Will of William T Matthews 1857

Last Will and Testament of William T. Matthews of Baltimore County, Dated April 8, 1857, Probated March 19, 1862

In the name of God Amen. I, William T. Matthews, of Baltimore County, in the State of Maryland, being weak in body, but of sound and disposing mind, memory, and understanding, considering the certainty of death and the uncertainty of the time thereof, and being desirous to settle my worldly affairs and thereby be the better prepared to leave this world when it shall please God to call me hence, do therefore make and publish this my last will and testament in manner and form following that is I say.

First and primarily, I commit I commit my soul into the hands of the Almighty God, and my body to the earth, to be decently buried at the discretion of my executors hereinafter named, and after my debts and funeral charges are paid, and my wife's thirds are taken out, I devise and bequeath the following.

Item, I give and bequeath unto my son in law, Randolph Young, the land which I have heretofore given him in a deed, for as his wife, Sarah Jane, full share of my estate both real and personal and no more.

Item. I devise and bequeath that all my estate, both real and personal, mixed and otherwise, be sold by my executors hereinafter mentioned, and equally divided between my seven children and my three step children namely, Rosena Matthews, Rachel Ann Matthews, William Wesley Matthews, Edward Clarke Matthews, Eli Free Matthews, Mary Elizabeth Matthews, Jeremi Francis Matthews, John Curfman, Elizabeth Dougherty, and Daniel Curfman in equal portions, share and share alike. And I hereby authorize and empower my executors, hereinafter named, to execute deeds or deed for all my real estate, as good as I could do if I were living and present, to execute the said deeds or deed. And I hereby authorize my executor, not to sell my real estate before twelve months after my death said real estate when sold to be sold with interest.

And lastly, I do hereby constitute and appoint Valentine W. Price, and Daniel Curfman, to be sole executors of this my last will and testament, revoking and annulling all former wills by me, heretofore made ratifying and confirming this and none other to be my last will and testament.

In testimony whereof I have hereunto set my hand and affixed my seal this eight day of April eighteen hundred and fifty seven.

Signed sealed and published and declared by William T. Matthews, the above named Testator, as and for his last will and testament in the presence of us, who at his request in his presence, and in the presence of each other, have subscribed our names as witnesses thereto.

Baltimore County, S.S. on this 19^th day of March 1862, came John Rigner Jr. one of the subscribing witnesses to the aforegoing last will and testament of William T. Matthews, late of said County, deceased, and made Oath on the Holy Evangely of Almighty God, that he did see the testator sign and seal this will that he heard him publish pronounce and declare the same to be his last will and testament that at the time of his so doing he was to the best of his apprehension of sound and disposing mind memory and understanding and he together with William Davis and William Shauck subscribed their names as witnesses to this last will in his presence at his request and in the presence of each other.

Baltimore County, S.S. on this 19^th day of March 1862, came Valentine W. Price, and made Oath on the Holy Evangely of Almighty God, that he doth not know of any other will or codicil of William T. Matthews, late of said County, deceased, other then the above instrument of writing, and that he received the same from William Davis since the death of deceased.

To the Honorable; The Judges of Baltimore County Orphans Court, Gentleman, I hereby relinquish my executorship in the Wm. T. Matthews will. Given under my hand and seal this 18^th day March 1862.

Additional Probate of William T. Matthews; Last Will and Testament

On this 26^th day of may 1863, came William Davis subscribing witness of the aforegoing last will and testament of William T. Matthews late of said County, deceased, and made Oath on the Holy Evangely of Almighty God, that he did see the testator sign and seal his will that he heard him publish pronounce and declare the same to be his last will and testament that at the time of his so doing he was to the best of his apprehension of sound and disposing mind memory, and understanding and he together with Wm Shanck and John Rigner Jr subscribe their names as witnesses to this will in his presence at his request, and in the presence of each other.
