Executed 06 Oct 1835

I Jemima Shoemaker of Russell County in the state of Viginia, do hereby make my last Will and Testament in manner and form following, that is to say:

First, after the payment of my just debts and funeral expenses I give to my grand-son Alexander Holland and my grand daughter Lucinda Holland, each the sum of one hundred fifty dollars.

Secondly. I give all the residue of my estate both real and personal to my daughter Nancy Hargis and my sons Leonard and Benjamin Shoemaker, equally, except that it is my desire that the sum of three hundred dollars, herein before devised to my grand son and daughter, Alexander Holland and Lucinda Holland be paid out of her third part of my estate hereby devised to my daughter Nancy Hargis and with the further exception that I will and desire that my slaves Will and Staci be permitted to live with any one of my children that they may make choice of to take care of them in their old age as some compensation for their past faithfulness.

Thirdly: I desire that there be no appraisement of my estate, but that the whole thereof be divided in kind, and if my said daughter and sons cannot agree in the division of my effects, I desire that each one of them choose a discreet person to make the division, and that the same be performed by those persons then chosen.

Fourthly. I hereby constitute and appoint my sons Benjamin Shoemaker, Leonard Shoemaker and my son-in-law William Hargis executors of this my last Will and Testament. In witness whereof I have hereunto set my hand and seal this 8th day of August 1835.

At a court held for Russell County on the 6th day of October 1835.
This instrument of writing was exhibited in court as and for the last Will And Testament of Jemima Shoemaker deceased, and proven by the oaths of William Price, Joseph Gilbert and Mary Bloomer the subscribing witnesses thereto, and ordered to be recorded. And on the motion of Benjamin Shoemaker, Leonard Shoemaker and William Hargis executors therein named who made oath and together with Vincent Jessee, David Sargent and George Smith their securities, entered into and acknowledged a bond in the penalty of $6000 conditioned as the law directs, certificate is granted the said Benjamin Shoemaker, Leonard Shoemaker and William Hargis, for obtaining probat of the said will in due form.
