Will - George GARDINER

Dated 12 Dec 1832; Proved 5 Mar 1833

In the name of God, Amen. I George W Gardner [sic] of Anne Arundel County and State of Maryland, being weak and low in body, but of sound mind, memory and understanding, considering the certainty of death and the uncertainty of the time thereof, and being desirous of settling my worldly affairs do make and publish this my last will and testament in form following:

First I commit my soul into the hands of Almighty God and my body to the earth to be decently buried and after my debts and funeral expenses are paid I give and bequeath as follows to wit:

Item, I give and bequeath unto my loving and affectionate mother Margaret Gardner, all my estate, real and personal of whatever kind, to her in fee simple forever, the same to dispose of in any manner she may please. And lastly I do hereby appoint my mother Margaret Gardner, Executrix of this my last will and testament hereby revoking all former wills made by me and ratifying and confirming this to be my last will and testament. In testimony whereof I have hereunto set my hand and affixed my seal this twelfth day of December in the year of our Lord eighteen hundred and thirty-two.

Signed, sealed and published by the aforesaid George W Gardner in the presence of us, who at his request, in his presence and in the presence of each other have subscribed our names as witnesses thereto.

Then came Samuel Owens and John S Hopkins, two of the subscribing witnesses to the foregoing last will and testament of George W Gardner, late of Anne Arundel County, deceased, and made oath on the Holy Evangely of almighty God that they did see the testator wherein named sign and seal this will and that they heard him publish, pronounce and declare the same to be his last will and testament, that at the time of his doing he was to the best of their apprehensions of sound and disposing mind, memory and understanding, and that they together with Henry Owens the other subscribing witness respectively subscribed their names as witnesses to this will in the presence and at the request of the testator and all in the presence of each other.

I hereby renounce my write [sic] of administration upon the property of my deceased son George W Gardner and do hereby recommend Samuel Owens as a fit and proper person.
