I Jesse Vermillion of the County of Russell and State of Virginia do hereby make my last Will and Testament, in manner and form following, that is to say: I desire, that, out of my cash on hand and my other personal estate, my just debts and funeral expenses be paid, and the residue of my personal estate I give to my beloved wife Polly Vermillion to be by her used as disposed of as she may think proper. I als give my beloved wife the use and occupancy of my lands situated in the County of Russell, with all and singularr the rents issues and proffits of the same during her natural life and after her death I give to my son Jesse Vermillion all my lands in said County of Russell upon condition that he pay to each of my daughters fifty dollars that is to say to Nancy Taylor fifty dollars to Rebecca Burk fifty dollars, to Polly Litton fifty dollars so soon after the death of my beloved wife as the same may be applyed for by my said daughters respectively or their heirs as the case may be I furthermore give to my son Jesse Vermillion jointly with his mother the use and occupancy of my lands together with the wrents issues and proffits of the same during her life, and desire that they cultivate the lands and use the proceeds and produce as the same have been used during the last years of my life, that is to say, I desire that they both use the proceeds of the said lands without having divided the same previously. I desire that there be no appraisement of the estate.
I hereby appoint Isaac Vermillion executor of this my last Will and I do hereby revoke all other or former wills by me heretofore made.

At a court held for Russell County at the courthouse on Tuesday the 8th day of December 1840. This instrument of writing was exhibited in Court as and for the last Will and Testament of Jesse Vermillion deceased, and proven by the oaths of Abraham Fuller and Edward Kelly two of the subsribing witnesses thereto, and ordered to be recorded. And on the motion of Isaac Vermillion Executor therein named who made oath, and together with George Smith & Jefferson Jessee his securities, entered into and acknowledged a bond in the penalty of $2500.00, conditioned according to law, certificate is granted the said Isaac Vermillion for obtaining probat of the said will in due form.
