James Bishop to Hartwell Wells

 

An Indenture, made this 11th day of May in the year of our Lord one thousand eight hundred and forty eight, between James Bishop of the first part and Hartwell Wells of the other part, all of the County of Dinwiddie and State of Virginia. Witnesseth, That James Bishop for and in consideration of the sum of Sixty Six dollars and fifty cents of lawful money of this Commonwealth, to him in hand paid by the said Hartwell Wells, at or before the ensealing and delivery of those presents the receipt whereof is hereby acknowledged, have given, granted, bargained and sold, alieneded, enfeoffed, released and confirmed, and by these presents do give, grant, bargain, sell, alien, enfeoff, release and confirm to the said Hartwell Wells, his heirs and assigns, a certain tract or parcel of land lying and situated in the said County of Dinwiddie, containing thirty eight acres and adjoining the lands of William Bishop and being the same which was allotted to said James Bishop under the will of his father James Bishop late of the said County deceased. To have and to hold the said tract or parcel of land with the appurtenances thereunto belonging, to him the said Hartwell Wells his heirs and assigns, to the only proper use and behoof of the said Hartwell Wells, his heirs and assigns forever. And the said James Bishop for himself, his heirs, executors and Administrators do hereby covenant and agree to and with the said Hartwell Wells his heirs and assigns that he the said James Bishop and his heirs, the said tract or parcel of land with it's appurtenances unto him the said Hartwell his heirs and assigns against them the said James Bishop and his heirs and against all manner of persons whomsoever, shall and will by these presents forever warrant and defend. In witness whereof the said James Bishop has hereunto set his hand and affixed his seal the day and year first above written.

At a Court held for Dinwiddie County on the 21st day of August 1848.

This Deed of bargain and sale from James Bishop to Hartwell Wells, was proved by the oaths of William Bishop and Robert H. Hardaway subscribing witness thereto, and continued for further proofs and at another Court held for the said County, on the 16th day of October 1848. This Deed was further and fully proved by the oath of Robert Gibbs another Subscribing witness thereto, and ordered to be recorded.

NOTE: This deed transfers the 1/5 share of land James Bishop inherited from his father James Bishop, Sr. to his neighbor Hartwell Wells. See James Bishop Sr’s Will.
