This Indenture made this 24th day of October in the year of our Lord one thousand eight hundred and thirty seven, between Thomas Vicars of the county of McMinn and State of Tennessee, of the one part, and Tyree Culbertson of the county of Russell and state of Virginia, of the other part, Witnesseth that the said Thomas Vicars for and in consideration of the sum of one hundred and fifty dollars ($150) current money of the United States, to him in hand paid, the receipt whereof is hereby acknowledged, doth grant, bargain and sell unto the said Tyree Culbertson, all the said Thomas Vicars' interest in a certain tract or parcel of land lying and being in the county of Russell containing two hundred acres of which Robert Vicars, the father of said Thomas, died, seized and possessed and which said interest of the said Thomas Vicars has been allotted to him by Robert Fugate, a commissioner appointed for that purpose by a decree of the Circuit Superior Court of Law and Chancery of Russell County rendered on the 22d of September 1836, in a suit in chancery defending in said court between the said Tyree Culbertson, Complainant and the heirs of said Robert Vicars, defendants, a copy of which said allotment is annexed to this Indenture as a part thereof, With all its appurtenances, to have and to hold the interest aforesaid in said tract or parcel of land with all its appurtenances unto the said Tyree Culbertson and his heirs to the sole use and behoof of him, the said Tyree Culbertson, and his heirs forever, and the said Thomas Vicars for himself and his heirs doth covenant with the said Tyree Culbertson and his heirs, that to the said Thomas Vicars and his heirs the said interest in said tract or parcel of land with all its appurtenances unto the said Tyree Culbertson and his heirs against the claims of all persons whomsoever shall warrant and will forever defend. In witness whereof the said Thomas Vicars hath hereunto subscribed his name and affixed his seal the day and year first above written.

This Indenture of bargain and sale from Thomas Vicars to Tyree Culbertson was acknowledged before me in the clerk's office of Russell County on the 24th day of Oct. 1837 by the said Thomas to be his act and deed and admitted to record.
