Last Will and Testameny of Philip Wagner of Baltimore county, Dated 17 Jan 1840

In the Name of God, Amen, I, Philip Wagoner of Baltimore County in the state of Maryland, being weak in Body but of sound and disposing mind, memory, and understanding, considering the certainty of Death, and the uncertainty of the time thereof, and being desirous to settle my worldly affairs, and thereby be the better prepared to leave this world, when it shall please God to call me hence, do therefore make and publish this my last Will and Testament in manner and form following, that is to say, after my Debts and funeral chares are paid, I devise and bequeath as follows:

I give and bequeath to my beloved wife Violet during her natural life, the place on which we now live containing Thirty-Three Acres, more or less, with the exception of One-eighth of an Acre, which I reserve for the use of a burying ground and I also reserve the use of a Road to the burying ground.

I give and bequeath to my my wife during her natural life all my stock, all my Farming Utensils, all my Household and Kitchen Furniture, one half of the grain which may be in the Barn, one half of the grain in the ground and also a one horse carriage.

I also give and bequeath to my Wife during her natural life the Annual Interest of One Thousand Dollars, Six Hundred of which is now on Interest and Four Hundred in the house, to be put on Interest.

My farm situated in the Hanover Road above Reistertown, containing One Hundred Four and a Half Acres more or less, I leave to be rented, during the natural life of my Wife and the Annual Rent to be put out on Interest.

I also give to my Son Edward Wagoner the Refusal of Renting said Farm at the Annual Rent of Thirty-six Dollars.

After the death of my Wife, I leave all my property to be sold, both Real, Personal, and mixed, either for Cash or on Credit as my Executors, hereinafter mentioned, may think best as follows: I give and bequeath to my Daughter Eliza Mason, the amount of the Accounts I have against her and her husband which is One Hundred and One Dollars, and I also give to my Daughter Eliza Mason, Five Hundred Dollars in addition amounting to Six Hundred and One Dollars.

I give to my Son John Wagoner, Five Hundred Dollars which he has already received and for which amount I hold his Notes, with any Interest that may be due on said Notes, that is, not charging any Interest on said Notes.

I give to my Son Thomas Wagoner Five Hundred Dollars.

I give to my Daughter Rachel Watts Seven Hundred Dollars.

I give to my Son Edward Wagoner Five Hundred Dollars.

The balance of my Estate I leave to be equally divided amongst my four children, John Wagoner, Thomas Wagoner, Rachel Watts, and Edward Wagoner. And lastly I do hereby constitute and appoint my Son Thomas and Benjamin Watts my Executors of this my last Will and Testament, revoking and annulling all former Wills by me heretofore made, ratifying and confirming this and no other to be my last Will and Testament.

In Testimony Whereof, I have hereto set my Hand and affixed my Seal this Seventeenth Day of January, One Thousand Eight Hundred and Forth.

Signed, Sealed, Published, and Declared by Philip Wagoner the before named Testator as and for his last Will and Testament in the Presence of us, who at his request, in his Presence and in the Presence of each other have subscribed our Names as Witnesses thereto.
