I Thompson Combs of the aforesaid county do make my last Will and Testament in the manner as follows. 1st I will and bequeath to my dear and beloved wife all my lands to her until the youngest child becomes of age. But if my widow should marry before the heirs should all become of age, then two thirds of the lands to be rented out, for the benefit of my heirs. And also I will all my household kitchen furniture and my farming utencils and one horse and one woman saddle and two choice cows to my wife. My saddle I will and bequeath to my son Benson B. Combs. One large kettle I will and bequeath to my daughter Victora Combs, to my daughter Susan Combs, I will and bequeath one Trunnel? Bed stead, and also to my wife hogs enough to make meet enough for the family twelve months and one saw and five sheats and eight head choice sheep and if my wife maries before the heirs become of age two thirds of the above property is to be sold for the benefit of my children and the balance of my property, which I may sease and posess it is my will to have it sold and all of my just debts personal expenses paid out of it, and my present crop now growing I give it to my family.

At a Court of Quarterly session held for Russell County at the Court house on the 8th day of June 1869
The last will & testament of Thompson Combs Jr was this day produced in court, and proved by the oath of Cullen Combs one of the subscribing witnesses thereto and commission is directed to be issued and directed to any Justice of the peace of Lawrence County Kentucky to take the deposition of I. S. Judd the other subscribing witness to said will as the law directs.

To any Justice of the Peace in and for the County of Lawrence and State of Kentucky, know ye that we trusting to ? fidelity and provident circumspection in examining I. S. Judd an attesting witness to the last Will and Testament of Thompson Combs Jr. dec'd hereunto annexed authorize and request you that at such certain time and place as you shall ____ witness before, you call and cause to come and dilligently examine upon oath touching the execution of said Will and his attestation thereto and his examination unto our said Court for the County of Russell distinctly and plainly without delay you read and certify enclosed returning also this writ together with the copy of said Will. Witness P. B. Henritze Clerk of our said Court, at the Court house, this 25th day of October 1869 in the 74th year of the Commonwealth.

I. S. Judd a witness of lawful age being duly sworn deposith and saith
1st Question. Did you or not on the 9th day of June 1863 write a Will for Thompson Combs Jr.
Answer. I did
2 question. Did or not Thompson Combs Jr. acknowledge said instrument - be his last Will and Testament in your presence and in the presence of Cullen Combs Jr.
Answer. He did
3rd question: Did you or not witness said will at the request of the said Thompson Combs Jr. in his presence and in the presence of Cullen Combs Jr.
Answer. I did
4th question. Did you or not think that the said Thompson Combs Jr. was at that time of sound mind and disposing memory
Answer. I did so think then and now
5th question. Did you ever witness any other will made by said Thompson Combs Jr. with Cullen Combs Jr. prior to the date of the copy of said will hereto attached or since and if so please state when and where it was
Answer. I never have before or since
And further this deponent saith not

Kentucky Lawrence County to wit:
The foregoing deposition of I. S. Judd was taken subscribed and sworn to before Thomas M. Kinster a justice of the peace in and for the County and State afore said persuant to the commission hereto annexed. Given under my hand this 10th day of November 1869.

The last Will and Testament of Thompson Combs dec'd was this day again produced in court and proof of the execution of the same completed by the deposition of I. S. Judd and the other subscribing witnesses thereto and ordered to be recorded. And on motion of William F. Combs who took the oath of an administrator prescribed by law, and entered into and acknowledged a bond in the sum of $400, together with Thompson Combs his security thereto conditioned as the law directs - A certificate is therefore granted him for obtaining letters of administration with the will annexed on the estate of Thompson Combs dec'd in due form
