THE RIGHT HONOURABLE THOMAS LORD FAIRFAX Baron of Cameron in that part of Great Gritain called Scotland Proprietor of the Northern Neck of Virginia To all to whom this present Writing shall come sends Greeting. Know Ye that for goods ... for and in Consideration fo the Composition to me paid and for the Annual Rent hereafter allowed, I have given granted and confirmed and by these Presents for me my heirs and assigns Do give grant and Confirm unto Henry Piper of the County of Frederick a certain Tract of Waste and ungranted Land in said County Lying on the West Side of N. Shannandoah including where he lives and joining George Dillinger's Late Survey and bounded as by a Survey thereof made by Mr. Robert Rutherford as followeth, Beginning at Two Black oaks near the Great Waggon Road in the Line of the said Dillinger and Extending No. 40 degrees East One hundred and Sixty Poles to a White Oak by a Valley, Thence No. 35 degrees, West Four Hundred Poles to Three White Oaks Amongst Rocks, Thence So. 40 degrees Wt. One Hundred and Eighty Poles to Two white Oaks amongst Rocks; Thence So. 35 degrees East Ninety Eight Poles to a White Oak on a Ridge in the said Dillinger's Line, thence with the said Dillinger's Line No. 55 degrees East Twenty Poles to Three Black Oaks on a Ridge, Thence So. 35 degrees East Two hundred and Eighty four poles crossing the said Road to the Beginning containing Four hundred and Ten Acres. Together with all Rights and Member's and Appurtenances thereunto belonging royal Mines excepted a full third part of all Lead, Copper, Tinn, Coals, Iron Mines and Iron Ore that shall be found thereon. To have & to Hold Four hundred and Ten Acre's of Land Together with all Rights, Profits and Benefits to the same belonging or in any wise Appurtaining Except before Excepted to him the said Henry Piper his heirs or Assigns for Ever. He the said Henry Piper his heirs or assigns therefore ??? and paying to me my heirs or assigns or to my Certain Attorney or Attorney's Agent or Agents or to the Certain Attorney or Attornies of my heirs or Assigns Proprietor's of the said Northern Neck Yearly on the Feast Day of St. Michael the Arch Angel the Fee Rent of One shilling Sterling Money for Every fifty acres of Land hereby granted and so Proportionally for a greater or Lesser Quantity. Reserve that if the said Henry Piper his heirs or Assigns shall not pay the before required Annual Rent so that the sum or any part thereof shall be behind or unpaid by the space of two whole Years after the same shall become due if lawfully Demanded That then it shall and may be lawful for me my heirs or Assigns Proprietors as aforesaid my or their Certain Attorney or Attornies Agent or Agents unto the above granted. Promises to Reenter and Hold the same so as if this grand had never passed. Given under my Hand and Seal and Dated the tenth day of September in the Thirtyeth Year of the reign of Our Sovereign Lord George by the Grace of God of Great Britain France and Ireland, King Defender of the Faith Feb 18th One Thousand Seven Hundred and Fifty Five. |
