Will - Anthony SWICAFER

Dated 01 Sep 1827; Proved 18 Apr 1831

In the name of God, Amen, I Anthony Swicafer of Anne Arundel County in the State of Maryland, being weak in body, but of a sound, disposing mind, memory and understanding, considering the certainty of Death, and the uncertainty of the time thereof, and being desirous to settle my worldly affairs, and thereby be the better prepared to leave this world when it shall be the will of God to call me home, do therefore make and publish this my last will and testament, in manner and form following, that is to say. First and principally I commit my soul into the hands of Almighty God, but my body to the earth to be decently buried at the discretion of my executor hereinafter named and after my just debts and necessary funeral charges are paid, I give and bequeath as follows.........

Item the first; I give and bequeath unto my daughter Catherine Smith, the wife of Nicholas Smith, one hundred dollars to be paid in three years after the day of my death, clear of interest if paid in that time, to her & her heirs forever.

Item 2: I give and bequeath unto Ann Mariah Crawford, the sum of fifty dollars to be paid unto her in two years after my death, clear of interest, also one feather bed, two pillows, one bolster, two sheets, two quilts, and one bedstead, one cow and two sheep, and also in addition to the above I give her my underfeather bed, to her & her heirs forever, in case the said Ann Mariah Crawford continues to behave in a dutiful and respectful manner to me.

Item No 3: I give and bequeath unto my son John Swicafer and Ann Mariah Crawford my household & kitchen furniture to be equally divided between them, and recommend that they divide it between themselves to suit each other.

Item the 4th; I give and bequeath unto my son John Swicafer, to him and his heirs forever, all my Real Estate of every description, together with all my ploughs, harrows and farming utensils, my waggon and geers of every kind, horses, sheep and horned cattle, wheat fan, and home. It is my desire that my son John pay unto Catherine Smith or her heirs six dollars in addition to the deviso of one hundred dollars for her share of the home, & that she have the six dollars paid to her soon after my decease, say thirty days.

Item the 5th. I give my wearing apparel of all kinds whatsoever to do with as he shall think fit to John Swicafer. And lastly, I do hereby constitute and appoint my son John Swicafer to be solo executor to this my last will and testament revoking and annulling all former wills made by me, ratifying and confirming this and none other to be my last will and testament. In testimony whereof I have hereunto put my hand and seal this first day of September in the year of our Lord, one thousand eight hundred and twenty seven.

Anthony Swicafer the above testator as and for his last will and testament in the presence of us, who at his request, in presence and in the presence of each other have subscribed our names as witnesses.

The named Lloyd Selby and Adam Delawder two of the subscribing witnesses to the aforegoing last will and testament of Anthony Swicafer late of Anne Arundel County, deceased, and made oath on the Holy Evangely of Almighty God, that they did see the testator named sign and seal this will and that they heard him publish pronounce and declare the same to his last will and testament, that at the time of his so doing he was to the last of their apprehensions of sound and disposing mind memory and understanding and they together with Luke Mercer the other subscribing witness respectively subscribed their names as witnesses to this will in the presence and at the request of the testator and all in the presence of each other.
