Will - Walter PUMPHREY

Dated 01 Feb 1816; Proved 10 Aug 1818

In the name of God Amen. I, Walter Pumphrey of Anne Arundel County, farmer, being in perfect health of body and of perfect mind and memory, thanks be given unto God; calling unto mind the mortality of my body and knowing that it is appointed once for all men to be to make and ordain this my last Will and Testament; that is to say principally and first of all I give and recommend my soul into the hand of Almighty God that gave it and my body I recommend to the Earth to be buried in decent Christian burial at the discretion of my Executor, nothing doubting but at the general Resurrection I shall declare the same again by the mighty Power of God - and as touching and worldly state wherever it has pleased God to bless me in this life, I give, devise and dispose of in the following manner -

It is my will that all my just debts be paid by my Executor and that all persons indebted to my Estate be required by my Executor in due time to satisfy and pay or otherwise to settle and receive what is due.

Item - I give and devise unto my son Walter Pumphrey and unto his heirs and assigns forever, all and singular the tract of land or plantation whereon I now live being part of several original tracts called Suttons Choice, Alridge's Beginning and the content; on condition that he pay to my daughter Keturah Pumphrey six hundred dollars current money in four payments. The first payment to be made when she is sixteen and the last to be made when she is twenty years of age. But if it is not the choice of my son Walter Pumphrey to do this or _______________ it is my wish ________________ I do hereby give and bequeath unto my Daughter Keturah and unto her heirs and assigns forever eighty acres of _________ and tract of land or plantation whereon I now live. To be laid off on this side of part adjoining the land of Charles Waters Esquire. Beginning at my line in the branch to certain distance up said Branch, thence running parallel with the land between my land and the lands of Charles Waters Esquire to the main road leading from Severn Ferry to Waters Mill so that said line will enclose just Eighty acres. For consideration of the before mentioned devise it is my will and desire that my son Walter Pumphrey pay my daughter Dilly Pumphrey the sum of one hundred dollars current money fifteen months after my decease and Excepting as hereafter excepted.

Item - I give and devise unto my daughter Elizabeth Pumphrey and unto my son Charles Pumphrey and unto their heirs and assigns forever all that Misonage?? or tract of land at the head of Severn called Hammonds Retreat except one fifty seven acres I sold to Charles Waters Esquire and fifty acres I sold to Dr. James Murry - the division line between my daughter Elizabeth Pumphrey's share and my son Charles Pumphrey's share shall be the drain or outlet of a well known pond of water, the Frog Pond which runs through said tract and empties into the Bear branch, my Daughter Elizabeth Pumphrey shall have the upper part adjoining the part sold to Doctor James Murry and my son Charles Pumphrey shall have the lower part adjoining Severn River and the part I sold to Charles Waters Esquire. In consideration of the above devise it is my will and devise that my daughter Elizabeth Pumphrey pay unto my daughter Dilly Pumphrey one hundred dollars current money fifteen months after my decease excepting as is after excepted.

Item - I give and bequeath unto my daughter Dilly Pumphrey two hundred dollars current money to be made up out of my estate and paid to her fifteen months after my decease - one hundred dollars are to be paid of my Daughter by my son Walter Pumphrey and one hundred dollars are to be paid of my Daughter Elizabeth Pumphrey, excepting my said Daughter Dilly Pumphrey should leave my house and go from home to live before her marriage or my decease in which case she shall have no part or share of my estate whatever. And my son Walter and Daughter Elizabeth Pumphrey are hereby released from paying the amount willed for them to pay or any part thereof.

Item - I give and bequeath unto my sons Walter and Charles Pumphrey each one horse. I give and bequeath unto my five children Dilly, Walter, Elizabeth, Charles, and Keturah the residue of my personal property to be divided among them share and share alike. Also I make, ordain, constitute and appoint my son Walter Pumphrey the sole Executor of this my Last Will and Testament and all and singular my lands, misouages??, and tenements or Estate and I do hereby utterly disallow revoke and disannul every other former Testament Will Legacies Bequest or Executor by me any way before named, willed, and bequeathed, satisfying and confirming this and no other to be my last Will and Testament.

In Witness Whereof I have hereunto set my hand and seal this first day of February in the year of our Lord One thousand eight hundred and sixteen. Signed sealed published and pronounced and declared by the said Walter Pumphrey as his last Will and Testament in the presence of us who in his presence and in the presence of each other have hereunto subscribed our names.

Anne Arundel County SS the 10th day of August, 1818. Then came Charles Waters one of the subscribing witnesses to the within last Will and Testament of Walter Pumphrey late of Anne Arundel County deceased, and made oath on this holy Evangely of Almighty God that he did see the Testator therein named make his mark, seal this Will and that he heard him publish, pronounce and declare the _____ his last Will and Testament, that at the time of his signing his will he appearing of sound disposing mind memory and understanding and that he together with Jacob Williams and Michael M. Marriott the then declarating witnesses respectively subscribed their names as witnesses to this Will in the presence and at the request of the Testator all in the presence of each other.

Anne Arundel County SS. Then came Walter Pumphrey Jun., appointed the 3rd day of November 1818 as Executor in the within Will and made oath on the holy Evangely of Almighty God that the within Instrument of writing is the true and whole Will and Testament of Walter Pumphrey Sen., late of Anne Arundel County deceased, that hath come to his hands or possession and that he doth not know of any other.
