Will of Jonathan Tracey 1869

Will of Jonathan Tracey of Baltimore County, Dated 27 March 1869

In the name of God Amen, Jonathan Tracey of Baltimore County in the State of Maryland being in perfect health of body and of sound mind memory and understanding considering the certainty of death and the uncertainty of the time thereof and being desirous to settle My Worldy affairs and thereby be the better prepared to leave this world when it shall please God to call me hence do therefore make and publish this my last Will and testament in Manner and form following, that is to say.

First and principally I commit my soul into the hands of Almighty God and body to the earth to be decently buried at the descretion of my executor herein after named and after my just debts and funeral charges are paid Idevise and bequeath as follows:

I give and bequeath unto my son Joshua Tracey all my farming utensils of what soever nature or kind of which I die siezed and possessed also the crops that may be growing on the ground that is to say a winters or summer crop Also all the straw fodder hay and corn husks also all my harnesses that is to say wagon harness and plow Gears

and whereas I have possessed of cetain real estate lying in Baltimore County whereon I now reside it is My Will and I do hereby order will and direct My executors herein after named to sell the land at public sale or private as mmy executors may decide most advantegeous to my estate at any time within two years after my death and I do hereby empower my executors or the survivor of them to mmake execute and acknowledge to the purchaser thereof a good and sufficient deed of conveyance for the Source and proceeds arising from the sale together with the proceed of the residue of my personal property not heretofore devised.

I will and devise the Source to be equally divided between my following named children and granddaughter Share and Share alike. Thomas C. Tracey's children to Heir in my estate, Lucy Ann who is intermarried with Noah S Cofield, Richard C. Tracey, My granddaughter Margaret Armacost, Rachel who intermarried with John W. Armacost, Mary who is intermarried with Luther A. Martin, John Tracey, William Tracey, Pothies Tracey, and Abberilla who intermarried with Abijah H. Cole or their legal representatives, Share and share alike

and Lastly I do hereby Consititute and appoint My sons Richard C. Tracey and Joshua Tracey to be jointauthorizing and Empowering them to do andperform every matter Cause or think contained in this My Last Will and Testament ordered and directed to be done. I hereby revoke and annull all former wills by me heretofore made, ratifying and confirming this and none other to be my last Will and testament In testimony whereby I have hereto set My hand and affixed Mt seal this twenty seventh day if March in the year of our Lord Eighteen hundred and sixty nine.

Baltimore County,SS. On the Twenty Fifth day of April 1874 came Richard C.Tracey and made oath on the Holy Evangely of Almighty God that he does not know of any other Will or Codicileof Jonathan Tracey late of said County, deceased other than the above instrument of writing and that he received the same from the deceased's desk with other papers of the deceased on or about the 14th day of April 1871. Sworn to in open Court Test: O.F.Macgill REgister of Wills for Baltimore County.

Baltimore County SS. on this 25th day of April 1871 came Abraham Bossom & William C. Sparks subscribing witnesses of the aforegoing Last Will and Testament if Jonathan Tracey late of said County, deceased, and made Oath on the Holy Evangely of Almighty God that they did see the testator Sign and seal this Will that they heard him publish pronounce and declare the same to be his Last Will and Testament that at the time of his so doing he was to the best of their apprehension of sound and pisposing mind memory and understanding and that they together will William Curtis subscribed there names as witenesses to this will in his poresence at his request and in the presence of each other, Sworn to in Open Court.
