Russell Co., Va. - January 30, 1835 - 84 years of age - drafted in the army in 1780 - he states that in consequence of old age and the subsequent loss of memory he cannot recollect the name of the Redgment to which he belonged but he was drafted in Franklin Co., Va. in the malitia spring 1780 and was entered as such he states he was a very poor man and had a wife and 2 children who could not support them selves without his assistance and he substituted one ning? Prater and paid him for his service for the 3 months who was recd. and send his time he states he was there again drafted in the fall of 1780 his wife being in a helpless situation he could not well leave her and he substituted one John Jourden and paid him to serve the 3 month tour and did in which took really every thing he had to support open to pay his substitutes he states that he was again drafted about the 9th or 10th of May in the year 1781 and entered the service of the US and served in the Malitia under the following named officer to wit: as he before state he cannot recollect the name of the Ridgement nor of the colonel but served under General Green major Charles Rose, Captain Thomas Hnderson, Lt. Mathew Smaul drafted in Franklin Co. Marcht from Franklin Co., to Henry Co. through Salsbury town and Camden South Carolina to a place cold ninety six there were stationed 18 days every day or night had ___ little scrimage with the Biritsh we took their spring and kept it 3 days the British reinforst and we had to retreat over Broad River to the Yewtau Springs and there we had a severe Battle with the British a great many kiled and many wounded on both sides on a horst time after the aforesaid Battle we were parted and apart of the army which the aforesaid Mullens was in were marcht to the Cross Roads there were stationed there with many other circumstances which occured in his servitude to tedious to morision and not well enough recollected as it has ben a great while ___ and all statements here to be made with precision and upon oath he does not wish to state more than what he can precisely recollect he states that he served his 3 months and about 21 days as near as he can recollect or in ___ wise his than the aforesaid time applied for a discharge and the officer who he applied to did not give it to him but applied his time was out and he could go where he pleased he left the service in September does not recollect the day or the month in the year 1781 and returned home in his family he states he served with an embodied corps cold on by compatant authority he hired a substitute who served 3 months each and served 3 months 21 days himself makes 9 months & 21 and for such service he claims a pension as he is now old frail and helpless and unable to maintain himself by his labour and hath not where with provided for his subsistance in this life only that provided by the act of Congress - passed June the 7th 1832 he therefor prays an assistance from and under that law he also states that in consequence of old age and his helpless situation and the long distance he resides from the court house in Russel County he is unable to attend the court he there four makes this his declaration before a Justice of the peace of said county and he hereby relinquishes every claim to a pension or anuity except the present and he declares that his name is not on the pension roll of any agency in any state or in any ___ on that of the agency of the State of Virginia

The following interogatories were this day put to the applicant before the Justice of the peace:
Ques: where and in what year were you born?
Ans: I was b. in Franklin Co., State of Va., in the year 1751 to the Best of my recollection & information.
Ques: Have you any record of your age & if so where is it?
Ans: I have none nor never had any
Ques: Where were you living when cald into service where have you lived since the Revolutionary ware and where do you now live.
Ans: I was living in Franklin Co., Va. where cald into service I then moved to Green River South Carolina then to north Carolina then to Russel County, State of Virginia and am now living in the same
Ques: How were you called into in to service were you drafted did you volunteer or were you a substitute and if a substitute for whom?
Ans: I was drafted 3 times ___ & Hired for 3 months and ___ I served for 3 months & 21 days.
Ques: State the names of some of the Regular officers who were with the troops where you served such con___ and malitia Ridgements as you can recollect?
Ans: General Green, Major Charles Rose, Capt. Thomas Henderson, Leiut. Mathew Smaul were with the malitia the continental Ridgement I have forgotin and the name of the Ridgement to which I belonged and the General column, ___ of my service is as I before stated in the declaration.
Ques: Did you ever receive a discharge from the service and if so by where was if so by when was it given and what has become of it?
Ans: I did not I applied for one but never got it but servd out my time and 21 days longer.
Ques: State the names of persons to whom you are known in your present neighborhood and who can testify as to your cosector? varasity and for their belief of your services as a soldier of the Revolution?
Ans: Richard Stanly of Scot Co. can testify because he saw me in the service and served with me, James Mullins, Ambrus Mullins, Junr. and R. Steel, Clergamin, Joseph Short, Bucker Mullins, Isam Hall, Senr.
