This appears to be the final accounting of Levy Blankinship's administration of Asa's estate. What happened to Asa's family after this is unclear. The account continues thru pages 95, 96, 97, 98 and 99 and consists mostly of payment of Asa's debts, payment of Asa's family's living expenses and "Cash to the widow" That there was more than one Asa Blankenship in Lunnenburg see: Lunn CTO BK 16-77: Asa Blankenship to be ensign in the room of Francis Smithers who is promoted 4 Jul 1795

All to wife, Ann, land I live on during her natural life, after her decease , to son Abel Blankenship, residue equally divided between four children, Madelene Pigg, Ella Morton, Mary Dixon, and Cain Blankenship . Cain's share to go to the child that takes care of him after Ann's death .(2)

I make this my last will and testament, firstly, I want John J Throckmorton to take all of my estate in hand and first sell all the Peters Creek tract of land that lies below the road from Richard Edmundson's to Wm. Allen's mill, and after selling that land, I want him to advertise and sell all my land. I want it to be at his discretion about the time of the sale of the land. I want him to sell every piece of property and everything except the negroes and my blood mare and Sarpeslon Colt. (3) I want the sale of my property to be in the fall, or any time when he thinks best, and after he has sold all and paid my debts, I wish him to make a division of my Estate, when he thinks proper for it to be done. I wish it made in the following manner: Firstly, after all my debt is paid, I want my son Levi A. Blankenship to have one hundred dollars out of my Estate. I want the balance of my Estate equally divided with my daughters, towit, Mary M. New, Nancy G. Blankenship, Elizabeth L. Dismukes, Martha C. McCargo, Susan N. Blankenship, Sarah A. Blankenship, Leticia A. D. Blankenship, and my wife Elizabeth S. Blankenship. (4) I want John J Throckmorton to manage my Estate just as he would his own and sell the lands and make deeds for it, that shall be good and permanent from me and my heirs, as same as if I had of made it myself. I wish the sale of the land to be wholly at his DISCRETION. I do not require the said John J Throckmorton to give any security. I wish Ray Portjeo to remain in the house where he now lives, five years, that is, if his behavior deserves it, and if my Estate will admit of the sale of the said lands, to be put off of to that time. But I wish it to be just as John J Throckmorton thinks best. I want Joseph to tend all the ground that he cleared, two years for clearing (that is after the present year). He is to keep half of what he and Marshall make this year.(5) He is to pay rent on the land that he cleared, after having it for two years, for the clearing. I want John J Throckmorton to have his own control about selling any tract or piece of land, when he thinks best to sell it, publicly or privately, just as he thinks best, and in fact, I want him to wind up my Estate, just as he thinks best, and sell my land and make a division, just when he thinks best. I wish him to get the Commissioners to take this tract of land where I now live, back, provided they will pay one hundred dollars for the improvements I have made on it, and pay back the two hundred dollars I have paid for it. But I leave that to John J Throckmorton, to do it if he thinks best, or if he thinks it best not to do it. As witness my hand and seal the day and year above written.(6)

James Callicott and Susannah, his wife, formerly the widow of George Brooke, dec'd, Plaintiff's vs Langston Bacon, adm'r of the estate of George Brooke, dec'd; Bibby Brooke, Thomas Brooke and Travis Brooke, sons and infants of George Brooke, dec'd, Defendants - a suit in Chancery
On the motion of Langston Bacon, he is appointed special guardian for Bibby, Thomas and Travis Brooke for purpose of this suit. Ordered that a division of the slaves, (except a negro named Black Sall), and personal estate belonging to George Brooke, dec'd, in the possession of the defendant Bacon, as adm'r of the sd George Brooke, who died intestate, so far as respects the dower of the sd pltf, Susannah, as in the bill mentioned, be made in a fair and equable manner, that is to say, one third of the slaves, John, Bib, Will, Sall, Rosa, Hannah, Lucy, Joane and Edmund, and one third of the personal estate, as her distributable share, after allowing a sufficiency of the personal estate to pay the debts of the intestate, be allocated and assigned to the sd Plaintiffs, James Callicott and Susannah, his wife, late the widow and relict of the sd George Brooke, dec'd, as her reasonable dower.

This day came the parties by their attorneys, and the commissioners who were appointed under an order of this court to make partition and allotment of the land and appurtenances, of the sd order mentioned, this day made their report in these words: Charlotte County: agreeable to an order of the court of Charlotte Co, to us directed; we have proceeded to divide the estate of George Broks (sic), dec'd, among his children, agreeable to the within statement, and have allotted to each his division of land in the following manner, towit: To Bibby Brooke, the eldest son, 91 acres agreeable to platt No. 1 -- to Thomas Brooke, 136 acres agreeable to platt No. 2 -- to Traverse Brooke, the third son, 108 acres agreeable to platt No. 3. Given under our hands this 1st day of November 1798 -- Hillary Moseley, Reps Osborne, Miles Bottom, Commissioners. In the first place, I reco11mmend my soul to God, through the merits of my Redeemer. In the next place, my body to the earth, to be buried in a Christian like manner, as my Executors, hereinafter named, shall think proper.
ITEM: My desire is that my wife, Susannah Callicot, shall live on and be possessed of, the plantation I now live on, with six of my Negroes, Abram, Poll, Phil, Big Peg, Dorhis, and Silver during her natural life, also two feather beds and furniture, two horses, twelve head of cattle, twelve head of sheep and fifteen head of hogs, also the use of my tables and kitchen furniture. At the death of my wife, sell the property, Negroes, stock and household goods, to be equally divided amongst all my daughters, Clary, Prudence, Rhoda, Nancy, Dicy, and Betsy.
ITEM: My will and desire is that all the residue of my Estate, real and personal, be equally divided between my two sons, James and William after taking my part of.
My will and desire is that Little John McCargo and Brachet Barnes be my Executors.
In witness whereof I have hereunto set my hand and seal this twenty first day of December, one thousand eight hundred and six.

At a Court held for Charlotte County the 2nd day of February 1807, this last will and testament of James Callicot,deceased, was presented in court by Little John McCargo, one of the Executors herein named, and the same was proved by the oath of Francis Barnes Sr.,one of the witnesses thereto subscribed, to be acknowledged by the said James Callicot as his last will and testament, in his presence, and that he believed he was then in his perfect senses and memory. Thomas McCargo and Thomas Parish, the other two subscribing witnesses, being sworn, saith James Callicot was not in his perfect senses and memory at the time of acknowledging the same in their presence. The motion for admitting the will to record is continued until next court, for the Court to advise thereon, and it is ordered that the said Estate be committed to the hands of the said Little John McCargo and Brachet Barnes, the Executors named in the will, until further order of the Court.

On the motion of Susannah Callicot, by Thomas Brooke, their guardian, by their attorney - to admit the will of James Callicot to record in this court, on hearing the testimony of sundry witnesses and the arguments of counsel, as well on behalf of the plaintiffs as in behalf of Miles Bottom, William T. Branch, Little John McCargo, and William Archer, defendants in opposition thereto, alleging the Testator was not in his senses and memory at the time of the execution of the said will. It is the opinion of the Court that the said James Callicot was in his senses and memory at the time of executing this will. Therefore it is ordered that the will be admitted to record in this Court, and that the defendants pay to the plaintiffs, their costs. On the motion of Little John McCargo, one of the Executors herein named, who made oath according to law, Certificate is granted him for obtaining a probate of the said will in due form, he giving security. Therefore it is ordered that the will be admitted to record in this Court, and that the defendants pay to the plaintiffs, their costs. Whereupon he, with John McCargo, Miles Bottom, James McCargo, and Martin Williams, his securities, enter into and acknowledge their bond according to law for that purpose. Brachet Barnes, the other Executor named in the will, renounced in open court, the burthen of the Executor thereof.

ITEM I give to Elizabeth Duffer, my negro man Peter, also my negro man Murphy, to be sold by my executors, hereafter named. The money arising from such sale, I give and bequeath to the said Eliza- beth Duffer. (20)
ITEM I give to Mary Ann Margaret Duffer and Elizabeth Susannah Duffer, daughters of Elizabeth Duffer, the following property towit: Matt, Rachel, Abram, Linda, Bailly and Mary, with their future increase, also my part of the tract of land lying on the Staunton River, formerly the property of Miles Bottom, to be sold by my executors, in the manner they think most proper, and convey such title as is vested in me. The money arising from such sale, together with the above named negroes, is to be equally divided between the said Mary Ann Margaret and Eliz. Susannah Duffer, and if either of the above named children are without lawful heir, her part of the property is to go to the other.

Item 3 The residue of my estate both real and personal of every description together with all that may accrue to me from any source whatever, I loan to my beloved sister Elizabeth Williams McCargo, for her own special benefit during her natural life and it shall be in no wise subject to the payment of any debt heretofore contracted by her husband Little John McCargo and at the death of my sister Elizabeth Williams McCargo, my will is all the property loaned to her by me of every description be divided into as many equal parts as my sd sister has living children at the date of this will and that each and every one of such children do receive one equal share of my property to have and to hold to them forever and further if any of the aforesaid children should die before receiving such portion and leaving no lawful children, then the portion allotted for them shall be equally divided among the surviving brothers and sisters. At a Superior Circuit Court of Law & Chancery held for Charlotte County the 18th day of September 1844, the last will and testament of William Callicott, decd, was exhibited in court by Little John McCargo, the executor therein named and the same was proved by the oaths of William Bacon and Anderson Malone, two of the subscribing witnesses thereto and ordered to be recorded.

At a Superior Circuit Court of Law & Chancery held for Charlotte County the 18th day of September 1844.
On the motion of Little John McCargo, the executor named in the last will and testament of William H. Callicott and who made oath thereto and together with Hezekiah McCargo, Hezekiah D. McCargo, George R. McCargo, Little John S. McCargo, William T. McCargo, David H. McCargo, John M. McCargo, William Bacon, Drury A. Bacon, and Hillary M. L. Goode, his securities, entered into and acknowledged a bond in the penalty sum of fifty thousand dollars, conditioned as the law requires. Certificate is granted the sd Little John McCargo for obtaining a probate of the said will in due form.

Question by pltf counsel: please state what you know about the sale of a tract of land to Little John McCargo Jr by Little John McCargo Sr called the Terrapin tract on Hazel Branch in Halifax County Virginia and in whose possession sd tract of land is at this time and has been since the sd sale by Little John McCargo Sr.
Answer: I was present at the sale of the Terrapin tract on Hazel Branch. The land belonged to Little John McCargo Sr. bot by Little John McCargo Jr. I think the size of the tract on the day of the sale was stated to be eighty acres more or less. Little John McCargo Jr. has been in possession of this tract of land since the day of the sale, claiming it as his own property. Answer: I was at the sale. It was in the year 1855 I think. I was a bidder for one of the tracts of land sold by Little John McCargo Sr on that day, there were two tracts sold, one on Difficult Creek, the other on Hazel Branch {and called the Terrapin Tract} and Little John McCargo, Jr bought both of them and has been in possession of both tracts ever since claiming them as his own possession. Little John McCargo, Sr was present at the sale, conducting it.
Question by same: Do youi recolect the terms on which the tract of land was sold.
Answer: The Difficult tract was certainly sold upon a credit to the 1st day of June for one-third of the purchase price, and upon a credit of 12 months for the remaining two-thirds of the purchase money, and I think the Terrapin tract was sold upon the same terms, and of this I feel pretty confident, though my attention was more particularly called to the Difficult tract, because I was a bidder for the same. The sale was early in January 1855. I have known Little John McCargo, Jr. since his boyhood. He was born where I live and I know that he has owned no other lands in Virginia except the two tracts bought of his father in January 1855 as before stated.
Question by same: Please state what you know about the execution of Little John McCargo's Jr. bonds for the above two tracts of land.
Answer: William Bacon, the admr of Wm. H. Callicott, dec'd, staid at my house on his way to the sale of these 2 tracts of land and said that he didn't intend to interfere with the sale but that the bonds taken from the purchasers for the tracts was to come to him as adm'r of Callicott to pay money which Little John McCargo Sr owed to the Callicott estate. Mr. Bacon afterwards told me that he had gotten the bonds and that Dr. Fleming was the was the security of Little John McCargo Jr. and that he had [maily] enough money in his hands to make the first payment and further deponent saith not.

Answer: Sometime in the year 1855 (the winter of that year) Little John McCargo Sr., sold at public auction two tracts of land in the County of Halifax, one of these tracts had a dwelling house on it and was situated on Difficult Creek. The other was a smaller tract and I have since been informed and I believe was situated on Hazel Branch and called the Terrapin Tract - Little Jno S. McCargo Jr. bought both of the above tracts & executed his bonds for the same to the said McCargo Sr. with B. R. Fleming as his security. Both bonds are dated 2 May 1855. One of them for $ 12,193.81 & payable the 25th Dec 1855. The other for $2,587.62 & payable the 25th Dec 1855. These bonds embrace the entire purchase money for both of the above tracts of land and were transferred to me by sd McCargo Sr. to pay his debt to the est of Wm. Callicott, dec'd, of which I was adm'r. Both of these bonds have been paid in full to me by Little John S. McCargo Jr & long since given up to him. and further deponent saith not.

My will and desire is that my Loving wife, Judith Ligon, may and shall Enjoy and possess During her Natural Life, 150 acres of Land Bounded as followeth Beginning at the Mouth of Brown's Creek, so up the River to the mouth of Cedars Creek, thence up Each Creek an Equal distance from the River, so as to include the above said Land and my Dwelling House. I lend unto my loving wife, Judith Ligon, during her natural life one negro slave named Nan and one negro girl named Rachel. I lend unto her also during the time she Continues my widow, one Negro man named Abram. I give unto her also the Eight part of all my household furniture and likewise of my stock of all kinds not before given.
ITEM I give and bequeath unto my four sons, Thomas Ligon, James Ligon, Obediah Ligon, and Henry Ligon the Remainder part of my plantation whereon I now live to be Equally Divided between them when my son, Thomas Ligon, Comes to the age of twenty-one Years according to Quality and quantity, but if it should please God that if any of the aforesaid sons should Die before they should arrive at the age of twenty-one years, then his or their parts shall be Equally Divided between the survivors of the four Children
ITEM I give and bequeath unto my six sons, Blackman Ligon, John Ligon, Thomas Ligon, James Ligon, Obediah Ligon and Henry Ligon, six negroes: peter, jack, yellow Rachel, Sue, Jean and dick to be Equally Divided Between them, when my son, John Ligon, comes to the age of twenty-one years and likewise one more negro man Named Abraham. I, Hezikiah McCargo, being sound of mind & memory, do hereby make this my last will and testament in manner and form following -
1ST. It is my desire that my Estate be kept together two years after my decease, that my brother James McCargo superintend the plantation, employee overseers and direct any land to be cleared, that he may think proper.
2ND. It is my desire that the money arising from the crops as well as any other money belonging to my Estate be applied to the payment of my debts.
3RD. Should my son Hezikiah D[avid] McCargo sustain any loss in the collection of his debts in Mississippi, and the amount made from said debts not sufficient to pay all the debts which he is now owing, then and in that case, it is my desire that all the debts he is now owing, that may remain unpaid (after using his Mississippi funds) for that purpose, be paid out of my Estate, and my Executors are hereby directed to pay the same. 4TH. I give to my beloved wife, Tabitha McCargo,(37) one negroes boy by the name of John Stokes, to dispose of as she may think proper. I lend to her during her natural life, all my land not hereinafter disposed of, and the following slaves, with their future increase, (towit): Ryley and her five children, Pricilla, Betsy, Sally, Ann Nancy and Jinney; Carter; Rosa Stokes and her youngest child, Peyton; Lewis; Jules; Stephen; Frank; Asa; Albert; Champion; Elvira; Ben and Burrell and all the balance of my Estate, of every description whatever, not hereafter disposed of or, so much as she may think fully sufficient for her purposes. The balance of any to be by my Executors, sold. 5TH. After the death of my wife, it is my will & desire, the land loaned her be equally divided between my two daughters, Elizabeth H. McCargo & Jane McCargo, the balance of the property loaned her to be equally divided between my four children, Elizabeth H. McCargo, Hezikiah D. McCargo, Jane McCargo and James M[orton]. McCargo (reserving to my favorite servant, Ryley, the privilege of choosing her master or mistress), which I give them and their heirs forever.
6TH. I give to my son John M[orton] McCargo, all the property that I have heretofore possessed him of, and the following slaves, with their increase, (towit); Peter, Fanny, Amanda, Pusthena, Julia and Kelly, to him and his heirs forever.
7TH. I give to my daughter Elizabeth H[erndon] McCargo, all the property that I have heretofore possessed her of, and the following slaves with their future increase (towit); Dinah,Sam,Minerva & Harriet; one horse, saddle & bridle worth one hundred dollars; one bed & furniture and one cow & calf, to her and her heirs forever. 8TH. I give to my daughter Jane McCargo, the following slaves, with their future increase (towit); Larkin, Polley, Susan, Henry, Tom and Clarissa; one horse, saddle & bridle worth one hundred dollars; one bed & furniture and one cow & calf, to her and her heirs forever.
9TH. I give to my son Hezikiah D. McCargo all the land lying south of a line beginning at a marked white oak on the meadow ditch, running a straight line to a corner in the land purchased of Hillery M. L. Goode, near the fork of the roads, including the land purchased of the said Hillery M. L. Goode, Thos. J. Garden (formerly Robt H.Mayo) and a part of the land purchased of William Bacon; all the property that I have heretofore possessed him of and the following slaves with their future increase (towit);Jordan, Jacob, Eliza, Angeline, Alice, and Malinda; one bed & furniture and one cow & calf, to him and his heirs forever.
10TH. I give to my son James M[orton] McCargo, four hundred acres of land lying west of a line beginning at a marked Hickory on the Burnt Church Road, about eighty yards East of Ingram's gate on said road, running a straight line to Edward Robert's line for quantity, and the following slaves with their future increase ( towit);Abram, Jimama, Amy, Jasper and Isaac; one bed & furniture and one cow & calf, to him and his heirs forever.
11TH. I give to my grand daughter, Mary Jane Cooksey, one negroes woman named Matty with her future increase, one bed & furniture, one horse worth fifty dollars, one saddle & bridle worth fifteen dollars and five hundred dollars in money, to be by my Executors, kept at interest, and the interest paid her annually until she marries, at which time they are to pay over to her the said sum of Five Hundred Dollars, but in the event of her death before marriage, the whole is to return to my Estate, and be equally divided among my children, which I give to them and their heirs forever.(39)
12TH. It is my desire, and my executors are hereby directed to make sale of a certain piece of land purchased of William Rawlins, containing eighty acres, on such terms as they may think best.
13TH. Should there be any money left in the hands of my Executors after paying the legacies I have herein named, it is my desire that my wife Tabitha, have one third part of the same, and the balance equally divided among my children.
13TH AND LASTLY. I do hereby constitute and appoint my brother James McCargo, my son Hezikiah D. McCargo and my friend William Bacon, Executors to this my last will and testament, hereby revoking all others by ne heretofore made, and that the court require no security of them. In testimony whereof I have hereunto set my hand and seal this 18th day of October 1840

The foregoing last will and testament of Hezikiah McCargo dec'd, was this day presented in court by Hezikiah D. McCargo one of the executors therein named, and the same was proved by the oaths of H.M.L.Goode and William Elam, two of the subscribing witnesses thereto, and ordered to be recorded, and on the motion of the said Hezikiah D. McCargo, who took the oath prescribed, together with William Elam, William T.F.McCargo, Samuel McGehee, Frederick N. Cole, Hillery M.L. Goode & James M. McCargo, his securities (deemed sufficient by the court) entered into and acknowledged a bond in the penalty of fifty thousand dollars, for the due and faithful discharge of the duties of his office, a certificate is granted the said Hezikiah D. McCargo for obtaining a probate of the said will in due form.

The Sale of the personal estate of Hezekiah McCargo (Son of John the founder) was conducted 12 January 1853 at his plantation in Charlotte County Va. The account of that sale may be found Will Book 11 Pages 148- 154. Since Hezekiah's will disposed of his land & slaves, the items offered at the sale were from his household and plantation. The following is an extract of that account, showing only the items that I feel might be of interest to the McCargo family at large. As will be noted most of the purchasers were members of his immediate family, and are listed as:

I, I. H. McCargo of Mecklenburg County, Virginia being of sound and disposing mind and memory, do hereby make publish and declare this t be my last will and testament, hereby revoking all Wills by me all any time heretofore made.
(1) I direct that my executors, hereinafter named, shall pay out of my estate, all of my just debts and funereal expenses as soon after my death as is practicable.
(2) I give, devise and bequeath to my son, H[erbert] G[lendon] McCargo, my bed and bureau in the front room, one bed and center table in the room occupied by me; one wash stand, bowl and pitcher in the hall room, together with all blankets, quilts and counterpanes; one rocking chair and six split bottom chairs; one sewing machine; one dining table; one cook stove; one safe and the family bible;(41) my two horses or mules, whichever I may own at the time of my death, and harnesses, to be his in fee simple.
(3) I give to my two sons,H[erbert] G[lendon] McCargo and C[harles]. T. McCargo, jointly, share and share alike, my wood saw, feed cutter and engine.
(4) I direct that my executors, hereinafter named, shall buy as tombstone and place it at my grave, not to exceed Twenty-five ($25.00) dollars.
(5) All the rest and residue of my property of whatever kind and description that I may own at the time of my death, I wish, devise, and bequeath to be sold by my executors, hereinafter named, and the proceeds devised equally, share and share alike, among all of my children, namely: sons,H[erbert] G[lendon] McCargo, T[homas] P[uryear] McCargo, R[obert] H. McCargo, Lizzie Glasscock, Virgie Driggs, Sadie Alice Hall, Jessie Driggs, Orelia Reese and Estelle Brankley, to be theirs in fee simple.
(6) I do hereby nominate and appoint my son, C. T. McCargo, and my friend, H. I. Brankley, my sole executors of this my last will and testament, with full power and authority to execute the same according to its true and intended meaning and having perfect confidence in their judgement and integrity, I direct that my said executors shall allowed to qualify after giving reasonable bond.

The will of John McCargo, dec'd, was presented and proven by the oaths of John Garnett and John Hunsley, subscribing witnesses thereto. On the motion of Little John McCargo, one of the executors named in the said will, certificate is granted him for obtaining a probate of the said will in due form. Whereupon he, with Francis Barnes, James McCargo, Hezikiah McCargo and Henry Robertson, his securities, acknowledge their bond, according to law for that purpose.

The deposition of Gilderoy Yeats and Julius Hudson taken in pursuance of the annexed notice at the store house of Adkinson & Britton at Clover Depot, in Halifax Co. Va. on the 28th of March 1860 between the hours of 10 O'clock AM and 6:00 PM of that day to be read as evidence in a suit in equity now pending in the circuit court of Halifax Co. Va., Little John McCargo, Jr. pltf, and Wm. Bacon, adm'r de bonis non of William H. Callicott dec'd and others, as defendants.
The deponent [Gilderoy] Yeats, being first duly sworn on the Holy Evangelists of Almighty God, deponent saith:
Question by pltf counsel: please state what you know about the sale of a tract of land to Little John McCargo Jr by Little John McCargo Sr called the Terrapin tract on Hazel Branch in Halifax County Virginia and in whose possession sd tract of land is at this time and has been since the sd sale by Little John McCargo Sr.
Answer: I was present at the sale of the Terrapin tract on Hazel Branch. The land belonged to Little John McCargo Sr. bot by Little John McCargo Jr. I think the size of the tract on the day of the sale was stated to be eighty acres more or less. Little John McCargo Jr. has been in possession of this tract of land since the day of the sale, claiming it as his own property. I think the sale was in the year 1855, and further deponent saith not.

The deponent Julius Hudson, being next duly sworn, depose & saith:
Question by pltf counsel: please state what you know about the sale of a tract of land called the Terrapin tract on Hazel Branch in Halifax County Virginia belonging to Little John McCargo Sr to Little John McCargo Jr.
Answer: I was at the sale. It was in the year 1855 I think. I was a bidder for one of the tracts of land sold by Little John McCargo Sr on that day, there were two tracts sold, one on Difficult Creek, the other on Hazel Branch {and called the Terrapin Tract} and Little John McCargo, Jr bought both of them and has been in possession of both tracts ever since claiming them as his own possession. Little John McCargo, Sr was present at the sale, conducting it.
Question by same: Do youi recolect the terms on which the tract of land was sold.
Answer: The Difficult tract was certainly sold upon a credit to the 1st day of June for one-third of the purchase price, and upon a credit of 12 months for the remaining two-thirds of the purchase money, and I think the Terrapin tract was sold upon the same terms, and of this I feel pretty confident, though my attention was more particularly called to the Difficult tract, because I was a bidder for the same. The sale was early in January 1855. I have known Little John McCargo, Jr. since his boyhood. He was born where I live and I know that he has owned no other lands in Virginia except the two tracts bought of his father in January 1855 as before stated.
Question by same: Please state what you know about the execution of Little John McCargo's Jr. bonds for the above two tracts of land.
Answer: William Bacon, the admr of Wm. H. Callicott, dec'd, staid at my house on his way to the sale of these 2 tracts of land and said that he didn't intend to interfere with the sale but that the bonds taken from the purchasers for the tracts was to come to him as adm'r of Callicott to pay money which Little John McCargo Sr owed to the Callicott estate. Mr. Bacon afterwards told me that he had gotten the bonds and that Dr. Fleming was the was the security of Little John McCargo Jr. and that he had [maily] enough money in his hands to make the first payment and further deponent saith not.

Bacon in Charlotte County Va. on the 25th of April 1860, between the hours of 10 O'clock AM and [blank] PM of that day to be read as evidence in a suit in equity now pending in the circuit court of Halifax Co. Va., Little John McCargo, Jr. pltf, and Wm. Bacon, adm'r de bonis non of William H. Callicott dec'd and others, as defendants.
The deponent Wm. Bacon, being first duly sworn on the Holy Evangelists of Almighty God, deponent saith:
Question by defendant's counsel: Please state what you know about the sale in the year 1855, of a tract of land called the Terrapin tract and lying on the Hazel branch in the county of Halifax, belonging to Little John McCargo Sr and also about the payment of purchase money for the sd tract of land?
Answer: Sometime in the year 1855 (the winter of that year) Little John McCargo Sr., sold at public auction two tracts of land in the County of Halifax, one of these tracts had a dwelling house on it and was situated on Difficult Creek. The other was a smaller tract and I have since been informed and I believe was situated on Hazel Branch and called the Terrapin Tract - Little Jno S. McCargo Jr. bought both of the above tracts & executed his bonds for the same to the said McCargo Sr. with B. R. Fleming as his security. Both bonds are dated 2 May 1855. One of them for $ 12193.81 & payable the 25th Dec 1855. The other for 2587.62 & payable the 25th Dec 1855. These bonds embrace the entire purchase money for both of the above tracts of land and were transferred to me by sd McCargo Sr. to pay his debt to the est of Wm. Callicott, dec'd, of which I was adm'r. Both of these bonds have been paid in full to me by Little John S. McCargo Jr & long since given up to him. and further deponent saith not.

McCargo, one of the executors therein named, and the same was proved by the oaths of R.N.Lee and Joseph A.Clarkson, two of the subscribing witnesses thereto and ordered to be recorded, and James H. McCargo and John J. McCargo, the two executors named in the will appeared in court and renounced the execution thereof. Whereupon on the motion of James M. McCargo and John J. McCargo, who took the oath of office, and together with James H. McCargo, B.J. Law, Hezikiah D. McCargo, E.S. Rosser, Robert B. Spenser,and Sam'l F. McCargo of the County of Mecklenburg and the State of Virginia, being of sound mind and memory do make this my last will and testament in manner and form as follows: 1st I lend unto my father James C. I, Louis Napolean McCargo, Being of sound and disposing mind, of the County of Christian, State of Kentucky, do make and publish this my last will and testament, hereby revoking any and all wills that may have heretofore been made by me.
First: I direct that all my just debts be paid.
Second: I will to my wife, Mary P. McCargo an amount equal to a child's interest in my estate, to be hers absolutely, but if she should decline to take that, and take under the, she is to have the right to take a life interest in one third of my estate.

Sixth: If any of my children should be dissatisfied with mounts willed to them and should contest my will. those so contesting, shall only receive the sum of five dollars ($5.00) and the balance of the amount willed to them, is to be as residue to my estate. And if any of my children should die before I do, without leaving children, then in that event, the amounts willed them shall go back to the estate and be a part of the residue thereof.
Seventh: I direct that the residue of my estate, after paying any debts that I may owe, and said specific bequests, be divided equally among all of the mentioned devisees.
Eighth: I hereby appoint ny said son, Thomas Oscar, as executor of this last will and testament, and direct that he be allowed to qualify as such executor without giving bond. but should it appear to the court, he is not properly carrying out my wishes as expressed herein and is wasting my estate, the court shall have the right to require bond of him.
Ninth: I hereby authorize my said executor to sell and convey all my property, both real and personal, as soon after my death as is practicable for the purpose of dividing the proceeds as above directed.
My said executor will go to Frank Rives, Attorney, Hopkinsville, Kentucky for advice and counsel in carrying out this my last will and testament

Should my said son live to the age of twenty-one years, then I desire that he shall receive of the said John Foremen all the property and goods hereby placed in his hands in the absolute right. But if he should my son William died before he attains the age of twenty-one years, then it is my wish that my grandson John Gregory shall have all the property and effects herein willed to my son William and that my friend John Foreman shall act as the guardian of my grandson

McCargo, one third of my negroes property during her life and I lend her my household and kitchen furniture, my carriage and horses, cows, sheep, and hogs & bacon or Polk & [co--], I die possessed of, during her widowhood. 6th - The balance of my estate (slaves) shall be kept together and hired put to support my children and as each child arrives at the age of twenty-one ar marries, that such child shall be allowed his or her equal portion of slaves and money on hand at that time. 7th - At any time during the minority of my children, H. M. L. Bailey being sworn in court as witnesses depose and saith that they are well acquainted with the handwriting of the said W. T. F. McCargo and that the whole of the said will and signature thereto are in his proper handwriting and thereupon the said will is ordered to be recorded and on the motion of the said H. M. L. Goode, the executor therein named who took the oath of office and together with Wm. A Smith, John D. Southall, Zac. Bugg, and Hillary C. Moseley, his securities deemed sufficient by the Court entered into and acknowledged a bond in the penalty sum of Eighty thousand dollars, conditioned on the due and faithful discharge of his duties of his said office or trust certificate is granted the sd H. This indenture made this 11th day of August, 1839, between Mary Ellis of the 1st part, and John M. McCargo and Mary A. M. McCargo, his wife, of the second part. Witnesseth that the late William Ellis, the father of Mary A. McCargo, by his last will and testament, devised to the sd Mary Ellis, a large portion of his estate to dispose of as she thought proper, and the sd John M. McCargo, believing that the sd William Ellis was incompetent from mental imbecility to make a will, opposed the admission of the said will to probate, and all the parties being anxious to settle a family lawsuit, which is likely to be expensive and vexatious and to estrange them from each other. The said John M. McCargo doth agree to withdraw his opposition to the recording and establishing of the said will, and the said Mary Ellis, in consideration of the promises, and of the love and affection which bears with the children of the said William Ellis, and especially in consideration of five dollars, doth covenant, contract, and agree with the said John M. McCargo, that the said Mary Ellis will hold the estate devised to her, by William Ellis, as tenant for life, in the same way as she would have held it had it been devised to her by the said William Ellis for her life only, and that after her death it may and shall be divided equally among the children grand children and heirs at law of the said William Ellis, in the same way and proportions that it would have been had William Ellis died intestate. On the testimony of all and singular the parties have set their hands and affixed their seals the day and date above first shown.

This did not keep him from an occasional toddy apparently as note the "still house" which came to him through his fathers will, which see below.

36. Hezikiah David was born in 1813 so he would have been 30 years old at this time and unmarried. The Mississippi venture must have occurred in the previsious five years or so. I have not been able to find any Miss records relating to it.

It is ordered that William Bacon, Thomas Garden and Hilllary Moseley, three of the members . . . or any two of them do . . . examine the sd Prudence concerning the state of her mind and also to examine witnesses on the same subject and report the testimony together with their own opinion to the court and do say . . . whether the sd Prudence to be of sound mind and whether she is capable of managing her estate or not.

The court being informed of the report of Hiliary Moseley and Thos Garden two of the members the court appointed to examine into the state of mind of the sd Prudence McCargo that the sd Prudence McCargo is of unsound mind and incapable of taking care of her property. No other Joseph McCargo fits the time frame This is the second record of a first choice in hogs and the re-appearance of some of the successful bidders (i.e James C McCargo below) seems to indicate the sale was conduced at more than one location and perhaps over two or more days.
