I'm not sure where Nicholas came from or who his parents were.  There were Irishmen known to have come over from County Down (the surname McGinnis is prevalent there) to the Northern neck in the 1730s.

Here are some of the interesting connections I have found:

In a book entitled "Records of Indentured Servants and Records of Certificates for Land, Northumberland County, Virginia (1650 - 1795) compiled by W. Preston Haynie for Heritage Books, Inc, there are several McGinnis records that could possibly be some of the ancestors or relatives of Nicholas McGinnis.  There is no proof yet for any connection between the persons in the book and Nicholas, but they may be starting points for further research into the McGinnis family in early Virginia.

The first is most certainly our Nicholas McGinnis.  It lists him by name and the time period is only 3 months before he buys land in Richmond County:  Page 295, Rec: 1810 - August 14, 1749 - John Elom, Servant to Manly Brown, Jr. agrees to serve his said master after his other time of Service is expired eighteen months in consideration of the said Brown's bying [buying] him from Nicholas McGennis.  Order Book 1743 - 49, page 507.

(On a side note: In a very interesting work, the Diary of Colonel Landon Carter of Sabine Hall, in Richmond County, he makes reference to sending to a McGinnis.  McGinnis was in fact his slave.  We know the McGinnis family were slave owners so it is more than likely this person was bought from the McGinnis family by Landon Carter).   

The next record goes back a little earlier in the 1700s:

Page 261 - 1582 19-May-1725 - Hanah Melony came into Court and made oath that Joshua Harrison, servant to Robert Carter Esquire (note: this refers to Robert "King" Carter of early Virginia history), was the Father of her base born Child.  Order Book 1719 - 29, page 179.  (In the index her name is spelled Mellony).  Then she is listed again, Page 261, 1586 - Aug. 18, 1725 - Whereas Hanah Melony, Margaret Megeneys (I've seen several early references and spellings of McGinnis changed to forms like this and others, McGennys, Magennis, McGuinice...), and Ann Lynch was bound over to this Court by George Ball Gentleman, one of the Majesty's Justices of the peace for this County and being convicted by evidence together with their own Confession, ordered yet the sheriff give the said Hanah Melony, Margaret Megeneys, and Ann Lynch twenty five lashes each well laid on their bare backs at the Common Whipping post and that they be discharged paying costs.  Order book 1719 - 29, page 185.

In the Northumberland Historical Society Records I found these additional records about Margaret:

Northumberland County Record Book (1726 - 1729) Page 39, John Taylor of Wiccocomoco Parish records a Will and Administration with Margaret McGinnis as his witness. 

Then, At a vestry held for the Parish of Wiccocomoco on Oct. 12, 1736, 340 (not sure if shillings or not) given to Mr. Christopher Garlington for burying John Richards and Margaret McKennis - >From a History of Wicomico Parish, 1703 - 1795.  The surname McKennis is prevalent in Virginia, and does appear in the Northern Neck, so Margaret may or may not be a relative. 

The final and earliest record of a McGinnis in Northumberland County is on pages 128 - 129, entry 713: March 19, 1678/79 - Certificate is granted Mr. Christopher Neale for twelve hundred Acres of Land for the Importation of fower & twenty persons: (on this list of individuals are) Michael McGennis and Patrick McGennis.  Order Book 1678 - 98, part 1, page 32. 

(Something to keep in mind: Northumberland County was created in 1645 and suffered some loss in a fire in the Clerk's office on October 25, 1710).

Previously, the earliest record I found regarding Nicholas was his purchasing land in Richmond County in 1749, but now, I've found an even earlier record: Richmond County, Order Book 10, part 2, page 649.  Recorded September 4th, 1738 (date written in Roman Numerals) Nicholas McGinnes versus William Creek - Nicholas in a case regarding, "actions of trespass and assault damages and 201 Pounds current money against William Creek" Court dismist the debt and paying costs.  

If Margaret McGinnis (McKennis, Mageneys) died in 1736 perhaps Nicholas is her son.  He could have become head of household at that time. 

The following records deal solely with our Nicholas McGinnis and can be viewed at the Clerk's Office in Warsaw, Richmond County, VA.

Richmond County Order Book 12, page 92.  Nov. 7, 1747 - The Justice orders the Sheriff to summon to the next court Nicholas McGinnis of Lunenburg Parish to answer the presentment of Grand Jury against him for a common swearer.

Richmond County Order Book 12, page 98.  Dec. 7, 1747 - Court dismissed in the case against Nicholas McGinnis for incertainty in the said presentment.

Richmond County Order Book 12, page 109.  March 8, 1748 William Muse of Westmoreland County have been summoned an evidence for Nicholas McGinnis versus Thomas James and having attended two days on the suit is therefore ordered the said Nicholas McGinnis is to pay him 80 pounds of Tobacco for the two day attendance and for coming once 10 miles and going once 10 miles.

Richmond County Order Book 12, page 112 - April 7, 1748, Thomas James dismisses his case against Nicholas McGinnis.  William Muse must be paid 55 pounds of Tobacco for his attendance.

Richmond County Order Book 12, page 128.  May 2, 1748 - Nicholas McGinnis is summoned to answer claim of swearing within the months last past.

Richmond County Order Book 12, page 132.  July 4, 1748 - Jury finds against Nicholas McGinnis for swearing one profane oath and is fined on motion by the King's Attorney Five Shill or Fifty Pounds of Tobacco to be paid to the Church wardens of Lunenburgh Parish with cash.

Deed of land sale from Thomas William Wells to Nicholas McGinnis on November 7, 1749. 

                This indenture made the seventh day of November in the twenty third year of the Reign of our Sovereign Lord George the Second by the Grace of God of Great Britain, France, and Ireland, King Defender of the Faith and in the Year of our Lord One Thousand seven hundred & forty nine Between Thomas William Wells of the County of Fairfax, Planter, of the one part, And Nicholas McGinnis of the County of Richmond, Wheelwright, of the Other Part Witnesseth That for and in Consideration of the sum of Fifteen pounds to the said Thomas William Wells in hand Paid by the said Nicholas McGinnis on or before the Sealing and Delivery of these presents the Receipt whereof the said Thomas William Wells Doth hereby acknowledge and thereof Doth release, acquit, and Discharge the said Nicholas McGinnis his Heirs, Executors, and Administration forever by these presents He the said Thomas William Wells Hath Granted, bargained, Sold, Aliened, Released, and Confirmed and by these presents doth grant, bargain, sell, alien, release, and confirm unto the said Nicholas McGinnis his Heirs and assigns All that Plantation and Tract or Parcel of Land Situated Lying and being in the Parish of Lunenburgh in the said County of Richmond containing by estimation one hundred and fifty acres be the same more or less formerly purchased by the said Thomas William Wells of Francis Settle and by him sold and conveyed to the said Thomas William Wells by indenture of (Feesment?) bearing date the thirteenth day of December in the year of our Lord one thousand seven hundred and thirty three as by the said Indenture now remaining among the Records of the Court of this County of Richmond relation being thereunto had may more at Large Appear and all houses, outhouses, edifices, buildings, yards, gardens, orchards, woods, underwoods, trees, ways, waters, watercourses, profits, commodities, hereditaments, and appurtenances to the said Plantation and Tract or Parcel of Land belonging or in any wise appertaining and the reversion and reversion remainder and remainders Rents, Taxes, and Profits thereof and also all the Estate right of the interest use, trust, possession, benefit, property, claim and demand of him the said Thomas William Wells of in or to the same and all Deeds, evidences, and writings, touching or in any way concerning the said premises to have and to hold the said Plantation and Tract or Parcel of land and Premises with their and every of their appurtenances unto the said Nicholas McGinnis his heirs and assigns to the only proper use and behoof of him the said Nicholas McGinnis and of his Heirs and assigns forever and the said Thomas William Wells for himself and his heirs, executors, and administration doth covenant, promise, and grant to with the said Nicholas McGinnis his heirs and assigns by these presents that he the said Thomas William Wells now at the time of the sealing and delivery of these presents is lawfully seized of the said Plantation and Tract or parcel of land and premises with their appurtenances a good sure perfect and indefeasible estate of inheritance in fee simple and hath good right title by authority to grant and sell the same in the manner herein before mentioned and also that he the said Thomas William Wells his heirs, executors, and administrators the above granted premises unto the said Nicholas McGinnis his heirs and assigns against the lawfull claim title of demand of all and every other person and persons shall and will warrant and for ever defend by these presents in witness whereof the said parties to these presents have interchangeably set their hands and seals the Day of Year first above written.  Sealed and Delivered in the presence of:

                At a Court continued and held for Richmond County the seventh day of November, 1749 This indenture of Bargain and Sale from Thomas William Wells to Nicholas McGinnis was acknowledged by the said Thomas William Wells and by the Court ordered to be recorded.

Richmond County Order Book 12, page 299.  March 4, 1750 - Nicholas McGinnis, summoned by the Sheriff, does not appear to answer the charge of being a common profane swearer.  He is fined 10 Shillings, or 100 Pounds of Tobacco for the poor of the Parish of Lunenburg, he must pay prosecution costs, and the Sheriff is ordered to attach the body of Nicholas McGinnis and him in his safe custody keep until he enter into Bond with sufficient security the principal in 20 Pounds and security in 10 Pounds for the said Nicholas McGinnis being of good behavior towards all his Majesty's Living Subjects for one year. 

Then on July 8, 1752, Nicholas is given the same sentence again for yet another swearing.  Richmond County Order Book 12, page 395. 

Richmond County Order Book 12, page 406.  August 5, 1752.  Nicholas McGinnis wins against Stephen Peacock for 3 Pounds, 4 Shillings and 7 Pence, Half Penny due by bill (I'm not sure what the details of the case were).   

Richmond County Order Book 14, page 312.  July 3, 1759 - Nicholas McGennis versus Thomas Dolozier in debt for 12 Pounds, 10 Shillings.

Ebenezer Balderson, Zachariah White, and Silicia White this day appeared before me, John Belfield one of his Majesty's Justices of the peace for the aforesaid County made Oath that Nicholas McGinnis who died yesterday did in his last sickness in his own house give to his son Rich. McGinnis all his working Tools & the Timber in his Shop and that the aforesaid Nich. McGinnis did bid the aforesaid persons bear witness that the same was his Will Certified under my hand this 29 day of March, 1769.

Richmond County, Order Book 16, page 502 - Jannet McGennis made oath and gave bond, Certificate is granted for her to obtain an Admonition regarding the estate of Nicholas McGinnis.  Acknowledged by Jannet, William Flood and John Gordon, security was entered.  (Researcher's Note: I wonder if Jannet was a Flood or a Gordon?)

Richmond County, VA Court Order Book 17 (1769 - 1773) on page 471: "Jennett McGennis was chose by and appointed guardian to her daughter Mary McGennis giving bond according to law." 

Richmond County, Order Book 19 (1773 - 1786) page 259, Richard Schooly McGinnis made oath a certification granted for him to obtain letters of administration on the Estate of Janet McGinnis deceased and gave security with Zachariah White in the sum of 100 pounds.  Recorded June 6, 1785.

Nicholas and Jannett had a daughter named Mary.  This is proven in Richmond County, VA Court Order Book 17 (1769 - 1773) on page 471: "Jennett McGennis was chose by and appointed guardian to her daughter Mary McGennis giving bond according to law."

Nicholas, John, Susanna, Ruth, Nathaniel, and Samuel are indeed the orphans of Richard Schooley McGinnis.  It is proven in a Chancery Suit in Richmond County, VA concerning the dispersal of his estate following his death to his six surviving children.  During his lifetime, Richard S. McGinnis was very actively involved in the community.  He appeared as a Bondsman on several marriage records in Richmond County, Lunenburg Parish, and took on quite a few Apprentices.  From his father Nicholas's will, we know he acquired a few possessions and land and later in the Chancery suit between his children we learn at one time he held upwards of 175 acres of land.  The following are records you can view at the Richmond County Courthouse Clerk's Office:

Richmond County Order Book 16, page 500.  June 5, 1769 - The Will of Nicholas McGinnes deceased was presented in court by his son Richard.

Richmond County Order Book 17 (1769 - 1773), page 372: Dec. 3, 1771: Richard McGenniss versus Elizabeth Bruce.  Upon an attachment obtained by the Plaintiff (McGenniss) of the Defendant's Estate, having privately removed herself out of this family or to Absconds, that the ordinary process of law cannot be served on her. 

Richmond County, Order Book 19 (1773 - 1786) page 259, Richard Schooly McGinnis made oath a certification granted for him to obtain letters of administration on the Estate of Janet McGinnis deceased and gave security with Zachariah White in the sum of 100 pounds.  Recorded June 6, 1785.

(Now I've looked in the Richmond County Deed Books many times and have never seen these next couple of records indexed.  I found them in a book on Richmond County Deeds, 1772 - 1779):

Pages 447 - 448.  MARCH 2, 1778 This Indenture made and concluded upon this 2nd day of March in the year of our Lord one thousand seven hundred and seventy eight; Between William White of Parish of Lunenburg and County of Richmond of the one part and Richard Schooley McGinnis of said County and Parish, Wheelwright, of the other part; Witnesseth that William White hath and by these presents doth agree with Richard Schooley McGinnis to serve him as an Apprentice till he arrives to twenty one years of age and also to obey all and every the orders and commands of him his said Master justly given and reveal no secrets, refrain from all manner of gaming, neither absent himself without leave; in consideration whereof Richard Schooley McGinnis doth agree to instruct the said White in the art myster  and occupation of a Wheelwright as far as he knows and also to find said White all necessary cloths, board, washing and lodging fit for a person in his circumstances during the term; In Witness whereof the parties to these presents have interchangeably set their hands and seals the day and year first above written.  And at the expiration of the term of years to allow William White as the Law directs for imported Servants by Indenture or Custom.  Signed: Robert Hall, William White, Richard Schooley McGinnis.  At a Court held for Richmond County the 2nd day of March, 1778 This Indenture of Apprenticeship between Rich. Richmond County, VA Chancery Orders Book for 1813 - 1846, pages 28 - 36. 

Chancery Suit Records involving Nicholas McGinnis (plaintiff) against Beckham Kelly and Susanna his wife, John McGinnis, Daniel Sanford and Ruth his wife, Samuel McGinnis, and Nathaniel McGinnis (defendants).

Among the Records and proceedings of the said Court, are the following with suit above mentioned.  (Researchers note - these records were not rerecorded in chronological order.  In order to better make sense of the entire case proceedings I've tried to return them to chronological order with the exception of the first entry that begins the suit).

Page 28 - Be it remembered that on this day to wit.  At a court held for the said County the 2nd day of December, 1811.  The Plaintiff appeared by Counsel, and filed their Bill, which said Bill are the following words and figures to wit.  To the worshipful The Justice of the County Court of Richmond Humbly complaining shows unto your worship your Orator Nicholas McGinnis lately did seized of a small tract of land in Richmond County.  Leaving heirs Susannah Kelly, John McGinnis, who live in Kentucky.  Rutha, wife of Daniel Sanford in Westmoreland and Samuel McGinnis in Richmond, Nathaniel McGinnis in Lynchburg & your petitioner all of whom are the children of said Richard deceased that the share of each heir in the said Tract of land, when the same is divided among them will not amount to $100 & that the annexed papers will show that your Orator has purchased the Interest of Kelly & John McGinnis & of Sanford & Nathaniel McGinnis.  To the End that the said property may be sold and divided according to law which as your Orator is advised can only be done by ye Interpretation of ye County Court yet so Beckham & Susannah his wife & John McGinnis, Daniel Sandford & Ruth his wife, Samuel McGinnis & Nathaniel McGinnis may be made defendants & Summoned to answer in ye premises & yet ye land aforesaid may be sold & Divided according to Law & that your Orator may have such relief in the premises as to your Worships may seem meet may it please your worships.

(Page 29) Memorandum, This Day I Beckham Kelly of Orange County in behalf of my wife Susanna who was Susanna McGinnis have sold to Daniel Sanford all the said Susanna's right and Title to that certain tract or parcel of land, lying and being in Richmond County whereon the late Richard S. McGinnis lately resided and prospered.  A Legal right and Title to which part of said land, the said Beckham Kelly as aforesaid, hereby obligates himself, his heirs, and assigns to make the said Daniel Sandford, his heirs & assigns when demanded thereto, under the penalty (Page 30) of three hundred dollars for failure.  Witness my hand and seal this 20th day of March, 1805.  Beckham Kelly {SEAL} Signed, Sealed, and Acknowledged in the presence of Alexander D. Kelly and John Watson. 

FEBRUARY 8, 1806

(CONTINUES FROM ABOVE RECORD ON PAGE 30).  For Value Received I Daniel Sanford do hereby these presents assign over to Nicholas McGinnis his heirs and assigns all my right, title, and Interest in and unto the within mentioned land in the same manner that it was sold to me by Beckham Kelly and under the same penalty.  Witness my hand this 8th, February, 1806. Daniel Sanford.

                Memorandum, This day I Daniel Sanford of the County of Westmoreland on behalf of my wife Ruth who was Ruth McGinnis sold to Nicholas McGinnis all the said Ruth right and Title to that certain Tract or parcel of land lying and being in the County of Richmond whereon the late Richard McGinnis lately resided and prospered, a legal right and Title to which part of said land, the said Daniel Sanford as aforesaid hereby obligates himself, his heirs and assigns, to make to the said Nicholas McGinnis his heirs and assigns when demanded thereto under the penalty of Three Hundred Dollars for failure as Witness my hand & Seal this 8th day of February, 1806. MARCH 7, 1808

(Page 28) - This Indenture made the 7th day of March in the year of our lord 1808 Between John McGinnis & his wife Sally of the one part and Richard Efford of the other part all of the County of Westmoreland Witnesseth that the said John McGinnis and his wife Sally for and in Consideration of the sum of Twenty Pounds five Shillings Current Money of Virginia to them in hand paid By the said Richard Efford, on or before the ensealing and delivery of these presents the Receipt whereof they do hereby acknowledged.  Have Bargained and sold, and by these presents Doth bargain and sell unto the said Richard Efford, all their right title and Interest in and unto Twenty seven acres of land lying and being in the County of Richmond and which twenty seven of land fell to the said John McGinnis in the Division of the land belonging to his father's estate, and they further sell unto the said Richard Efford their reversionary right to the land now held by Milly Watson as her dower in said land.  Together with all and singular the appurtenances thereunto belonging, or in any wise appertaining To Have and To Hold the said bargained premises and the appurtenances thereunto belonging to him the said Richard Efford his heirs, executors, adm., or assigns forever, and the said John McGinnis and his wife Sally for themselves their heirs, Exectors, & admors, do by these presents, warrant and secure unto the said Richard Efford his heirs & the said, bargained premises and they will defend the same from the claim or claims of every person or persons whatsoever.  In Witness whereof we the said John McGinnis and Sally his wife have hereunto set their hands & Seals the day and year above written.  John McGinnis {SEAL} Signed and delivered in the presence of Samuel Templeman, M.M. Walker, Ben Walker.

Memorandum, John McGinnis did agree with Nicholas McGinnis for the land now sold Richard Efford and received of said Nicholas the sum of Ten pound in part.  It is understood Between Efford and John McGinnis that if Nicholas McGinnis comes forward and pay Efford the balance of 10 Pounds, 5 Shillings with Interest, Efford is to Give him up the land, Witness our hands this 7th day of March 1808.  John McGinnis {SEAL}, Richard Efford {SEAL}.

                At a Court held for Richmond Count the 5th day of September 1808, This Indenture of Bargain and Sale from John McGinnis and of the one part to Richard Efford of the other part, with the memorandum of an agreement there on Indorsed, was proved in open Court by the oath of Samuel Templeman and Benjamin Walker tow of the Witnesses thereto and ordered to lie for further proof.

(PAGE 30) Memorandum, John McGinnis did agree with Nicholas McGinnis for the said land now sold to Richard Efford and Received of said Nicholas the sum of Ten pounds in part as is understood between Efford and John McGinnis that if Nicholas McGinnis comes forward and pays the balance of Ten pounds five shillings with Interest then and in that case Efford is to give him up the land.  Witness our hands this 7th day of March 1808. JANUARY 5, 1811

(PAGE 31) This Indenture made and entered into this 5th day of January 1811 Between Nathaniel McGinnis of the one part and Nicholas McGinnis of the other part.  Witnesseth Whereas Richard S. (PAGE 31) Articles of agreement Between Nicholas McGinnis and Samuel McGinnis.  Whereas Richard S. McGinnis did prospered of one hundred and Seventy five acres of land in the County of Richmond, and left six children of whom the said Nicholas and Samuel are two, and the said Nicholas has bought the proportion of four of the said Children or coheirs and is entitled to 5/6th in all except what he has sold to James Burgess by articles of agreement entered into on this day of which the Samuel is (illegible), to wit, that part thereof Lying on the east side of the main road Leading from Lawfield to Henry Asburys, adjoining his the said Asbures land.  Now the said Nicholas Covenants and agrees to sell the balance of the said land subject to his mother's dower to the said Samuel for a negro named Ben and Twenty Pounds, Ten pounds to be paid the 1st of January 1812 and other Ten pounds the 1st of January 1813 and to make a good (PAGE 32) and sufficient Title for the said land when thereto demanded and the said Samuel covenants and agrees to deliver the said Negro to the said Nicholas McGinnis immediately and to pay him the said Twenty pounds at the times herein mentioned & Witness our hand & Seals the 8th of January, 1811.  Samuel McGinnis {SEAL} Nicholas McGinnis {SEAL}.

                Memorandum of agreement made and entered into the 8th Day of January one thousand eight hundred and eleven, between Nicholas McGinnis of the County of Richmond and State of Virginia of the one part, and James Burgess of Richmond County and State of aforesaid of the other part, Witnesseth that the said Nicholas McGinnis for and on his part, Covenants and agrees to and with the said James Burgess to sell and convey to him the said Burgess his heirs or assigns all that tract or piece or parcel of and lying and being in the County of Richmond, lying on the east side of the main road leading from Lawfield to Henry Asburreys and adjoining the land of the said Asbury, it being a part of the land formerly held and owned by Richard McGinnis deceased late of the aforesaid County at the rate of Two Dollars & fifty cents per acre for each and every acre the said tract shall contain on a survey to he had of the same, and the said James Burgess for and on his part, Covenants  to and with the said Nicholas McGinnis his heirs and assigns to pay him for the said tract or parcel of land at the rate of the said of Two Dollars Fifty cents for each and every acre, the said Tract or Parcel of land, shall contain on to the said Nicholas McGinnis making him a good and Sufficient Deed for the same, by which the said Burgess is to be secured in a fee Simple Title to the same, and for the true and faithful performance of the stipulations aforesaid, the parties hereto covenant and agree to and with each other, and each bind themselves, their heirs and assigns, to the other in the penalty of two hundred & fifty dollars.  In Witness whereof they have hereunto set their Hands and Seals the day & date first above written.  Nicholas McGinnis {SEAL}, James Burgess {SEAL}.

(PAGE 34) And the Court thereupon entered an order in the following words and figures to wit: On the prayer of the complainant, It is ordered that Summons's issued against Daniel Sanford and Ruth his wife, Samuel McGinnis and Nathaniel McGinnis, to show cause if any they can why the prayer of the complainant's Bill should not be grant, returnable to March term next, and it appearing to the satisfaction of the court that Beckham Kelly and John McGinnis are not inhabitants of this State.  It is ordered that the said defendants do appear here at next March term and answer the said Bill and that a copy of the order be published in the enquirer printed in the City of Richmond for eight weeks (illegible) and another copy posted at the door of the Courthouse of this County.  In Issuance also of the said order, Summons's were issued and returned in the following words and figures to wit:

(PAGE 33) This Indenture made the 29th day of August one thousand eight hundred and fifteen Between Nathaniel McGinnis of the County of Richmond of the one part and Nicholas McGinnis of the same County and both of the State of Virginia of the other part, Witnesseth that the above Nathaniel McGinnis for and in consideration of the Sum of Twenty pounds current Money of Virginia to him in hand paid the receipt whereof he doth hereby acknowledge Hath this day bargained and sold unto the said Nicholas McGinnis a certain Tract or parcel of Land, lying and being in the same County and parish of Lunenburg and bounded as follow to wit: (LARGE BLANK AREA) and containing twenty acres more or less To Have and To Hold the said Land with all its appurtenances of whatsoever description, kind, or denomination to him the said Nicholas McGinnis & his heirs forever.  And that the Nicholas McGinnis doth for himself his heirs, Executors, and Administrators, warrant and forever defend the Lawful Title of the said land and its appurtenances to the said Nicholas McGinnis and his heirs forever, against the claim of all persons whatsoever.  In Witness whereof the said Nathaniel McGinnis hath hereunto subscribed his name and affixed his seal the day and year first above written.  Nathaniel McGinnis {SEAL}.

(PAGE 35) At Rules held in the Clerks Office of the said County Court in the Several Months of March, April, May, June, July, August, September, October, November, and December 1812 continued for answer, January, February, May, June, July, August, September, October, November and December 1813.  Continued for answer.  January, February, March, April, May, June, July, November, and December 1814.  Continued for answer, and January and February 1815.  Continued for answer.  At a Court held for the said County at the Court House the 2nd day of September, 1816, this day came the plaintiff by his attorney and on his Motion, Ordered that William Settle, Thomas M. Bragg, and Joseph Belfield, or any tow of them be and they are hereby appointed commissioners to sell the lands in the Bill mentioned, reserving the right of Dower of the widow of Richard McGinniss deceased upon a credit of six months, having previously advertised the same for three weeks, at the Court House of this County, and that they take bond with sufficient security from the purchaser or purchasers for the amount of the purchase money exclusive of the costs of this suit, which is hereby directed to be paid in cash, payable to the said commissioners and that they make report thereof to the Court.  Costs of this suit, Twenty Dollars and Ninety Nine Cents.

This Indenture made and entered into this 1816, Between Thomas M. Bragg and Joseph Belfield commissioner acting under a decree of the County Court of Richmond bearing date 2nd September, 1816, of the one part, and Samuel McGinnis of the County of Richmond and the State of Virginia on the other part. 

Witnesseth that whereas by decree of the County Court of Richmond made the 2nd September, 1816 between Nicholas McGinnis complainant and Beckham Kelly & Susanna (McGinnis) his wife and others defendants in Chancery.  It was decreed and ordered that certain lands which Richard McGinnis did seized and prospered of under an act of assembly in that case made and provided should be sold on a credit of six months by William Little, Thomas M. Bragg, and Joseph Belfield commissioners appointed by the said Court for that purpose should make sale of the said land in the said decree mentioned having previous to the day of sale advertised the said land for sale at least three weeks at the court house door of the said Richmond County and the said commissioners according to the directions thereof did advertise the sale thereof and on the first day of November 1816 that being the day of sale appointed by the commissioners in their advertisement the aforesaid Thomas M. Bragg and Joseph Belfield two of the commissioners aforesaid did on the last mentioned day offer the same for sale.

                That is to say the land lying on the west side of the main road leading from Westmoreland Court House to Belfield's Mill after reserving the dower of Mary Watson who was formerly Mary McGinnis the wife of Richard McGinnis deceased on a credit of six months, at which time and place the aforesaid Samuel McGinnis became the purchaser for the sum of three hundred and thirty three dollars and forty four cents, he being the highest bidder for that sum, for the aforenamed price: one parcel of land, now in consideration of the premises and also in consideration that the said Samuel McGinnis both according to the terms of the sale secured the payment of the aforesaid sum of three hundred and thirty three dollars forty four cents the price aforesaid, the commissioners have granted bargained and sold, and by these presents doth grant bargain and sell without warrants expressed or implied unto him the said Samuel McGinnis his heirs and assigns forever.

                In Witness whereof the said Thomas M. Bragg and Joseph Belfield as commissioners have hereunto set their hands and seals this 2nd day of November, 1816.

(CHANCERY ORDERS PAGE 35) And now on this day to wit at a Court held for the said County at the Court House the 7th day of July 1817.  The Commissioners appointed to execute the former Decree of this Court in this cause this day exhibited to the Court their report.  It is ordered that the same be in all things confirmed and that the same be recorded and the bond returned by the commissioners taken in pursuance of the said Decree filed in the Clerk's office Subject to the future order of the Court. 

                The Commissioners Report aforesaid is in the following words and figures to wit.

                In Obedience to the annexed order of the County Court of Richmond Sitting in Chancery directing us to sell certain lands therein mentioned & agreeable to said order we Sold the same to John M. Yeatman & Samuel McGinnis as per our statement.

After the Chancery Suit in Richmond County ended, Nicholas appears in Richmond County Court Order Book 25 (1820 - 1822), pages 230 - 231: January 7, 1822.  Nicholas appears in Court and wants the money or Bonds that were deposited in the Clerk's office he is entitled to in the sale of the land of his father Richard McGinnis, deceased.   

There is an interesting tidbit from a letter dating from January of 1830 in Essex County, VA that very likely is about this Nicholas.  At first I thought the letter might refer to Nicholas, son of Samuel McGinnis, but upon further consideration of their ages, the content of this letter, and the fact of the court case surrounding the sale of land of Mary Watson formerly Mary McGinnis, wife of Richard Schooly McGinnis in 1816 - 1817 it is quite likely the letter refers to Nicholas, son of Richard Schooly:

January 15th, 1830

Dear Philip,

I have taken up my pen to address you with a few lines in hopes they will reach you and find you and all friends well as it leaves me and all your relations well except bad colds which has been very prevalent in this part of the country. There has been a great many deaths in this county. Roger Shackleford, his wife and son James died in one or two days of each other. Old James Cauthorn, Phoebe Dobbins, Mary and Frankie Hearman. I could mention twenty more deaths, all of your acquaintenances, but no relation. When you were down last year I was then in King & Queen jail for the offence of striking one Nicholas McGinnis, but I am now at liberty and have rented a place in King & Queen. When I was in jail I owed a balance of rent. They got an attachment and sold everything I had in the world except my horse, which died before the day of sale. However, I made out to get the best part of my property back and then it was so late in the year I could not get one piece of land to tend it was late and had all my meat and bread to buy and all my own labor. It took everything I could make to live on. I made enough money to buy me corn and meat enough to last me till harvest and renting the place where I now live I could not give security I was compelled to pay the money for it. The money I intended to buy my provisions with I was compelled to take it to pay the rent and again I am without provisions to live on and shall have to work from hand to mouth again without Mary Ann will let me have about $20.00 to get provisions. I must ask of you as a friend and relation that you will see Mary Ann and state the nature of the case to her and persuade her to let me have that sum. She boarded with me two years and two months at $60.00 per year, but I let her have $50.00 worth of clothes. Board, clothing and interest amount to $228.57 and she never give me one cent in her life. Besides she owes me $20.00 on settlement of my mother's estate. Do, if you please, my dear Philip try to persuade her to let me have that sum. Speak to Richard concerning of it. If I had that much money I could buy enough to last me until harvest, then I can sell some of my wheat and do very well the balance of the year and at the end of the year I hope I shall make enough to carry me to the western country. The place I have rented is good for 40 to 50 bushels of wheat, 70 or 80 barrels of corn and 150 to 200 gallons brandy. And if she will not assist me I shall have to work from hand to mouth again and never make nothing in that way in the world.

I have been solicited to take a school but cannot do for want of provisions for my family. I could get a school worth $120.00 and tend enough land to make enough for another year if I only had money to buy me 100 pounds of bacon and 8 barrels of corn. Do Philip you and James both persuade Mary Ann and Richard to help me. I ought not to say anything to Richard, he has done a good part, but Mary Ann has never let me have one cent. And if they will neither of them will let me have that sum I must beg you to let me have it and I will pay half the money at harvest and the balance at the end of the year. I have tried several persons and none appear willing to assist me and if Richard and Mary Ann neither ??? you will and I will return it at the time I stated. State the nature of the case to them and do your best to get them to help me. I must conclude by praying that you may persuade them to help me. Give my best respects to your family and all my relations. Write to me immediately. I would write to Mary but don't know where to find her. Write me word who she is a going to be married to and what ??? ???.

Samuel McGinnis of Richmond County, Virginia, served in the War of 1812 in the Virginia militia. After he was wounded, he was left behind in hospital in Dumfries, Prince William County, Virginia.

He's recorded, living by himself in the 1810 Richmond County VA Census as being between ages 26 and 45.  Living next door is his mother Mary Watson, age 45 and up, by herself.

Born: 1813 (Though Census records put his birthday after his brother Frederick, I think Richard may have been the oldest son of Samuel.  The McGinnis family lived in an area of Richmond County very near to Westmoreland County and Montross called Farmer’s Fork near the Belfield Plantation.  It is in this area that Richard and his children and grandchildren lived while Frederick moved to King George County.  I have yet to find a will or another Deed determining this, but the ordering of the children listed in Samuel’s Deed of Gift, if accurate to the order of their birth, would seem to support Richard as being the eldest son).

Married by the Reverand F.S. Evans in Washington, D.C.  Most likely they took a boat up for the day to get married.  To find their graves, Take Route 3 south from Route 301 toward Shiloh and Index.  Once in Index, after you pass the McGinniss barn antiques on the left, take a right onto Salem Church Road.  There is a farm on the right, with trees boardering the road about a quarter mile up.  In this field, one quarter of a mile from Rt. 3 on the right is a small clump of trees and bushes, their graves are located there.  Apparently, according to a woman I met who was walking the road by there as I drove up, pieces of clothing are starting to come up through the ground at the site.  The ground is covered with a carpet of ivy.  There are two smalls stones side by side, one for F. McG. and M.A. McG.  While unkept now, it must have been a very beautiful place 100+ years ago - I can see why they were buried there.

Jan. 1863.  Reenlisted Feb. 13, 1864 at Orange Courthouse for the war.  Absent sick, furloughed from April 8, 1863; present by June 30, 1863.  Ordered to duty at Chimborazo Hospital.  Oct. 5, 1863.  In hospital, Nov. 11, 1863 for catarrh, diagnosed as neuralgia Nov. 15, 1863.  Return to duty Jan. 11, 1864.  Hospitalized June 4, 1864 for diarrhea; returned to duty Sept. 16, 1864.  Married Baynton A. Reamy.  Living in Westmoreland County, May 1892.  Buried at Oak Grove Baptist Church.
