I Charles Hicks in the name of God Amen make this my last will and testament
this sixteenth day of December in the year of our Lord one thousand seven
hundred and ninety six being sick and weak of body but of perfect memory
take notice that I give and bequeath to my two sons Benjamin and Noah the
land and plantation whereon I now live to be equally divided between and
by themselves and if when they come of age either of them shall refuse to
[ ? ] on[ ] part and the other should he that [
] on the land above mentioned shall have the whole tract and take
notice that I give all the rest of my estate of whatsoever sort or kind of
property it may consist of after selling enough to discharge my just debts
with the use of the plantation to my loving wife Mary during her natural
life or widowhood and then to be divided between by (sic) seven children
Vizt. Frances, Nancy, Pinky, Benjamin, Noah, Patsey and Mary And I also leve
(sic) my brother William Hicks and Mary my wife my whole and sole
executors.

At a court held for Sussex County this 1st day of February 1816 The last Will and testament of Charles Hixs was presented into Court and proved by the oath of Anthony Evans one of the witnesses thereto who also deposed that Benjamin Evans and Jesse Evans other witnesses thereto subscribed their names in his presence and in the presence and at the request of the Testator and the same is ordered to be recorded and it appearing to the court that William Hix one of the exors therein named hath departed this life and Mary Hix having [ ] to the court that she would not qualify whereupon and on motion of Noah Hix who made oath and entered bond with security conditioned as the law directs administration with the Will annexed is granted him in due form.
