7 SEP 1812 DEED ESTABLISHING THE TOWN OF HAWKINSTOWN |
Witnesseth that the said William Hawkins and Lydia his wife for and in consideration of the sum of five hundred pounds current Money of Virginia in hand paid by the said Israel Allen at or before the sealing and delivery hereof the receipt whereof they do hereby acknowledge and thereof do release acquit and discharge the said Israel Allen his heirs, Executors & Administrators by these presents the said William Hawkins and Lydia his wife, have granted, bargained, aliened released and confirmed and by these presents do grant bargain sell afirm and confirm unto the said Israel Allen his heirs & assigns one certain piece parcel or tract of land lying and being in the said county of Shenandoah on the westerly side of the North River of the Shenandoah. And is the same tract of land which was conveyed to the said William Hawkins by Joseph Hawkins and Lydia his wife by their certain deed of gift bearing date the thirty first day of December in the year of our Lord one thousand seven hundred and ninety nine and of record in the County Court of Shenandoah reference thereunto being had may more at large and fully appear and is bounded as followeth to wit: Beginning at a poplar marked R.A. standing on the river bank corner to Ruben Allens survey and running thence down the courses and meanders of the river N 12 W twenty poles thence North 42 Wt eight poles to a locust standing on the river bank, then leaving the river N 58 Wt one hundred and twenty eight poles to a stake, thence N 40 Est. ten poles to another stake thence N 50 Wt fifty one poles to two pines and a hickory sapling thence S 40 Wt fifty two poles to a stake, thence N 50 Wt ninety eight poles to a small black oak sapling near a black oak and a pine. in the old line. with the old lines as follows S 25 Wt. ninety three poles to three pines on a knole thence S 65 Et one hundred and sixty poles to a stake on a level in the line of said Allen by three corne red pines, thence with Allen's N 20 Et thirty four poles to three pines and then S 67 Et. one hundred and fifty poles to the Beginning containing one hundred and ten acres be the same more or less. And is part of a larger tract of three hundred and ten acres (and where the said Joseph Hawkins before conveying the said one hundred and ten acres to the said William Hawkins laid out great part thereof into half acre lots and streets to be erected into a town by the name of Hawkinsburg and also some out lots adjoining thereto and made titles for some of the said lots to the purchasers and the said William Hawkins since the title of the said Town and lands was vested in him has also made titles for a number of said lots to the purchasers all which lots so sold and titles made to the purchasers as aforesaid whether called half lots or out lots and the streets as they were laid out for the convenience of the said inhabitants of the said Town are hereby excepted) the ground rents a reserved in the said titles made to purchasers for any of the said lots hereafter to grow due as payable to the said Israel Allen his Heirs, Executors, Administrators and assigns which he may demand, collect and receive agreeable to the stipulation and reservation in the said titles mentioned; (Any of the said Lots whether called half Acre lots or out lots which heretofore actually have been sold by either the said Joseph Hawkins or William Hawkins and the titles not fully Made and completed the said Israel Allen his heirs, Executors, Administrators and assigns shall make and complete the same to the purchaser respectfully under such reservatory stipulations as the like titles were heretofore made by the said former proprietors) together with all and singular the rights, improvements, Hereto standing and appurtenances, whatsoever thereunto belonging or in any wise apertaining the reversions and remainders, rents, Issues and profits thereof -- also all the estate right, Title, Interest use property claim and Demand whatsoever of them the said William Hawkins and Lydia his wife in Law or equity of and in the premises aforesaid and every part thereof to have and to hold all the singular the premises with the appurtenances are and behoof of the said Israel Allen for themselves and their Heirs, Executors and Administrators that they have good right to convey the land and premises to the said Israel Allen in manner and form aforesaid, And Lastly that the said William Hawkins and Lydia his wife and their Heirs all and singular the premises hereby granted with their appertenances unto the said Israel Allen and this Heirs and Assigns against the said William Hawkins and Lydia his wife and their Heirs and all and every other person or persons whatsoever shall warrant and forever defend by these presents (Except reservations and exceptions heretofore stated.) In testimony whereof the said William Hawkins and Lydia his wife, have hereunto set their hands and seals the day and year first above written. This indenture of Bargain and Sale between William Hawkins and his wife of the one part and Israel Allen of the other part was acknowledged and ordered to be recorded.
