Executed on 07 Feb 1843

I John Hackney Sr. of the County of Russell and State of Virginia, do hereby make my last Will and Testament, in manner and form following, that is to say: 1st I desire that immediately after my decease, so much of my personal property be sold, as will be sufficient to satisfy and pay my just debts and funeral expenses.

Secondly after the payment of my debts and funeral expenses, I give to my wife Jane all the remaining part of my personal property of any kind whatsoever, except that part of my estate as is now in the possession of Nichodemus Hackney and Elias Adkins: and also all my lands lying on the Clinch River in the County of Russell for and during the term of her natural life and after her decease I give the personal part of the same to my children herein after mentioned to be equally divided, among them and by them enjoyed forever; namely to personal part of the same to my children herein after mentioned to be equally divided, among them and by them enjoyed forever; namely to John, Jane, Sally, Thomas, Nicodomus, Joseph, Nancy and Vail.

Thirdly; I give to my daughter Polly after the decease of my wife, the upper end of my said tract of land as far down as to a certain drain between the dwelling houses and the lower apple orchard, to be enjoyed by her forever.

Fourth; I give the remaining part of my said Tract of land-to wit, the lower end of said land from the said drain above mentioned down the river to said children above mentioned to be sold and equally divided among them after my son Thomas having paid the estate forty dollars and Nichodemus paying thirty dollars and Joseph paying fifty dollars which they have received over and above an equal amount, with the rest of my children, and also after paying to my grandson John Hackney the son of my daughter Nancy, the sum of forty dollars out of the money arising from the sale of said lands, upon condition he remains with his grandmother until he arrives to the age of twenty- one years or until the decease of his Grandmother.

Fifthly, I give all that part of my estate now in the possession of Nichodemus Hackney to his two children to wit, to his son Ruel Priest, and his daughter Elender to be equally divided between them and by them enjoyed forever.

Sixthly, I give all that part of my personal property now in the possession of Elias Adkins to the children of my daughter Nancy to wit; Jane, Nancy, Polly and James, to be equally divided among them.

And lastly, I do hereby constitute and appoint my friends and Joseph Hackney executor of this my last Will and Testament hereby revoking all others and former Wills and Testaments by me heretofore made. In witness whereof I have hereunto set my hand and affirmed my Seal, this ? day of August in the year of our Lord One Thousand eight hundred and thirty two.

Virginia to wit. At a Court held for Russell County on the 7th day of February 1843. This Instrument of writing was exhibited in Court as the Last Will and Testament of John Hackney Sr deceased, and proven by the oath of George L. Jessee and James Artrip the subscribing witnesses thereto and ordered to be recorded, and on the motion of Joseph Hackney executor therein named who made oath, and together with George L. Jessee and William Jessee his securities entered into and acknowledged a bond in the penalty of $200.00 conditioned as the law directs, certificate is granted the said Joseph Hackney for obtaining probate of the said wil in due form.
