This Indenture made the Twenty fifth day of October in the Year of our Lord
One Thousand Eight Hundred and two Between Jacob Crabtree of Lee County &
Commonwealth of Virginia and Mary his wife of the one part, and John Bays,
William Bays, James Bays, Joel Bays, Peter Bays, Joseph Bays, Mary Bays,
and Susanna Bays, heirs at law of Peter Bays deceased of Russell County &
Commonwealth aforesaid of the other part. Witnesseth That the said Jacob
Crabtree for and in consideration of the sum of Six hundred dollars current
money to him in hand paid by the said Peter Bays dec'd to the said Jacob
Crabtree in hand paid the receipt whereof he doth hereby acknowledge hath
granted bargained and sold and by these presents do grant bargain and sell
unto the said John Bays, Will. Bays, James Bays, Joel Bays, Peter Bays,
Joseph Bays, Mary Bays & Susanna Bays (as Tenants in common) the following
two Tracts of Land one of them Containing one hundred Acres of Land and is
bounded as follows viz: Beginning at a double Spanish Oak, corner to
another survey of said Crabtree and with a line of the same S 78 E 110
poles to a white oak, red oak and beech to another of the said Crabtree's
corners Thence with a line of the same S 58 W 140 poles to a white oak and
buckeye thence leaving the said line S 65 E 32 poles up a rocky spur to
five white oaks N 70 E 80 poles to a poplar and black oak on the west side
of a spur of Clinch mountain and on the East side of a branch. N 38 poles
to a Sugartree on the top of a ridge N 58 E 80 poles to a bunch of Sycamore
(?) Standing on the South bank of Cedar Creek N 80 E 32 poles to a Buckeye
and Sugartree on the South(?) side of a spur(?) N 26 W 46 poles to a
Sugartree and white oak at the foot of the War ridge N 78 W 101 poles to a
Stake N 7 W 35 poles to a white oak red oak & Mulberry S 23 W 32 poles
crossing the old war gap road to a red oak and Two white oaks S 12 W 83
poles to the Beginning. The other Track contains _____(?) and is adjoining
the above mentioned Tract and bounded as follows viz: Beginning at a
___(?) near the Creek Thence N 17 E 44 poles to a double Sycamore in a
hollow at the foot of a ridge N 35 E 68 poles to three Spanish oaks on the
south side of said ridge S 78 E 110 poles leaving said ridge and crossing
the creek to a Black oak white oak and Beech on a Spur of Clinch Mountain S
58 W 164 poles Crossing the spurs of Clinch mountain to a white oak and
Two Beeches and from thence to the Beginning. Together with the
appurtenances thereunto belonging to have And To hold the said Two Tracts
of to them the said John Bays, William Bays, James Bays, Joel Bays, Peter
Bays, Joseph Bays, Mary Bays and Susanna Bays and their heirs to the sole
use of the said John Bays, William Bays, James Bays, Joel Bays, Peter Bays,
Joseph Bays, Mary Bays and Susanna Bays and their heirs. And the said
Jacob Crabtree and Mary his wife for themselves and their heirs will
forever warrent & Defend the said two tracts of Land with their
Appurtenances unto the said John Bays, William Bays, James Bays, Joel Bays,
Peter Bays, Joseph Bays, Mary Bays and Susanna Bays and their heirs. In
Witness whereof the said Jacob Crabtree and Mary his wife have hereunto
subscribed their names and affixed their seals the day and Year first above
Written.

At a Court held for Russell County October 26th 1802.
This Indenture of Bargain and sale of Land from Jacob Crabtree and
Mary his wife to John Bays, William Bays, James Bays, Joel Bays, Peter
Bays, Joseph Bays, Mary Bays and Susanna Bays was exhibited in Court and
acknowledged by the said Crabtree and Mary his wife being privilly examined
as the Law directs & Ordered to be Recorded.
