At a meeting of the committee for the county of CULPEPER, held at the courthoufe, the 18th of December, 1775
Ordered, That the matter relative to the Rev. JAMES HERDMAN by advertised I the public gazette.
To wit,
The Rev. James Herdman, Rector of Bromfield parifh, having proper notice that the 20th of July laft was appointed by the Continental Congrefs, and approved of by our Convention, as a faft, was defired to give notice of the fame, and preach a fermon upon the occafion; he refufed to do fo, and replied, it was inconfiftent with his duty to his Majefty, and imagined the people would not ftop at this, but would be for changing their King next. On this cmplaint, the committee for the county fummoned Mr. Herdman to appear at their next meeting, on the 24th following. Failing to appear, and it appearing, from the teftimony of fundry credible witneffes, that he faid "the committee had no authority to call him before them, neither had the Cogrefs any authority to appoint a fait, that power being only in the King and Clergy; that the people had no right to refute any thing the King and Parliament did; that he fhould not look to them for any protection, but rely on the King and Parliament." It was the opinion of the committee, that the faid Herdman was publicly advertifed as a perfon inimical to American liberty; and it was further recommended that the churchwardens and veftry of faid parifh do not fuffer him to preach in any of their churches, and that they levy no tobacco for him until the opinion of the Convention fhall be known. Thus the matter refted until October the 16th, when a further complaint was lodged againft Mr. Herdman for marrying one couple fince the determination of the committee of July the 24th, who then being at hand, was fummoned before the committee then fitting; but refufing to appear, and flighting the authority of faid committee, after the charge being proved.
Ordered, that as the Rev. Mr. James Herdman has added infult to his other acts of difobedience to this committee, he be forthwith expelled this county from and after the 19th day of this inftant (October) and that no perfon entertain him after faid day, faving only coming to and going from courts, and that a copy of this order be fervid on him by Benjamin Roberts__ jun. and Henry Hill, and that the fame be publicly advertifed.
