In the name of God amen, In this my last will and testament I bequeath my soul to God who gave it and secondly after all my just debts and funeral expenses are paid I make and distribute as my last request all my earthly property and effects in manner and form following that is to say, Margaret Wyatt, Martha Dills, Isiah D. Ball, Eliza Mutter, Lilburn Ball, George Ball and Mary Ann Ball my seven children, I give and bequeath to them all an equal portion of my property and effects, that remain undivided after Isiah D. Ball gets the amount of ten dollars worth of household property such as he may see cause to select. My daughter Eliza Mutter I give one milk cow to make her equal with my other daughter who I have already give a milk cow, also two bed quilts which she is to have to make her equal in bed clothing. To my daughter Mary Ann Ball I give one milk cow & calf, which she now claims, red and white pided, also my cuboard and cuboard ware, and my brass kettle, one good bed with all its clothing and fixtures. All my grain to be equally divided between my three children Lilbern, George and Mary Ann Ball. I also want my plantation rented out to pay my just debts, rather than the property I have given my children be taken away. After the above said gifts are made and complied with as above stated I request that all the remainder of my estate be equally divided between my three children Lilbern, George and Mary Ann Ball. Lastly I appoint my Father Samuel Taylor Executor of this my last will and testament signed & sealed in the presence of the following witnesses this 20th day of Oct 1865.

At a court held for Russell County at the Courthouse on the 6th day of February 1866. The last will and testament of Nancy Ball deceased was this day produced in court and proven by the oath of Otis Caldwell & Johnathon Boyd the two subscribing witnesses thereto and ordered to be recorded. And on the motion of Samuel Taylor the executor therein named who took oath of an Executor, presented by law and entered into and acknowledged his bond in the sum of $2500.00 with Johnathon Boyd and Wm. B. Aston as his securities therein conditioned as the law directs a certificate is granted him for obtaining probate of said will in due form. The estimated value of said estate was stated on oath by Samuel Taylor to be $200.00.
