Know all men by these Presents that I John Cook for and in consideration of the sum of one hundred Pounds in hand this Receipt where of is hereby acknowledged have this day bargained & sold & by these present doth bargain sell & confirm to Isham Belcher to him & his heirs forever a certain negro woman named Judy which said Negro & Increase I do forever warrent and defend against the Just claim or claims of all and every person or persons Whatsoever claiming the same by through in or under me.

This Indenture was made this sixth day of April 1807, between Robert Prunty of the County of Franklin and State of Virginia of the first part & Francis Belcher of the County of Franklin & State aforesaid of the other part.

 

Witnesseth that the said Robert Prunty hath and doth for and in consideration of the sum of Seventy five pounds in hand paid this Receipt where of is hereby acknowledged, granted Bargained & Sold unto the said Francis Belcher a certain Tract or parcel of Land ---- containing one hundred acres more or less, lying and being in the said County of Franklin on both sides of the Long Branch; Beginning at a white oak in Elisha Eastis line, thence with Saml. Collands & John James's line crossing the Long Branch to Pointers in Bottom Eastis line, thence with is line to Jessee Eastis corner Hickory, thence with his lines to Elisha Eastis lines, thence with it to the Beginning.  To have & to hold unto the said Francis Belcher his heirs etc forever in an indefeatible[?] Estate and the said Robert Prunty doth for himself his heirs & etc covenant nd agree to & with the said Frances Belcher his heirs & to warrent & forever defend the said Land & premises with all the appurtenances thereunto belonging or in any wise appertaining from the Just claims or demands of any persons or persons whatsoever. This indenture made this 27th day of May 1816 between Isham Belcher of the County of Franklin & State of Virginia of the one part & Zachariah Finney of the County & State aforesaid of the other part Witnesseth that the said Isham Belcher has this day bargained & sold unto the said Zachariah Finney for and in consideration of the sum of twenty pounds twelve shillings & 6p in hand paid this receipt where of is hereby acknowledged a certain tract or parcel of land situate lying and being on the ridge between Snow Creek and Grassy Fork including the head of one Branch running into Snow Creek containing by survey 27 & a half acres.  Bounded as followeth viz; Beginning at Pointers in Jesse Pruntys line on the old road leading from Richard Stocktons to Jn. To have and to hold [unto?] the said Zachariah Finney his heirs & forever the said Isham Belcher doth for himself his heirs & etc warrent the said land & premises with all the appurtenances thereunto belonging or in any wise appertaining unto the said Zachariah Finney his heirs & free from the Just claim or demand of any person or persons whatever. Know all men by these Presents that I Joseph Swinney of the County of Franklin and State of Virginia for and in consideration of the sum of one hundred dollars to me in hand paid before the writing signing and delivery of these Presents doth give grant bargain sell & confirm to Francis Belcher of the County and State aforesaid all my  right title claim and interest in the Estate of the late Francis Belcher (dec) consisting of negros Horses Hogs & cattle household & kitchen furniture of every description, plantation utensils [do] as well as every other species of property whatsoever.  Which Sd. property with its increase, profits [do] I do hereby relinquish to the only use benefit of the said Francis Belcher provided.  Nevertheless that the said Francis Belcher shall provide the Sd. Swinney with a house & home during Sd. Swinneys life with also such other conveniences as are reasonable and Necessary.

At a district court held at Franklin Courthouse the 20th day of April 1807 This Bill of Sale from Joseph Swinney to Francis Belcher was proved by the oath of John Cook one of the witnesses hereto and at a District Court held at Franklin Courthouse the 21st day of Sept 1807 the same Bill of Sale was furthur proved by the Oath of Thomas Dunn another witness and was ordered to be recorded.

Know all men by these presents that I William Callaway of the county of Franklin and state of Virginia being desirous of liberating and setting free my slaves named Perlina and her husband Abram and also Sally, Eliza, Giles, Creed, Harriet, Joab, Harden, Felix, Albert and Milton the children  of the said Perlina, do hereby give, grant, convey and assure to the said Perlina, Abram,Sally, Eliza, Giles, Creed, Harriet, Joab, Hardin, Felix, Albert and Milton their rights to and enjoyment of their liberty and freedom. From and after the date of this deed of emancipation and I do hereby covenant that I will and that my heirs shall warrant and defend the said right to freedom to the said Perlina, Abram, Sally, Eliza, GIles Creed, Harriet, Joab, Hardin, Felix, Albert and Milton and their heirs forever, against the claims and demands of all persons.           

 

In testimony whereof I have hereunto set my ahnd and affixed my seal  this he 15 day of April 1850.

This deed made this the 16th day of September 1882 between Jubal E. Ferguson sole heir of Alexander Ferguson decd and Nancy Ferguson, relict of the said Alexander Ferguson decd of the first part and E. T. McGuire of the second part all of the county of Franklin in the state of Virginia, Witnesseth, That for and inconsideration of the sum of five hundred and fifty dollars paid by E.T. McGuire party of the second part to Alexander Ferguson in his life time recupe whereof is acknowledged by the parties of the first part the said Jubal E. Ferguson and Nancy Ferguson parties of the first part do grant and convey to E. T. McGuire party of the second part with general warranty all the following lands, viz-

 

First a certain tract of land lying and being in the County of Franklin adjoing the lands of Abram Childress decd, George Dires (sic) decd others containing one hundred and sixty three acres more or less being the same land conveyed to Alexander Ferguson and E.T.McGuire by James L. Taylor and wife by deed bearing date the 20th day of March 1871 and of record in the clerks office of Franklin County.

 

Second, a certain other tract of land lying and being in Franklin County adjoining the above named tract and the tract now owned and occupied by John C. Ferguson containing one hundred and sixty four acres more or less being the same land purchased by James L. Taylor from Isham M. Ferguson and afterwards sold by the said James L. Taylor to Alexander Ferguson and E.T. McGuire and conveyed by deed bearing date March 20th 1871 and of record in the clerks office of Franklin County to have and to hold the said two tracts of land with the

appurtances there unto belonging to him the said E.T. McGuire forever.

Plybon of the second part Witnes that in consideration of one hundred and ninty dollars cash in hand paid Eli Ferguson and Mahala his wife doth grant unto Silas O. Plybon all this right title and interest with general warrenty to a certain lot of land lying on Lynville Road adjoining the lands of C._. Robertson, James Robertson & others and bounded by the lines of C._. Robertson James Robertson to the Lynville road near a tobacco barn thence to a chestnut thence to a blazed (sic) white oak in Stephen Ferguson line thence with Stephen Fergusons line to James Robertsons line containing fifty acres more or less--Witness our hands and seals this 28th day of Aug 1882

This Indenture made this 4th day of January 1833 between Elias Kitterman and Peter Kitterman of the County of Perry and the State of Indiana, heirs at law and divees of Henry Kitterman Dec. late of the county of Franklin and state of Virginia of the one part and William Campbell Senr. of the County of Franklin and State of Virginia of the other part witnesseth that whereas the said Henry Kitterman Dec. late of the county of Franklin and State of Virginia did posess of certian real estate to Wit one certain tract of land purchased from Thomas Crutcher as per deed recorded in the clerks office of the said county of Franklin containing 414 acres lying on the Gap branch of the Chestnut in the said county, one other tract adjoining the same purchase of a William Huston, as per deed of record in the Clerks office of the county aforesaid, containing 100 acres lying on Chestnut Creek and on other tract adjoining the first mentioned tract as per patent containing 154 acres, references being had to the paid Deeds and purchases, the courses and distrances will more fully appear and whereas, the said Henry Kitterman by his last will and testament which is also of Record in the Clerks office of the said Court of Franklin bequeathed unto Ann Kitterman during her life time the above mentioned lands and at her death to be divided among her children and the said Ann Kitterman having departed this life, leaving ten children, heirs and distributes of the said Henry Kitterman deceased to wit,  Mary Kitterman, George Kitterman, John Kitterman, Ann Kitterman the younger who intermarried with a certain George Robertson, Susannah Fortune formerly Susanna Kitterman, "Christopher Kitterman, Zachariah Kitterman, Elias Kitterman, Michael Kitterman, Peter Kitterman and whereas the said Peter Kitterman some time since purchased of the said Michael Kitterman his interest and claim in the land aforesaid and whereas John Kitterman by his act and deed bearing date the 14th day of November 1832, hath constituted and appointed the said Peter Kitterman and Elias Kitterman his true and lawful attorney to act for him in and about the premises aforesaid and whereas George Robertson and Ann his wife formerly Ann Kitterman, Susannah Fortune formerly Susannah Kitterman, Christopher Kitterman and Elizabeth his wife and Zachariah Kitterman and Mary his wife by their act and Deed bearing date 15th day of October 1832 have constituted and appointed this said Elias Kitterman and Peter Kitterman their true and lawful attorney to act for them in and about the premises aforesaid.  Now witnesseth that by virtue of the purchase aforesaid by the said Peter Kitterman from Michael Kitterman and the power of attorney from John Kitterman to Peter Kitterman and Elias Kitterman and the power of attorney from George Robertson Susanna Fortune to the said Elias Kitterman and Peter Kitterman in their rights being eight out of the ten children and distributes of the said Henry Kitterman, dec.  They the said Elias Kitterman and Peter Kitterman for and in consideration of the sum of $525.00 current money of Virginia to them in hand paid by the said William Campbell Senr. At or before the ensealing and delivery of these present the receipt whereof is hereby acknowledged hath bargined sold allowed enfused and confirmed and do by these presents bargin, sell, allow, enfuse and confirm unto the said William Campbell his heirs and assignes forever the before mentioned eight tenths of the aforesaid three tracts or parcels of land the whole amounting to 600 acres be the same more or less.  To have hold and enjoy the said eight tenths of the said land and premises, with its appurtinences thereto belonging either in land or in equity unto the said William Campbell Sr. heirs and assignes forever and the said Elias Kitterman and Peter Kitterman for themselves Indenture them the aforesaid eight tenths of the three tracts of land aforesaid unto him the said William Campbell Sr. his heirs and assignes so and will warrant and forever defend against the Claims of themselves and their heirs and against the Just Claim or demand of all and every other person or persons whatsoever.

Know all men by those present that I Sterling Parker of the county of Franklin and State of Virginia, for and in consideration of the natural love and affection which I have to my son William Parker and daughter Lucy Parker, both of the county of Franklin and State aforesaid, as well as for the further consideration of the sum of one dollar to me in hand first by the said William Parker and Lucy Parker at or before the ensolving and delivery of thus present the receipt whereof is hereby acknowledged and given and granted and by their presents do give and grant unto the said William Parker and Lucy Parker their heirs, executors, administrations and appendages the following lands and property to wit.

First I give to my son William Parker all my lands that I am in possession, consisting of two tracks containing two hundred and fifty acres and being the same that I purchased of Isaac Lemmons and John Kersy lying in the county of Franklin and in front of which I now live.  Also one feather bed and furniture and one three year old sorrel colt which I warrant and defer the title to the said William Parker his heirs and appendages forever. 

Second I give to my daughter Lucy Parker one bed and furniture, all the balance of my household furniture and all my kitchen furniture and all my plantation tools of every kind.  Also one cow and calf, three head of sheep, five head of hogs. Ten barrels corn and small quality of pickled pork of  three hundred pounds.

To have and to hold the said land and property to the said William Parker and Lucy Parker as above mentioned. Their executors, administrators, and appendages forever, and the said Sterling Parker for himself, his executors and administrators and appendages against the claim of all and every person or persons whatever shall and will warrant and forever defend them by these presents.

This Indenture made this 17th day of December in the year 1838 between William Parker and Sterling Parker of the County of Franklin and State of Virginia on the one part and James Keys, Trustee of the County of Franklin in State aforesaid of the other part. Whereforth that the said William Parker and Sterling Parker in order to secure the payment of debt due Samuel Saunders and Co. of the said County and State aforesaid due by bond, one bond due the 8th day of January 1838 for eighty nine dollars, eighty six cts. Also one bond due the 16th day of December 1838 for one hundred and forty dollars lawful money of Virginia and for the further consideration of the sum of one dollar to them in hand paid by said James Keys Trustee aforesaid, the receipt whereof they doth hereby acknowledge, hath bargained, sold, released and confirmed_?__by those present, grant, bargain, sell and confirm unto the said James Keys-Trustee, the following tracks of land and property to with, first being tracks of land lying and being in the County of Franklin on the waters of Nicholas Creek a branch of Smith River containing one hundred and fifty acres, being the same more or less being the track of land the said William Parker and Sterling Parker does reside on and the same deeded to the said Sterling Parker from  Isaac Lemmons. Reference the said deed for the course, also one other track lying in the said County of Franklin on the waters of Pig River containing one hundred acres more or less and being the same track deeded to the said Sterling Parker from John Kasey,, which deed is recorded in the Clerks office in the County Court of Franklin. Reference being head to the same for the course and boundary. Also the following property (to with) One bay mare, one black mare, sixteen head hogs, eight head of sheep, one heifer, all marked with swallow forks in the right ear and also in the left ear. Two feather beds and furniture

belonging to the same. Five bed stands, three pair geas ( geese), six stacks oats, one wood work of small wagon, eight chairs and all the crop of corn.

To have and to hold the aforesaid tracks of land and property to the use and behold and benefit of him the said James Keys and his heirs forever against the claim of them, the said William Parker and Sterling Parker and each of them and their heirs and all and every other person or persons, whatever other in law and equity claiming in anyway in Trust never the ? ?.  If the said William Parker and Sterling Parker shall pay the said sum due and the bonds of eighty nine dollars eight six cents, and one hundred forty dollars with the legal interest on the same and the costs attending this indenture to them the said Samuel Saunders and Co. their heirs or appendages on or before the first day June next, then the said the said James Keys doth oblige himself and his heirs to reconvey the said lands and property to the said William Parker and Sterling Parker and their heirs and appendages, but if the said William Parker and Sterling Parker shall fail to pay the said Samuel Saunders and Co. the said sums aforesaid mentioned then the said James Keys Trustee or his heirs shall forthwith proceed to sell on the said

premises the said land and property to the highest bidder for the ready money, previously advertising the same time and place of sale of the aforesaid lands and property at Franklin Courthouse at least ten days before the sale thereof and amount of proceeds thereof--First pay and satisfy the said Samuel Saunders and Co. their debt aforesaid with the legal interest and costs aforesaid and the over lush (?) if any there is after paying the said debt before mentioned, pay to the said William Parker and the said Sterling Parker their heirs or legal representatives.

This indenture of bargain and sale between Joel Sweeney and Nancy his wife of the one part, and Lewis Lancaster of the other part was proved in the said office by the affirmations of Samuel J Palmer, one of the witness here to and in the sad offices April 6th 1840.  This said indenture was further proved by the oath of John Janney and Burrell Janney two other subscribing witnesses hereto and admitted to record.

This deed made and entered into the six day of October One thousand eight Hundred and sixty six between George Walker of the First part and Walker Claytor of the second part  all of the County  of Franklin and State of Virginia WItnesseth the said George Walker doth this day Convey by deed to the said Walker Claytor the land that the said George Walker purchased of Thomas D. Jones contained 104 acres more or less also the lands bought to Thomas Williams containing one huundred and fifty acres more or less also all the land willed to the said George Walker by his father containing four hundred and eighty four acres more or less for which the Said Walker binds himself to pay to  the said George Walker one hundred dollars per year during his natural life for his support all of said lands lying and being in the County of

Franklin  the title of said lands the said George Walker doth forever warrant and defend for himself and all others claiming under him to the said Walker Claytor and his heirs. Given under my hand and seal the day above written above.
