STANSBURY, THOMAS
Pro Forma decree as to the Stansbury wills. On the 17th inst. Ex-Judge Yellott and Mr. W. Frank Mitchell, as counsel for Mrs. Eudocia Stansbury, filed a bill in the Circuit Court for Baltimore County asking for the construction of a clause in the will of Thomas Stansbury, deceased. The case was docketed under the title of Eudocia Stansbury, widow, plaintiff, vs. John Hubner, Joseph M. Cone, Eben B. Hunting and Frederick Rice, defendants. The bill then states that Thomas Stansbury, by his will dated November, 1816, left to his grandson, Thomas Stansbury, the husband of the plaintiff and the heirs of his body so long as they held and till the same certain lands in Baltimore county, including the parcel of land sold by Mrs. Eudocia Stansbury to the defendants, Hubner and others. The devise was as follows: I give and bequeath to Deborah Stansbury and Anna Powell, my daughters, all that tract of land whereon I now live called Daniel s Gift together with Carr s Lot and Tracy s Park , during their natural life, and at their decease the then tracts of land above mentioned I will and give to my grandson, Thomas Stansbury, son of my son John, excepting the part hereafter bequeathed to him and the heirs of his body so long as thy hold and till the same. Should he die without heirs of his body, my will and desire is that my grandson, Thomas Taylor, should have it, him, his heirs forever; and if Thomas should die without an heir then the aforementioned land to fall unto my grandson, James Taylor, to him, his heirs and assigns forever. On August 14th, 1817, said Deborah Stansbury and John Powell and An Powell, his wife, and Thomas Stansbury, son of John, executed and delivered to a certain Elizabeth Edwards a deed in fee of all the land which was devised as aforesaid to the said grantors by the will of Thoas Stansbury, mentioned in the preceding paragraph; and the same land was on the same day conveyed by the party named to Deborah Stansbury and Ann Powell for life, with remainder to Thomas Stansbury; that the said Ann Powell and Deborah Stansbury are dead; that Thomas Stansbury, the husband of the plaintiff, died in 1857 leaving an heir who also died; that Thomas Stansbury by a will of date March 31st, 1856, left all his property to his widow, Eudocia Stansbury, and she has held possession ever since. On June 16th, 1864, Eudocia Stansbury made a mortgage upon the above lands; that on May 28th, 1890, the plaintiff contracted in writing to sell to John Hubner, Joseph M. Cone, Eben B. Hunting and Frederick Rice in fee, free from incumbrances, at and for the sum of $150 per acre the lot of land being part of the land devised as set forth by the wills of Thomas Stansbury, the elder, and Thomas Stansbury, the younger, situate in Baltimore county. Doubts have arisen as to the true operation and effect of words so long as thy hold and till the same, used in the will of Thomas Stansbury, the elder, in the device of the lands in question to his grandson, Thomas Stansbury, the younger, under whom the plaintiff claims title, and this case is brought for the purpose of procuring a judicial construction thereof. And if the Court shall be of the opinion that the plaintiff claiming title in the manner herein set forth owns and can convey a fee simple title in and to the said land, then the defendants are ready and willing as soon as the plaintiff had paid off and procured to be released the mortgage given. But if the Court shall be of the opinion that the plaintiff claiming title to the lands in question in the manner herein set forth cannot convey the same by a clear fee simple title to the defendants, then the plaintiff is willing that a decree be passed in the case dismissing her bill and releasing the defendants from their said contract of purchase of the lands. Copies of the wills of Thomas Stansbury, Sr. and Jr., were filed in the case. The decree passed by Judges Fowler and Burke in the case is as follows: It is ordered and decreed fro forma that the bill of the plaintiff in the above entitled cause be and the same is hereby dismissed, and that the defendants be and they are hereby released from their contract of purchase of the lands from the plaintiff in the proceedings mentioned, and it is further ordered and decreed that the cost in this case be paid one half by the plaintiff and one half by the defendants. An appeal was taken from the decision above given and the case will be carried to the Court of Appeals at Annapolis. Messrs. Schmucker and Whitelock appeared as counsel for Messrs. Hubner, Cone, and others. –– Maryland Journal, 20 Sept 1890

Taggart, the ground in question, and that the assignment was not recorded until after her death, that subsequently, Robert B. TAGGART, HAZELTINE
(Circuit Court) James J. Miller, administrator of Hazeltine Taggart and others, through Frank Gosnell, his attorneys, on Monday filed a bill of complaint against Lemuel D. Offutt and James Taggart, administrators of Robert B. Taggart, Gebhard Bulke and James Pierpont. The bill states that Hazeltine Taggart acquired during her lifetime certain property which, shortly before her death, she was, by undue influence, persuaded to convey to her husband, which, itself, is claimed illegal, and, besides she was in such a state of mind as to be unable to make a valid deed. The property afterwards mortgaged for $3,000 by R. B. Taggart, in which, it is claimed, he held only a life estate. Mr. Pierpont a short time ago sold the property under foreclosure of mortgage of $600, which was given by Hazeltine Taggart. The bill asks that the court may pass a decree ordering Mr. Pierpont to turn over the remainder purchase money, after deducting the expenses of the sale and payment of the mortgage. –– Baltimore County Democrat March 30, 1895

Judge David Fowler has filed an opinion in the case of James J. Miller, administrator of Mrs. Hazeltine Taggart and others, against Lemuel D. Offutt and James C. Taggart, administrators of Robert B. Taggart, claim the money on the allegation that the property was paid for by Mr. Taggart were made in fraud of her husband's creditors and should be set aside. The court holds that at the time the conveyances were made, in 1884 and 188?, Mr. Taggart was solvent, and that the deeds should not be set aside. The case was argued by Mr. Frank Gosnell on behalf of the plaintiffs and Messrs. D. G. McIntosh and J. P. Bannon for the defendants. –– Baltimore County Democrat, April 25, 1896

WEBSTER, LEE
On Saturday last, in the Circuit Court at Towson, Judges Fowler and Burke signed an opinion in the case of Lee Webster against William T. Lee et al. The matter at issue was a petition filed by James C. Dennis, administrator d. b. n. c. t. a., of Lee Webster, deceased, asking that Richard S. Albert, trustee, be required to account for an alleged balance due to estate of his decedent. The court dismissed the petition. The facts in the case were set out at length by the court, and are somewhat involved.
Briefly, they are that William Webster died owning, with other property, a five-sixth interest in Mount Repose farm, near Cockeysville. One-fourth of his whole estate he left to William T. Lee, in trust for Margaret L. Webster, his wife, and Lee Webster, his son. Lee failed to qualify and Albert was appointed a trustee in his place. Robert Henderson was his executor. He sold Mount Repose to Lee Webster for $10,833.33. Albert received as one-fourth of the estate $6,427.47, all of which was invested in mortgages on Mount Repose. Lee Webster owed his mother, besides this to the trustee, $10,000. Mrs. Webster also borrowed $1,500 and assigned one of her mortgages as security for it, and gave this sum also to Lee. The property was again sold, and this time bought by Mrs. Webster for $11,000, the purchase price being applied to the trust mortgages and to the payment of her own. The trust money was again invested in mortgages on this property subject to a loan of $3,500 made by Emanuel Herman. The mortgage to Herman was foreclosed and the property only brought enough to pay $2,023.76 on the mortgages held by the trustee.
The court held that the trustee should not be made to account for this. That as Lee Webster had died before his mother, and had made her his sole devisee, and she had enjoyed the money no substantial wrong had been done to anybody. –– Baltimore County Union, 8 Nov 1902

WHITEFORD, JOHN, SR.

Laura Wilson, &c. vs. Philip Wilson &c. In the Circuit Court for Baltimore County. The object of this suit is to procure a Decree for a sale of certain real estate of Philip Wilson, late of Baltimore county, deceased.
The Bill states that said Philip died intestate, seized and possessed of certain real estate in said county, and leaving Laura Wilson his widow, and Ann Maguire Margaret Lynch, intermarried with George Lynch, William Wilson junior, Rebecca Wilson, David Wilson, Jane Coaling intermarried with John Coaling, Anna Wilson, and Benjamin Wilson, the complainants, with the defendants, Philip Wilson, Robert Wilson and Henrietta Watts intermarried with ---- Watts (as in paper), his heirs at law. That said real estate is not susceptible of division, and that it would be for the interest and advantage of all parties that the same should be sold and the proceeds divided among the parties according to the several interests, but that no sale can be made because the said Philip Wilson, -----Watts, and Henrietta his wife, reside out of the state of Maryland, in parts unknown to complainant. It is thereupon, this 22d day of October, 1858, adjudged and ordered, that the complainants, by causing a copy of this order to be inserted in some newspaper published in Baltimore county, once a week for four successive weeks before the 30th day of November next, give notice to the said absent defendants of the object and substance of this bill, and warn them to appear in this court, in person or by solicitor, on or before the tenth day of March next, to answer the premises, and show cause, if any they have, why a decree should not pass as prayed. WORLEY, JOHN A.
Judge Burke has filed an opinion in the case of John J. Dobler, trustee, under the will of John A. Worley, against Mary C. Worley and others. The suit was brought for the purpose of having the will of Mr. Worley construed, or to determine who is entitled to receive the residue of the estate now in the hands of the trustee, who, since the death of Mr. Worley, was elected a member of the Supreme Bench of Baltimore City. Judge Burke holds that the residue of the estate vests in the testator s daughter, Mary Celinda Worley, and that his wife, Mrs. Johanna Worley, has no interest in it. In his opinion Judge Burke says in regard to the construction of the will:
During the widowhood of his wife, Johanna Worley, she was to receive from the trustee the whole net income of the estate. In the event of her remarriage she was to receive only the house No. 2028 Madison avenue and $10,000, and the balance of the estate was to be held by the trustee for the use of any child or children of the testator left living at the time of his death.
Upon the death of the wife the same persons would take the residue of the estate as would take it in the event of her remarriage.
The testator left surviving him one child, Mary Celinda Worley, who is an infant and who is now living. The widow having renounced the provisions of the will, and having had her dower set apart for her, and having received from the executor of the estate of John A. Worley her share of the personality, must for the purpose of this case be considered as dead. And having in contemplation of law departed this life, I will decree that the entire estate of John A. Worley now in the hands of John J. Dobler, trustee, is vested in Mary Celinda Worley, the infant daughter of the testator, and that upon her attaining her majority it will be the duty of said trustee to transfer said estate of her absolutely.
The mother of the late Mr. Worley, whose estate he inherited, was a daughter of the late Edward Rider, Sr., and owned valuable property in the neighborhood of Sherwood, N. C. R. R. –– Baltimore County Union, 9 March 1902
