Will - James SEWELL

Dated 09 Dec 1834; Proved 21 Feb 1835

In the name of God Amen, I James Sewell of Anne Arundel County in the State of Maryland being weak of body but of sound disposing mind, memory and understanding considering the certainty of death and the uncertainty of the time there of and being desirous of settling my worldly affairs that I my be the better prepared to leave this world when it shall please God to call me hence do publish this my last Will and Testament in manner and form as follows.- First and principally I commit my soul into the hands of Almighty God and my body to the earth to be decently buried at the discretion of any Executor herein after named and after my Just debts and funeral charges are paid I devise and bequeath as follows.

- Item, I give and devise unto my daughter Nancy Tracy the House in which she now resides, with five acres of land and after her death to be equally divided or apportioned among all her male children share and share alike. ~

Item, I give and devise unto my daughter Sarah Humbleback five acres of land adjoining that of Nancy Tracy s during the life of the said Sarah Humbleback and after her death to be equally divided or apportioned among all her male children share and share alike.~

Item, I give devise and bequeath all the residue of my real Estate to be equally divided or or apportioned among my son Thomas Sewell and my daughter Eliza and after the death of the said Eliza that portion of my Estate given and devised to her to be equally divided among all of her male children, and all my personal Estate to be equally divided or apportioned among Thomas Sewell and his sister Eliza, share and share alike.~

And lastly I hereby appoint and consti =tute John Frost of Js to be executor of this my last Will and testament- In testimony whereof the said James Sewell has hereunto set his hand and seal this ninth day of December in the year 1834.~

Then came John Frost of James and Mary Westly, two of the subscribing The 21st day of February 1835. witne ses to the aforegoing last Will and Testament of James Sewell, late of Anne Arundel County, deceased, and made oath on the Holy Evangely of Almighty God, that they did see the testator therein named sign and seal this Will and that they heard him publish, pronounce and declare the same to be his last Will and testament, that at the time of his so doing he was to the best of their apprehensions of sound and disposing mind, memory and understanding and that they together with William Baker Dorsey the other subscribing witne s respectively subscribe their names As witne ses to this will in the presence and at the request of the testator and all in the presence of each other.

Then came John Frost of James, and made Oath on the Holy The 21st day of February 1835. Evangely of Almighty God, that the foregoing instrument of writing is The true, whole and last Will and testament of James Sewell, late of Anne Arundel County Deceased, that hath come to his hands and profese sion and that he doth not know of any other. ~
