I, Elizabeth A. Tharp of Beatrice, Charlotte County, in the State of Virginia do make this my last will. I
give to Robert A. Tharp at my death the house and lot on which I now reside at Beatrice in Charlotte
County and State of Virginia containing (8) eight acres of land. I give to my children an equal share in the
remainder of my estate real and personal consisting of (50) fifty acres of land, more or less, lying on Sandy
Creek in the County of Charlotte and State of Virginia, this being the same tract of land bought by my
husband, C. Allen Tharp of James A. Ferrell and afterwards deeded to me. The names of my children who
I wish the remainder of my estate divided equally among after giving the lot and house to Robert A. Tharp,
is Wm. R. Tharp, Eliza Jane Lankford, Charles H. Tharp, E. T. Tharp, Susan A. Rutledge and Robert A.
Tharp. I appoint Drury B. Hutcheson of Sandy Creek, Charlotte County, executor of this will. In witness
whereof, I have signed this instrument as my will at Beatrice on Feby. 17th, 1904.

The foregoing will was this day signed by the said Elizabeth A. Tharp and acknowledged by her as her last
will, in the presence of us, the undersigned subscribing witnesses, both of us being present at the same

THIS DEED, made this 19th day of April, 1909, between W. R. Tharpe and Rosa B. Tharpe, his
wife, and Susan A. R. Rutledge and W. H. Rutledge, her husband, parties of the first part, and
R.A. Tharpe, party of the second part, WITNESSETH: That the parties of the first part for and in
consideration of the sum of $180.00 cash in hand paid by the party of the second part do hereby
grand, bargain, sell and convey with general warranty unto the said party of the second part all
their right, title and interest in and to all the real estate that was devised by the will of Elizabeth
A. Tharpe to Robert A. Tharpe, William R. Tharpe, Eliza J. Lankford, Chas. H. Tharpe, E. T.
Tharpe and Susan A. R. Rutledge which will is duly recorded in Charlotte County Clerk's Office
in Will Book No. 2, page 386, and the land therein devised to the said parties is described as
containing fifty acres, more or less, lying on Sandy Creek in the County of Charlotte, in the State
of Virginia. It being the intention of the parties of the first part to this deed to convey all their
interest in the land thus devised whether the same shall by actual survey turn out to be a much
greater area that fifty acres. And the parties of the first part hereby covenant that they have a
right to convey the said land to the grantee, that they have done no act of encumber the said land;
and that they will execute such other and further assurances of the same as may be requisite.

H. Tharpe, E. T. Tharpe and Susan Rutledge, which will is duly recorded in the Clerk's Office of
Charlotte County in Will Book #2, page 386: and the land therein devised to the said parties is
described as containing 50 acres, more or less, lying on Sandy Creek in the County of Charlotte,
Virginia;
It being the intention of the parties of the first part to this deed to convey the entire interest of the
said parties of the first part in the said land devised as above set forth, whether the same shall by
actual survey appear to contain more than fifty acres or not:
And the said grantors covenant: that they have the right to convey the said land to the said
grantee; that they have done no act to encumber the said land; that the said grantee shall have
quiet possession of the said land free from all encumbrances; and that, they, the said grantors, will
execute such further assurance of said land as may be requisite:

THIS DEED OF PARTITION, Made and entered into this the 15th day of March in the year 1928, by
and between R. A. THARPE and KATE THARPE, his wife, parties of the first part, and CHARLES H.
THARPE, and FANNIE THARPE, his wife, parties of the second part:

WITNESSETH:

THAT, whereas the said R. A. Tharpe and Charles H. Tharpe are seized in fee simple of, and have equal
shares as tenants in common in a certain tract, piece or parcel of land, lying and being in Bacon Magisterial
District, Charlotte County, Virginia, formerly owned by Elizabeth A. Tharpe, deceased, and devised by her
last will and testament, duly probated and of record in the Clerk's Office of the Circuit Court of Charlotte
County in W. B. No. 2 p. 383, to her children; the interests of all of said children and of their heirs having
been conveyed unto the said R.A. Tharpe and Chas. H. Tharpe by two certain deeds, one dated April 19,
1909 and of record in the Clerk's Office of the Circuit Court of Charlotte County in D.B. No. 61 p. 520,
and the other dated March 19th, 1913, and of record in the aforesaid Clerk's Office in D.B. No. 64 p. 383,
said tract of land containing by survey of J. D. Morton, C.C.S., One Hundred and Twelve (112) acres:
NOW THEREFORE, to the end and intent that a perfect partition may be had and made by and between
the said R. A. Tharpe and Chas. H. Tharpe, of the said tract or parcel of land, they, the said R. A. Tharpe
and Chas. H. Tharpe, by their own mutual consent and agreement, have and do hereby made partition of
same in the manner following:
The said R. A. Tharpe shall have for his part and portion of the said tract or parcel of land, fifty-six acres

degrees E (a spring about 4 poles east of line at 14 poles and another spring about 1 po. east of line at 16

contained in this deed, do grant unto the said Chas. H. Tharpe, with Special Warranty of title, all their right,
title, interest and estate in and to the said described tract of land, containing by survey 56 acres, which
survey is hereto attached, and which has been heretofore fully described by metes and bounds.
