‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑‑

We the undersigned Commissioners having been appointed by the County Court to divide the land of the late Sallye Payne of Stafford Co. between her heirs in accordance to her last will and testament recorded in the County Court of Stafford ‑‑ did on the 15th day of April 1869 proceed as follows:  We first surveyed the whole land and ascertained it to measure 43 acres 2 rods and 21 poles. We then divided it into two equal parts and the children of James Payne preferring lot no. 1, we allotted that portion to them and Mary Johnson and Lucy Burton preferring the other half of said and containing 21 acres 3 rods and 10 poles blk 1 allowed that to them and dividing the said half into equal parts we allotted to Lucy Burton lot blk. 2 and to Mary Johnson lot no. 3 as will appear in the plot above.

Given under our hands this 15th day of April 1869.

On Pages 516 and 517, Deed Book UU, are entered transfers and sales for 1/2 of the above property from the three children of James Payne to a Lewis W. Graves of Baltimore, Md. There are three separate transactions, paying each $72.71 for their 1/3 of the property. The date was 29 December, 1873. From this, we have proof that William H. Payne of Baltimore, Md. was a brother and Rosalie Payne of Falmouth was a sister to Sallye Payne. In the third transaction, it spells out "Sallie Payne now Sallie Payne Stiars and Wm. Wesley Stiars" leaving no chance that we are not talking about anyone but Wm. Wesley Stiars and his first wife, Sarah (Sallie) Payne Stiars[1]. The transactions further note that Elizabeth Payne (their aunt) still lives on the property[2].

 

The 1860 Census of Stafford County, lists Family No. 117 as:

Eliza Payne 43 F Not owning property.

On Page 178, Deed Book L, it notes that in an earlier transfer of this same property, James Payne's wife was Sallie E. Luck and her mother and father were John M. and Mary A. Luck. It also refers to the property as being 1 mile from Falmouth.

 

This map copied from “The Official Military Atlas of the Civil War” Fairfax Press, Series 1 Vol XXI, clearly shows this land l mile Northwest of Falmouth titled "Miss Payne. Also, the road in 1867 clearly follows what is now Wash­ington Street, turning into Melcher Drive. The Payne property would be just where Melcher Drive enters back onto Route 17, on the North side of 17.What’s left of this property is now Lot 6A in the current (2002) Stafford County Land Tax Map.

 


 


[1]  I have found no record, yet, of the marriage of William Wesley Stiars to Sallie.

[2]  Apparently, there was only 1 house on the property, Lot 2 assigned to Lucy Burton.
