Last Will & Testament of Edward Gill, Sr., of Baltimore County, Dated 5 Oct 1818, Proved 9 Dec 1818
In the Name of God Amen. I Edward Gill Senior of Baltimore County in the State of Maryland being sick and weak in body but of Sound and disposing mind memory and understanding Considering the Certainty of death and the uncertainty of the time thereof and being desirous to settle my worldly affairs and thereby be the better prepared to leave this world when it shall please God to call me hence do therefore make and publish this my last will and Testament in manner and form following that is to say.
First and Principally I commit my Soul into the hands of Almighty God and by Body to the Earth to be decently buried at the discretion of my Executor and Executrix hereinafter named and after my debts and Funeral Charges are paid I devise and bequeath as follows. I give and bequeath unto my dear wife Mary Gill all my Estate both Real and Personal during her natural life except such part of my Personal Estate as hereinafter will and bequeath unto my Daughter Agnes McClane Gill. Any my will is that my Son Edward Gill Junior shall have his Board found and a Horse kept free and Clear of any Expences or cost by his mother during her natural life. Also that my Daughter Agnes McClane Gill shall have her Board found and Horse kept by her mother free and clear of any Expence or Cost during the time she lives a single life and after the death of her mother my will is that she shall have her Board found and Horse kept by her Brother Edward Gill Junior, free and clear of any Expence or cost during the time she lives a single life.
Item. I give and bequeath unto my Son John Price Gill the sum of four Hundred Dollars Current money to be paid by my hereafter named Executor and Executrix in yearly payments of thirty Dollars in each year. Should he not live to draw it all what remains is to be equally divided between his two sons Ezekiel C. Gill and Edward Gill. I also give and bequeath unto my son John Price Gill all Book accounts which I have against him also all my wearing apparel excepting my new Great Coat.
Item. I give and bequeath unto my Daughter Mary Gill the sum of four hundred Dollars Current Money to be paid to her by my hereafter named Executor and Executrix in twelve months after my decease also all Books Accounts which I have against her.
Item. I give and bequeath unto my son Mordicai Gill the sum of four hundred Dollars Current money to be paid to him by my above named executor and Executrix in twelve months after my decease also my new great Coat and all Book Accounts which I have against him.
Item. I give and bequeath unto my daughter Agnes McClane Gill eighty shares of Mechanic Bank stock, one thousand Dollars Specie, Six Silver Table Spoons, Six Silver Desret [Dessert] Spoons, Twelve[?] Silver Tea Spoons, one pair Silver Sugar Tongs, one silver Cream Pot, six Bed quilts, Two Counter[?], Four pair of homemaid blankets, Four Feather Beds, four pair of sheets, four pair of Pillow-Cases, one suit of curtains, one Bay Mare Called sylvia, One Bridle and one Saddle, a Piece of Table Linnen marked with the initials of her name. I also give and bequeath unto my Daughter Agness McClane Gill two Female Servants the one called Anny and the other Called Henny, but she is not to have possession of them untill the decease of her mother.
Item. I give and devise unto my son Edward Gill Junior my youngest son my Plantation whereon I now dwell being part of a Tract of land Called Nicholsons Manor Containing one hundred and thirty three acres more or less also all my part of a Tract of Land Called [?]reaghs Addition Enlarged Containing one hundred and fifty six acres more or less also all the stock and Farming utensils Household Furniture and every other thing that shall be on my Plantation or Plantations at the time of my dear wifes decease, except such legacies as is heretofore mentioned to him the said Edward Gill Jun his heirs and assigns forever.
Item. I give and bequeath unto my Grandson Edward Gill, son of John Price Gill, my Silver Watch. My will is that my negro man named Jerry who is at this time runaway shall be sold if ere he is caught and the Balance of the money arising from said sale after the expences are paid for taking him up I will and bequeath unto my dear wife Mary Gill.
And Lastly I do hereby Constitute and appoint my son Edward Gill Junior Executor and my dear wife Mary Gill Executrix of this my last will and Testament revoking and annulling all former wills by me heretofore made, ratifying and confirming this and none other to be my last will and testament. In Testimony whereof I have hereunto set my Hand and affixed my seal this fifth day of October in the year of our Lord one thousand eight hundred and Eighteen.

Darby Ensor Aged sixty four years one of the subscribing witnesses to the aforegoing Last Will and Testament of Edward Gill Senior late of Baltimore County deceased being duly Sworn deposeth and saith that some time on or about the first day of October last he was sent for by the said Edward Gill to write his will that he accordingly went to his Dwelling House on Saturday the third day of October 1818 and at the request of said Edward Gill wrote the Paper writing now exhibited as the will of the said Edward and read the same in his presence that the said Edward Gill signed and executed the said will in the presence of the deponent and in the presence of Stephen Gill of Nicholas and Lewis Pitts whose names are erased and obliterated, that he declared the same to be his will and at the time was of Sound Mind and perfectly in his Senses, that the deponent took the will and together with the said Stephen Gill and Lewis Pitts went into an adjoining Room where they all subscribed their names as Witnesses. And this deponent further Saith that he returned home on Saturday Evening and on Sunday concerning that some difficulty might arise in consequence of the will having been Witnessed out of the room where the said Edward then lay he went back to the dwelling House of the said Edward Early on Monday morning the 5th of October and mentioned the Circumstances and his fear to the said Edward that the said Edward then directed his son Edward Gill Junior to blot and cross out his name and to write his name over[?] again he being very sick and weak, that the said Edward Gill the younger did then and thereby the direction of his Father and in his presence immediately cross out and obliterate the [word omitted] of the Said Edward Gill Senior and wrote the name of Edward Gill Senior thereunder as appears by the Said Paper writing herewith Exhibited, that after the name was so signed by the said Edward Gill the Younger the said Edward Gill Senior acknowledged republished and declared the Said Paper writing to be his last will and Testament, that at the time of his so doing he was of Sound disposing mind memory and understanding, that the deponent together with Joseph Cole and Lewis Pitts in the presence and at the request of the Said Edward Gill Senr signed and Subscribed their names as Witnesses to Said will and the deponent further Saith that the names of Stephen Gill, Darby Ensor, and Lewis Pitts were obliterated by the Deponent and that the date of the will was also altered by him in the presence of the Said Edward Gill at the time the new execution took place at the time.
Lewis Pitts of lawful age being duly Sworn deposeth and Saith that he was present and did see Edward Gill Senior Sign and seal declare and publish this paper writing now herewith Exhibited as his last will and Testament and that he at the time was of sound disposing mind and in his perfect senses and that he together with Stephen Gill and Darby Ensor went into an adjoining room and subscribed their names as witnesses to the said will at the request of the Testator. And the deponent further Saith that on Monday Morning the 5th of October last the deceased having been informed that some difficulty might arise on account of his will being witnessed out of his presence directed his son Edward Gill to obliterate and cross out his name and to sign his name again the deceased being very sick and low in health, that the said Edward Gill the younger did then and there cross out the ------- in the presence of the said Edward the Testator, Cross out the name and write the name Edward Gill Senior as appears on the said Paper writing, that the said Edward Gill senior did then and there immediately afterwards acknowledge republish and declare the said paper writing to be his last will and Testament and was at the same time of Sound disposing mind memory and understanding and that the deponent together with Darby Ensor and Joseph Cole signed their names as witnesses thereto in the presence and at the request of the Testator and of Each other.
Joseph Cole of lawful age being duly sworn deposeth and saith that he was present at the Dwelling House of Edward Gill Senr on the 5th day of October 1818 and did hear him direct his son Edward Gill to cross out his name and write his name to the will again which the said Edward Gill the Younger did do as appears by the paper writing herewith exhibited, that the same was done in the presence of the Testator and in the presence of the deponent and Darby Ensor and Lewis Pitts the other Witnesses, that the said Edward Gill Senr after his name was so written by his Son did then and there acknowledge republish and declare the said paper writing to be his last will and testament, that at the time of his so doing he was to the best of the deponents apprehension of sound disposing mind memory and understanding that the deponent together with Lewis Pitts and Darby Ensor subscribed their names as witnesses thereto in the presence of each other
