Will - Joseph CARR

In the name of God Amen. I Joseph Carr of Anne Arundel County in the State of Maryland being of sound mind, memory and understanding and do hereby make and constitute this my Last Will and Testament hereby revoking and annulling all former Wills made by me.

First, I commit my soul to the hands of my Creator and my body to the earth to be interred at the discretion of my Executors herein named and after all my just debts and funeral expenses are paid, I devise and dispose of my estate in the following manner:

Secondly, I Will and Bequeath to my nephew Philip Wesley Witright, the farm upon which I now reside, containing about two hundred acres of land to him and his heirs forever, excepting five acres more herein after bequeathed to Ellen Ann Dorsey, provided nevertheless that the said nephew Philip W. Witright pay the following legacies and annual payments to wit.

Thirdly, to James Henry Dorsey, son of Ellen Ann Dorsey, three thousand dollars, current money, when he arrives at the age of twenty one, and that he shall also pay to James Henry Dorsey, or his guardian, the sum of two hundred, current money, yearly after my death during his minority for his education and support and also that the said nephew Philip Wesley Witright shall pay to Frances Ann Dorsey (sister of James Henry Dorsey and daughter of Ellen Ann Dorsey) one thousand dollars, current money, with interest from and after my death, the interest to be paid to her guardian, yearly, for her support, the principal to be paid when she shall have arrived at the age of twenty years.

Fourthly, I will and direct that the children of my negro woman Mary; Liza, Lloyd, Ned, John and Daniel being all the children she now has and also all the children that may hereinafter be born to her until the year one thousand eight hundred sixty at which time she is to be free under the Will of my father Robert Carr shall be and go free as they severally and respectively attain the age of twenty five years if males, and eighteen years if female.

Fifthly, I will and direct that my negro man Nace and Isaac shall be and go free from and after the period of three years from my decease.

Sixthly, I Will and Bequeath unto Ellen Ann Dorsey, the mulatto woman whom I have recently mammitted by deed duly executed and recorded, the house and five acres of land more or less lying on the north side of the farm on which I now reside, near the creek that divides my farm from that of Stephen L. Lee's together with all the appurtenances thereto belonging to and beginning from the same, and a holly tree near the corn field fence and easterly from the house with said fence, Northwesterly to the creek and thence with a boundary on the creek, to a black walnut tree standing near the creek upon the bank a little north of a flat place and marsh and thence in a straight line to beginning, to have and to hold the same for and during the term of her natural life and after her death, to her two children James Henry Dorsey and Frances Ann Dorsey before named in this Will forever.

Seventhly, I Will and Bequeath to Ellen Ann Dorsey, one milk cow, one horse, four hogs, bedstead and furniture for her and her children.

Eighthly, my will and desire is that my brother Samuel Carr act as guardian to James Henry and Frances Ann Dorsey during their minority.

Lastly, I constitute and ordain my nephew Philip Wesley Witright my sole Executor, the regulatory legatee upon this my Last Will and Testament.

I witness whereof I have hereunto set my hand and seal this ninth day of December, one thousand eight hundred and fifty seven.

Signed, sealed and delivered by Joseph Carr, the above named Testator known personally to us, who at his request, in his presence and in the presence of each other subscribed our names and witnesses therefore their being first one word blotted out and in the fifteenth line of the first page and one part of word in the fourth line and one word in thirteenth line, second page blotted out.
