebbert) HAYS had been living there prior to the death of her husband. He left the neighborhood in 1865. - William L. GROSS, age 38, Brunswick - He had lived there since 1877 and the lots were always known as the 'Hays lot'. - Mrs. Mary C. JOHNSON, age 66, Martinsburg, Berkeley Co, WV - She married John T. JOHNSON about 40 years prior. Catharine (Ebberts) HAYS was her aunt who had lived on Lots #10 & 11 and also had her grandmother (Catharine's mother) living there until her grandmother's death. Catharine had lived there as long as she can remember and was living there for some years before the death of her husband. Besides her son William F. HAYS, she had another son who died while the war was going on; his name was George Washington HAYS and was 25 or 26 years old at the time of his death; he was single. Since the death of her father, George EBBERT, she and William F. HAYS and herself had been paying taxes on it, each owning half of the lots. Mr HAYS had been renting the property. Her father's Will listed her as Mary Ann, but there is no other daughter named Mary Ann. - John T. JOHNSON, age 64, Martinsburg, WV - both he and William F. HAYS have paid taxes on the property; the Hays had been living there before his marriage some 40 years ago. - John H. POOLE, age 49, Washington, DC. - Lucinda JETT, age 67, Sunbury, PA - William F. HAYS was about six months old when his father died. The family had been living there and Mrs HAYS then lived there with her two sons. She moved to Martinsburg after her father died. She hadn't seen William F. HAYS in over 20 years. The HAYS family had been living there before she was born. She stated her husband had sold the property devised to her in her father's Will without her knowledge. - Alley A. LEITZ, age 53, Baltimore City - Claimed she heard her Uncle Fred EBBERT and her mother talking about Bill HAYS wanting to take this property away from Aunt Mary and Uncle Fred saying Mary couldn't claim Lot #11 and couldn't claim all of Lot #10 because her father had given her only half of it. She was born in Berlin but left when seven years old. She (her mother) always said that George EBBERT let Mrs. HAYS live there out of charity because she was his widowed sister. As soon as her mother "was put in the ground", then Bill HAYS started these proceedings. The court determined George EBBERT had specifically devised only half of Lot #10 to his daughter Mary which indicated no claim for the other half. He also had been living there with his nephew at the time of his death. Therefore, the other heirs had no interest in these lots and ownership is determined to be for Mrs JOHNSON and William F. HAYS.
