In the name of God amen. I Lydia Montgomery of the County of Russell & State of Virginia, do hereby make my last will and testament in manner and form following that is to say.
1st, I desire that my burial and funeral expenses be paid out of my estate.
2nd, I desire that there be no appraisement on sale of my personal estate.
3rd, I give and bequeath to my brother Isiah Munsey in the State of Indiana, three hundred dollars out of two debts coming to me in Washington County from Washington Montgomery and Timothy Eavins should he be living, should he be dead, then I give and bequeath the same to his two children, James B. & Elizabeth Jane.
4th, I give and bequeath to my sister Nancy Mariah and Phebe, one hundred dollars each out of the same debts coming from Montgomery and Eavins.
5th, I give and bequeath to my brother Charles W. , one hundred dollars out of the debt mentioned.
6th, I give and bequeath to my mother and brother Samuel P. the balance of the two debts coming from Montgomery and Eavins, also I give and bequeath to my mother and my brother Samuel P. one bed each bedstead and bed furniture.
7th, I desire that each of my brothers and sisters that I have chose to heir, my estate shall have their full portion of interest according to their debts before they receive the money.
8th, I give and bequeath to my neice Elizabeth Munsey my _____.
Lastly, I do hereby constitute and appoint my friend Charles H. Gilmer executer of this my last will and testament hereby revoking all other or former wills or testaments by me heretofore made. In witness whereof I have hereunto set my hand and affixed my seal this 16th day of March in the year 1849.

At a Court of Quarterly session held for Russell County at the courthouse on Tuesday the 5th day of June 1849. This instrument in writing was exhibited in court as and for the last will and testament of Lydia Montgomery de'cd and proven by the oath of John R. Hendricks and John Blessing the subscribing witnesses thereto, and ordered to be recorded, and on the motion of Charles H. Gilmer, executer therein named who made oath, and together with Ira Reynolds and Isaac Vermillion his securities entered into and acknowledged a bond in the penalty of $2400.00 conditioned as the law directs, certificate is granted him for obtaining probate of said will in due form.
