Will Book 10, p163 Charlotte County, Virginia

I John C Booth of the County of Charlotte do make and publish this last

will and testament in manner and form as follows:

First:  It is my will and desire that all my just debts be paid.

Second: I give to my daughter, Martha Francis Booth the sum of two

Hundred Dollars to her and her heirs forever.

Third:  I give to my daughter Elizabeth Cobbs Booth the sum of two

Hundred Dollars to her and her heirs forever.

Fourth: I give to my daughter Mary  Jane Booth the sum of two Hundred

Dollars to her and her heirs forever.

Fifth:  I give to my son  John R Booth the sum of Two Hundred Dollars to

him and his heirs forever.

Sixth:  After the payment of my Just Debts and the special legacies

above named it is my will and desire that my entire estate, both real

and personal, be kept together and managed for the benefit of my wife

and children until my oldest child become of age or marries and I hereby

request my executors herein named to council and advise my wife in the

management of the same.

Seventh:  It is my will and desire that upon the arrival of twenty one

years of age or marriage of my children that they receive from my estate

their proportion of the fore mentioned thereof except the household and

the kitchen furniture which I wish kept together for the use of my wife

and younger children. I ---- except my personal carriage which I leave

my wife during her widowed life.

Eighth:In the event my wife's marriage again, I consider the following

slaves which was loaned or given her by her father, James McCargo dec'd

to wit Peter, Anthony, Tyree, Mary, Dolly, Milly, Hannah, Sarah, Arthur,

Marente, Clem, and Aolina to be __ for her support consequently it is my

will and desire that the household and kitchen furniture together with

the plantation tools and stock of every description be returned to my

estate, that my lands be rented out until my children become in

possession of the lands given them by their grandfather James McCargo

dec'd then to be put into a general division supposing that the best

interests of my children will be promoted by doing so, as I consider it

too small to divide and it is not my wish for it to be ______.

Ninth: If I should have more stock than my executors should think

necessary for the use of my wife and children, I hereby authorize them

to sell such as they may think can be best spared from my estate.

Tenth and lastly I do hereby constitute and appoint Hillery A Booth and

Patrick Booth Executors of this my last will and testament.  In witness

whereof I have set my hand and seal the 21st day of May

Whereas I John C Booth of Charlotte County having made and truly

executed my last will and testament in writing bearing date  the 21st

day of May 1851.  Now I do hereby declare this present writing to be a

codicil to my said will and direct the same to be annexed thereto and

taken as part thereof:

Codicil 1st: It is my will and desire that the piece or parcel of land

purchased of Obedience Skelton and not disposed of in my will (in

consequence of its having been purchased since the date of my will)

containing twenty five acres be the same more or less be disposed of as

the balance of my lands are disposed in the foregoing will and herein

annexed.

In witness whereof I have hereunto set my hand and affixed by seal this

13th day of December 1851.

At a court held for Charlotte County the 3rd day of May 1852 the

foregoing last will and testament of John C Booth, dec'd together with

the codicil there under written were this day produced in court by

Hillery A Booth one of the Executors therein named and the said will was

proved by the oaths of two of the subscribing  witnessess, thereto, and

ordered to be recorded and the said codicil was also proved by the oaths

of two of the subscribing witnesses thereto and ordered to be recorded.

And on motion of the said Hillery A Booth who took the oath prescribed

and together with Zachariah Bugg, William T Chaffin, Hillery M L Goode,

William Bacon and John G Smith, his securities, entered into and

acknowledged a bond in the penalty of forty thousand Dollars conditioned

for the use? and faithful discharge of the duties of his said office or

trust a certificate is granted the said Hillery A Booth for obtaining a

probate of the said will in due form.
