I Andrew R. Martin being of sound mind but feeble in body and bearing in mind the uncertainty of life do make this my last will and testament in the manner and form following to wit Namly
1st that my funeral expenses be paid together with my just debts out of the property that I may have on hands at my decease,
2nd I give to my nephew in law J. J. Bays all my lands according to his contract with John C. Linticum as it was the property of said Linticum according to a previous contract between me and said John C. Linticum. And I also give to J. J. Bays all my house hold and kitchen furniture of all kinds. I also give to said J. J. Bays my interest in the Black Cow which I and said J. J. Bays purchased from Ellen Linticum,
3rd I give my red two year old cow to the sons of J. J. Bays,
4th I give my Black Cow’s Calf to Mary J. Bays daughter of J. J. Bays,
5th I give my red cow’s calf to Nannie V. Bays daughter of J. J. Bays,
6th I give my Book called Wesley’s Notes to my brother David Martin,
7th I give my Clark’s commentaries to my nephew Jno. W. Martin,
8th I give my bench planes to my nephew Andrew W. Martin,
9th I give the note that I hold on my nephew Phillip W. Martin to him (P. W. M.),
10th any other property of any kind which I may have I give to J. J. Bays for satisfying any funeral expenses and for paying my niece Katy Martin well for her kind attention to me during my illness. And all the above named property to remain with my wife Mary Martin until her decease and then be appropriated according to this will. I appoint J. J. Bays to be the executor of this will. Given under my hand and seal this 22nd of July 1866.

Mr. J. G. Price, A. M. Ferguson and Priscilla Price certify that A. R. Martin whose name is signed to the above will acknowledged the same to be his last will and Testament and that it was witnessed by us in the presence of the aforesaid A. R. Martin and in the presence of each other. Given under our hands this 22nd day of July 1866.

At a court of quarterly session held for Russell County at the court house on the 7th day of August 1866. The last will and Testament of A. R. Martin deceased was produced in court and proved by the oath of James Price and A. M. Ferguson two of the subscribing witnesses thereto and order to be recorded and upon motion of J. J. Bays the executor therein named who took the oaths of an executor prescribed by law and entered into and acknowledged his bond in the sum of five hundred dollars with Alexander McFarland as his security thereto conditioned as the law directs, a certificate is therefore granted him for obtaining probate of said will in due form. The estimated value of said estate was proved by the oath of J. J. Bays to be $500.
