Deed of Henry M. Shutts of the County of Charlotte and State of Virginia, and Sarah Jane Shutts his wife to George Grile of Ohio Submitted by Linda Lawson Charlotte County, Va Deed Book 33; Pg 425 - 427 Shutts to Grile This Indenture made this eleventh day of March in the year of our Lord One Thousand Eight Hundred and seventy two, between Henry M. Shutts of the County of Charlotte and State of Virginia, and Sarah Jane Shutts his wife of the first part, and George Grile of Ohio of the second part, witneseth that the said party of the first part in consideration of the sum of four thousand dollars, the receipt whereof is hereto acknowledged to them duly paid have sold and by these presents do grant and to the said party of the second part his heirs and asigns all that certain tract or parcel of land on which the said party of the first part now resides, situate in the County of Charlotte and State of Virginia and is descriped as follows to wit: Beginning at the small Ash in D. Bacons estate line, near corner between Mr. Potter and Shutts at A ---- thence N 4 degrees W 42 3/4 poles N 6 degrees E 10 poles, N 17 degrees E 22 3/4 poles N 22 degrees E 18 poles, N 18 1/2 E 24 and N 24 degrees E 42 poles to the corner of the fence at some blazed bushes at B, thence --- 48 degrees W 18 1/2 poles to a White Oak on the North bank of the creek at C, thence ----- 39 poles to a pile of Rocks on the East side of the raod at D, thence along the road N 32 1/2 degrees E 38 poles N 51 degrees E 14 poles and N 60 degrees E 33 1/2 poles to a Hickory on the West side of the road at E thence off on Bacons Estate line N 60 degrees W 81 1/2 poles to a stake near a cedar at F, thence N 18 degrees E 137 poles to a pine in the line of Booths Estate at G, thence S 76 degrees E 87 3/4 poles to a walnut tree at H, thence S 49 degrees E 133 1/2 poles to a Hickory in Estate of Dr. Gardens line at I, thence S 54 degrees W 66 1/2 poles to a stake on the North side of the road at J, along the road, thence S 37 1/2 W 10 1/2 poles to Gardens Estate corner Rock at K, thence off on his line S 1 degree E 101 1/2 poles to a white Oak at L, thence S 28 E 17 poles to a pile of Rocks near a little pine at M, thence a new line S 15 degrees W 72 poles to a White Oak at N thence S 66 degrees W 153 poles to the beginning at A, containing three hundred and twenty five acres (the grave yard containing three fourths of an acre with the right of way to the same being reserved: with the appurstenance and all the estate title and interest therein of the said party of the first part and the said Henry M. Shutts and Sarah Jane Shutts his wife do hereby covenant and agree to and with said party of the second part his heirs and asigns that the premises thus conveyed in the quiet and peaceable possession of the said party of the second part his heirs and asigns they will forever warrand and defend against any person whomsoever lawfully claining the same or any part thereof. Shutts and Sarah Jane Shutts his wife to me personally known to be the same persons described in, and who executed the foregoing instrument, who severally acknowledged that the executed the same, and the said Sarah Jane Shutts wife of Henry M. Shutts on a private examination by me, and hving the indenture explained to her after reading the same to her, apart from her said husband, acknowledged that she executed the same freely, and without any fear or compulsion of her said husband, and does not wish to retract it. Given under my hand and the seal of my office this day and year above written at Wylliesburg, Va. Thomas W. Greer Notary Public In Charlotte County court Clerks office May 6, 1872 The foreging writing together with the certificate of its acknowledgement ----------as to Henry M. Shutts and Sarah Jane his wife, whose names are signed thereto, was this day filed in this office and admitted to record. Four Dollars Internal Revenue Staped attached and cancelled. Teste H. A. Carrington C. This Indenture made this Eleventh day of March One thousand eight hundred and seventy two between Geo. W. Grile and Ann H. Grile of Holmes Co., Ohio of the first part and Henry M. Shutts of Charlotte Co., Va witneseth that the said party of the .......................(**Note - One line missing from copy**).................................. second part his heirs and asigns forever all that certain tract of land known as the Dr. Saunders farm, being the same farm purchased this day by the said G. W. Grile from the said H. M. Shutts described fulliy in the Deed given this day by the said shutts to the said Grile, situate in Charlotte Co Va containing 325 acres, with the appurtinances and all the Estate Title and interest of the said party of the first part therein: to have and to hold the same to the said party of the second part his heirs ana asigns forever provided always, and thes presents are in the ----- condition, that if the said party of the first part their heirs, executors or administration shall well and duly pary, or cause to be paid to the said party of the second part his certain attorney, heirs, executors, administration, ar asigns the sum of one thousand seven hundred dollars ($1700) to be paid as follows. One thousand dollars on the 1st day of April 1873 and seven hundred dollars on the 1st day of April 1874 with intrest at 6 percent per annum from Jan. 1st 1872 according to the condition of 2 certain bonds or writings obligatory, bearing even date herewith, executed by the said Geo W. Grile to the said party of the second part, which said ---- the said Geo. W. Grile and Ann H Grile of the first part hereby cobenant to pay, their presents shall cease and be void, and in case default shall be made in the payment of the principal sum hereby intended to be secured, or in the payment of the interest thereof, or any part of such principal or interest as above provided then the said party of the second part his executors, administrators, or asigns, are hereby authorized persuent to ----- to sell the premises above granted or so much thereof as will be necessary to satisfy the amount them due, with the costs and expenses allowed by law, rendering the overplus if any there may be, to the said party of the first part their heirs executors administrators or asigns. Grile wife of Geo W, Grile on a private examination by me apart from her said husband, having the writing read and explained to her acknowledged that she executed the same freely, and without any fear or compulsion of her said husband, and that she does not wish to retract it.
