Will of James MANSHIP 10 August 1824

In the name of God Amen, I James Manship of Caroline County and State of Maryland being sick and weak of body but sound disposing mind memory and understanding, and calling to mind the certainty of death and the uncertainty of the time thereof, and being desirous to settle my worldly affairs and thereby be the better prepared to leave this world when it shall pleas God to call me, hence, do make and ordain this my last will and testament ____?_____ and form following that is to say.
First and principally I commit my soul into the hands of Almighty God who gave it and my body to the earth to be decently buried at the discretion of my Executrix therein after named and after my funeral charges and just debts are paid I desire give and bequeath as follows.

Item I give and bequeath to my beloved wife Hester Manship during her natural life (or widowhood) the use and benefit of all the balance of my personal estate, after my just debts are paid and also the use and benefit of all my lands and real estate which I now own, hold or ___?___during her natural life (or widowhood) as aforesaid enjoining it one her, to make no waste or distraction in either the personal estate or timber (some sort of mark here) one said Sands and after her death or marriage, which ever may first happen, my will and desire is that all my lands, which I now hold, own or ___?___ shall immediately descend to my son Henry Manship his heirs and assigns forever, upon condition that he pay to my son George Manship, the sum of Fifty dollars current money in a reasonable time, after the decease of my said wife Hester Manship, (should the said George live till that time) or apply the same in any proper manner for his use and benefit and my particular request to my son Henry Manship is that he should endeavors to take care of and maintain my said son George Manship till he arrives at the age of twenty one years exclusive of the Fifty dollars here in before mentioned and I hereby will and bequeath to my son William Manship for and in consideration of his part of my land and real estate thirty five dollars to be paid to him his heirs or assigns by my son Henry Manship immediately after the death of my wife without fail.

Item I also give and bequeath to my daughter Margarett Wadman wife of Thomas Wadman Jun. one good cow and calf to be delivered to her out of my personal estate by my Executrix soon after my decease and no
money.

Item my will and desire is that after the death (or marriage) of my wife Hester Manship all the personal estate, there remaining shall be equally divided between my sons and daughters namely Elizabeth Manship, William Manship, Rebecca Manship and George Manship or the survivors and their heirs.

Item, I hereby ordain constitute and appoint my beloved wife Hester Manship to be executrix of this my last will and testament requesting that she execute the same according to the true intent and meaning thereof.

In testimony that the aforegoing is my only true and last will and testament I have hereunto subscribed my name and affixed my seal this Tenth day of August Eighteen hundred and twenty-four.

Caroline County to wit the 17th August 1824

There came Samuel Fountain who offered the aforegoing instrument for probate and made oath on the Holy
Evangelo of God that the same is the true and whole will and testament of James Manship late of Caroline County deceased that hath come to his hands or prossesion and that he doth not know of any other of a later date.

There came Thomas Pearson, Andrew Manship and Samuel Fountain the three subscribing witnesses to the
aforegoing last will and Testament of James Manship late of Caroline County deceased and severally made oath on the Holy Evangels of God, that they did see the Testator therein named make his mark to and seal this will that they heard him publish, pronounce and declare the same to be his last will and testament, that at the time of his so doing he was to the best of their apprehensions of sound and disposing mind memory and understanding and that they respectively subscribed their names as witnesses to this in the presence and at the request of the Testator and in the presence of each other.
