Will of Joseph Bruder 1863

The Last Will and Testament of JOSEPH BRUDER, of Baltimore county, Dated November 22, 1863, Proved 2 Feb 1864

In the name of God, Amen. I, Joseph Bruder of Baltimore County, being weak in body, but of sound and disposing mind, memory and understanding, do hereby make, publish and declare this my last will and testament, hereby invoking and making null and void any and all other last will and testaments by me any time heretofore made.

And first I will and direct that all my just debts, funeral and testamentary expenses, and the expenses attending the administration of my estate be paid be my executrix, herein after named out of my estate.

Item-I give, devise and bequeath all the rest and residue of my estate, real, personal and mixed after the payments of the debts and expenses aforementioned, unto my wife, Mary Maria Bruder, to her proper and sole use and behoof, having full confidence that she will use the same in the best manner for the interest and advantage of my and her children, and I intend that she shall have full power to use, occupy and enjoy the said property, or to sell and dispose of the same as she may think best, and the rent issues, and profits, or the proceeds of the sale thereof, to take and apply as she thinks proper and to execute and deliver deed for the real Estate, and I hereby constitute and appoint my said wife sole executrix of this my last will and testament. In the witness whereof I have to this my last will and testament set my hand and affixed my seal this twenty-second day of November eighteen hundred and sixty three.

Signed, sealed, published and declared by the said testator Joseph Bruder as and for this last will and testament in the presence of us who at his request and in his presence and in the presence of each other have subscribed our names as witnesses hereto.

On the 2nd day of February, 1864 came Mary Maria Bruder and made Oath on the Holy Evangily of Almighty God, that she doth not know of any other will or codicil of Joseph Bruder, late of said County, deceased, other than the above instrument of writing, and that she received the same from Thomas H. Robinson on or about the 20th Day of December 1863.

On this 2nd day of February 1864 came Joshua Eagleston and Adam Scharf subscribing witness to the aforegoing last will and testament of Joseph Bruder late of said County, deceased, and made oath on the Holy Evangely of Almighty God that they did see the Testator sing and seal this will that they heard him publish, pronounce and declare the same to be his last will and testament, that at the time of his so doing he was to the best of their apprehension of sound and disposing mind, memory and understanding, and that they together with William Lutz subscribed their names as Witnesses tot he Will in his presence at his request, and in the presence of each other.

Greeting,
This is to authorize you, jointly to appraise the goods and chattles and personal estate of Joseph Bruder, late of Baltimore County, deceased, so far as they shall come to your sight and knowledge, each of you having first taken the oath, or affirmation, hereto annexed, a certificate whereof you are to return, annexed to an inventory of the said goods, chattles, and personal estate by you appraised, in Dollars and Cents; and in the said inventory you are to set down in a column or columns opposite to each article the value thereof.

The Appraisers before they proceed to work must take the following oath or affirmation, viz: We John S. Biddison, and William Lutz do swear (or solemnly, sincerely, and truly affirm) that we will well and truly, without partiality or prejudice, value and appraise the goods, chattles and personal estate of Joseph Bruder, deceased, so far as they shall come to our sight and knowledge, and will in all respects, perform our duty as Appraisers, to the best of our skill and judgement, so help us God.

Inventory appraised by the subscribers John S. Biddison and William Lutz jointly, and having been first authorized by law as will be seen by the warrant to appraise, and Certificate therein annexed.
