In the Matter of the Incorporation of the Town of
Nassawadox, Northampton
County, Virginia.
ORDER
This day came the petitioners by their attorney and the
court having considered
the petition for the incorporation of the unincorporated
town of Nassawadox,
Northampton County, Virginia, which is in the following
words and figures, to-wit:
"1. That Nassawadox is an unincorporated town situate in
Northampton County,
Virginia.
2. That more than twenty (20) of the undersigned
petitioners are duly qualified
voters and reside within said unincorporated town,
within the boundaries as hereinafter
set forth.
3. That the number of inhabitants of the said town
exceeds three hundred (300)
and does not exceed five thousand (5000).
4. That it will be to the best interest of the
inhabitants of the said unincorporated
town, within the boundaries as hereinafter set forth,
that the said town be incorporated;
that the prayer of your petitioners for incorporation
thereof is reasonable; that the general
good of the community affected will be promoted by
incorporation; and that the area of
land designated to be embraced within the limits of said
town is not excessive.
5. That the area to be embraced within the limits of the
said town of Nassawadox
prayed to be incorporated is approximately 260 acres
(260 A. approx.); and that the metes
and bounds of said town prayed to be incorporated are as
follows:
Beginning at a Highway Marker located on the Southwest
Right of Way of
Virginia Route 606, also known as the Nassawadox Cross
Road, the Point of Reference
for said Beginning Point being the center line of said
Virginia Route 606 at the Southeast
side of the present concrete surface of U. S. Route 13,
said reference point being located
in a Southeasterly direction 3140.98 feet, from the True
Point of Beginning; thence South

The metes and bounds hereinbefore set forth are shown on
a plat of survey,
entitled "Town of Nassawadox, Northampton County,
Virginia" dated October and
November, 1958, by Geo. H. Badger, Jr., C.S., marked
Exhibit A, to be presented to the
Court along with this petition.
WHEREFORE, your petitioners pray that the said
unincorporated town embraced
within the metes and bounds hereinbefore set forth shall
be incorporated as the "Town of
Nassawadox," under the provisions of the Statute laws of
Virginia for such cases made
and provided, and that all such other things may be
ordered and done as may be
necessary for the accomplishment thereof.
And your petitioners will ever pray, etc.," and having
heard and considered the
evidence presented on behalf of the petitioners and the
argument of counsel, and it
appearing to the court that the said petition with
notice appended of the time and place
that said petition would be presented had been published
in full in the Northampton
Times, a newspaper published in Northampton County,
Virginia, once a week for four
successive weeks, and posted at the front door of the
courthouse of Northampton County,
Virginia, at Eastville for four successive weeks, the
said petition having been published

as aforesaid for four successive weeks, beginning on the
19th day of November, 1958,
and having been posted at the front door of the
courthouse aforesaid on the 19th day of
November, 1958, and it further appearing to the court
that more than twenty of the
signers of the petition are duly qualified voters of the
unincorporated town of
Nassawadox, Northampton County, Virginia, within the
boundaries thereof designated in
the said petition; and it further appearing to the court
that the said unincorporated town of
Nassawadox within said boundaries lies wholly within
Northampton County, Virginia;
and the court being satisfied that it will be to the
best interest of the inhabitants of the
said town; that the prayer of the petition is
reasonable; that the general good of the
community will be promoted; that the number of
inhabitants of said town exceeds three
hundred (300) and does not exceed five thousand (5000)
within the metes and bounds
thereof as hereinafter set forth; and that the area of
land designated would be embraced
within said town is not excessive; the court, in the
vacation thereof, doth order and decree
that the unincorporated town of Nassawadox be, and the
same hereby is, incorporated as
a town by the name and style of "The Town of
Nassawadox," but with the metes and
bounds thereof amended as follows, to- wit: Beginning at
a Highway Marker located on
the Southwest Right of Way of Virginia Route 606, also
known as the Nassawadox Cross
Road, the Point of Reference for said Beginning Point

doth further order and decree that
hereafter the inhabitants within the amended boundaries
herein above set forth shall be a
body, politic and corporate with all the powers,
privileges and duties conferred upon and
appertaining to towns under the general law.
It is further ordered and decreed that an election be
held on Tuesday, the 24th day
of February, 1959, at the office of Allen Tilghman, in
the Town of Nassawadox, for the
election of a mayor and six councilmen for said town,
and it is further ordered and
decreed that said mayor and six councilmen, when
elected, shall constitute the council of
said Town.
It is further ordered that the said plat of survey of
the area hereby incorporated as
the Town of Nassawadox made in October and November,
1958, but as amended on the
17th day of December, 1958, be, and the same hereby is,
made a part of this order, and
that the same be recorded, properly indexed, in the
office of the Clerk of this Court.
