In the name of God, Amen I John Rumbold of Caroline County State of
Maryland being of sound and disposing mind and understanding do make,
ordain and publish this my Last Will and Testament in manner and form as
follows to wit~~~ Item first ~~~ I give devise and bequeath unto my beloved wife, Margaret Rumbold the farm and premises which I Purchased of Batchelder G. Chance and William Chance whereon Jeremiah Reed now Resides ~ to her and her assigns during her married Life ~~ also one years provisions for herself and child and also all the property she owned before marriage ~ the above bequeath to be taken in Lieu of Dower in accordance with the marriage contract entered into by my said wife and myself before marriage ~ Item Second ~~ I give bequeath and devise unto my son James B. Rumbold the Farm and premises on which he formerly resided ~ also the Lands ~ and premises formerly belonging to Henry Friend Negro deceased ~ and one half of Forty acres of Land more or Less which I Purchased of Joseph Grey ~ now Laid off adjoining the Farm above named ~ to him and his heirs forever ~~ I also give and bequeath to him half of my wearing apparel ~~~~~~~ Item Third, ~~ I give and bequeath and devise unto Elizabeth Stack my daughter and widow of Levin Stack deceased ~~~~~ my home Farm together with Eight acres of Land which I ~ Purchased of Thomas Stack and added thereto to her and her heirs forever Item Fourth, I give bequeath and devise unto my daughter Mary Hubbard, wife of Lemuel Hubbard the Farm whereon the said Hubbard now resides, ~ being the Lands I purchased of Joseph Grey ~ also the Lands and premises which formerly belonged to Thomas Baker ~ deceased ~ to her and her heirs forever ~~~~~ Item Fifth, ~~~~ I give bequeath and devise unto my daughter Martha Patten wife of Mathew Patten the Farm whereon the said Mathew Patten now resides which I purchased of Perry Grey also the one half of Forty acres of Land which I Purchased of Joseph Grey now laid off to her and her heirs forever ~~~~~ Item Sixth, ~~~~ I give bequeath and devise unto my son John Rumbold the following Land and premises (viz) the Farm and premises named in the first Item of this will mentioned Subject to the Life Estate of his mother as provided in Said item First ~ also all the Lands I Purchased of James Stack, Byard Willis and Alexander Willson to him and his heirs forever provided nevertheless if my said son shall die before he attains to the age of twenty one years ~ the Said Lands and premises Shall be divided equally among my other children and their respective heirs I also give and bequeath unto my said son my Silver Lever watch one bed, bedstead and furniture one half of my wearing apparel ~ and one hundred dollars I also bequeath and devise that if my said son shall arrive at the age of twenty one years ~~ that my daughters Elizabeth Stack Mary Hubbard and Martha Patten Shall each pay over to my Said Son John Rumbold the Sum of fifty Dollars Each ~ and that the Land devise to Each of them Shall be bound for the payment of the money ~~~~~ Item Seventh, I give and bequeath unto the children of my Late daughter Leah Turner deceased (viz) to Martha A. Sewell Lucinda Covey Leah Ette Insley Thomas H. Turner John R. Turner and Mary E. Turner my Grand children the Sum of two hundred and fifty Dollars Each ~~~ Item Eight, It is my will and desire and I hereby direct that my negroes shall be free as follows my negro man William Nichols at the Expiration of the year of my decease ~~ and my negro Boy John Westly Dickinson to be free from the first day of January A. D. Eighteen hundred and sixty Six Item ninth ~ I give and bequeath unto my said negro man William Nichols the house and lot of two acres of Land whereon Richard Larrson now resides to him and his heirs forever ~ also Six dollars per month from the date of my decease to the end of the year then current and fifty dollars ~~~~ Item Tenth ~~ it is my will and desire and I do hereby order and direct that all the residue of my Estate real personal and mixed shall be sold by my Executer hereinafter named ~ and after the payment of the Legacies herein before named I Give and bequeath the proceeds thereof unto my children and their respective heirs as follows (viz) to James B. Rumbold one sixth part thereof ~ to Elizabeth Stack widow of Levin Stack decd. One sixth part thereof ~ To the Heirs of my deceased daughter Leah Turner (viz) Martha A. Sewel, Lucinda Covey Thos. H. Turner John R. Turner Leah Ette Insley and Mary E. Turner and their respective heirs one sixth part thereof ~ To Mary Hubbard wife of Lemuel Hubbard one sixth part thereof ~ to Martha Patten wife of Mathew Patten one sixth part thereof ~ to my son John Rumbold one sixth part thereof ~~~ Lastly, I do hereby constitute and appoint my son James B. Rumbold if he be Living and able to attend to the business (if not Mathew Patten) to be sole Executer of this my last will and Testament and as full compensation thereof and in Lieu of the Legal fees grant to him the Sum of one hundred and fifty dollars and thereby revoke and annull all and Every will or wills by me heretofore made ratifying and confirming this and no other to be my Last will and Testament ~~ In witness Whereof I have hereunto set my hand and affixed my seal this Eleventh day of January A. Domini Eighteen hundred and fifty Eight John Rumbold (Seal) Signed sealed published and declared by John Rumbold the Testator above named as and for his Last will and Testament in the presence of us who in his presence and in the presence of Each other have hereunto our names as witness thereto Edward Hardcastle John E. Hubbard Caleb Clark Caroline County to wit The 25th day of January 1859 Then came Mathew Patten Executer named and appointed in the foregoing will and made oath on the Holy Evangelly of Almighty God that the foregoing instrument of Writing is the true and whole Last will and Testament of John Rumbold, Late of Caroline County deceased that hath come to his hands or possession and that he doth not know of any other of a Later date Certby W. G. Nicholson Regr of wills for Caroline County Caroline County to wit The 25th day of January 1859 Then came John E. Hubbard & Caleb Clark two of the subscribing Witnesses to the foregoing Last will & Testament of John Rumbold Late of Caroline County deceased and Severally made oath on the Holy Evangelly of Almighty God that they did see the Testator therein named sigh and seal this will that they heard him publish pronounce and declare the same to be his Last will and Testament that at the time of his so doing he was to the best of their apprehension of sound & disposing mind memory and understanding and that they together with… |
