Will of Richard Ray, Starke, Bradford County, FL 1897

 


 

Starke, Bradford County
                                                                                                                       State of Florida.

In the name of God, Amen.
I, Richard Ray of said County and State being of sound and disposing mind and memory do make this my last will and testament hereby revoking all others heretofore made by me.


Item first - I commend my soul to God who gave it trusting for life and salvation in the merits and mediation of Jesus Christ and direct that my body be buried in a plain Christian manner


Item second -  I am mindful of the uncertainly of my life. Therefore I want to do all I can in making this will to save my family from trouble confusion and expense in dividing my little estate after my death.


Item third - I direct that all my just debts be paid if I owe anything.


Item fourth - I will and bequeath to my beloved wife Cassandra P. Ray all of my property both real personal and mixed to be used by her for the maintenance of herself and our unmarried children and to hold in trust all that may be over her expenses to be divided among our four children at her death. but she will be at liberty at any time to equally divide among our children any amount that she may think she can spare from her support


Item Fifth - It is my will and desire that Carrie A. and Olive E. Ray have and be given of my estate one hundred dollars each more than the two other children. I give them that much more not that I love them more for I have always shown no partiality. but I give them more because they are delicate and when their parents are dead

they will probably have no home consequently will need more money.


Item Sixth - I hereby charge my daughter Mary Noble White with five hundred and fifty dollars ($550.oo) in money: $50.oo of it give about 1888 and $500.oo given about May 1st 1896. She is to have no more out of any estate until Luther C. Ray gets $550.oo and Carrie A. Ray and Olive A. Ray get six hundred and fifty dollars ($650.oo) after this division if there is anything left it is to be equally divided between my four children named above.


Item Seventh - I hereby constitute and appoint my son Luther C. Ray the sole executor of this my last Will and Testament after the death of both his parents with directions that if all the heirs will agree to the execution of this will without having it proved up and entered on record in the County clerks office and sign their names to that effect at the bottom of this will. And if they the heirs will not agree as above to avoid expense and trouble why they have this will proved up and entered on record as the law directs.


Item Eight - I will and desire that my wife Cassandra P. Ray with the advice and consent of our son Luther C. Ray sell any of my real estate in Texas or my Stone Cole property in Kentucky or our home place in Starke Florida whenever they may think best.
In testimony whereof I hereunto set my hand and 
seal this the 29th day of May 1896.

The foregoing writing signed sealed and published and declared by Richard Ray as his will and testament in our presence who at his request sign the same as witnesses in the presence of the testator and in the presence of each other.

                               in and for said County personally appeared W T Weeks who being duly sworn by me says that he was personally present as a subscribing and attesting witness with L D Wall and L C Ray who were also present as subscribing witnesses and saw the Testator Richard Ray subscribe his name to the instrument of writing hereunto annexed as and for his last Will and Testament and that the said Richard Ray did then and there in the presence of said L D Wall and L C Ray and affiant publish and declare the same to be his last Will and Testament. That the said L D Wall and L C Ray and he the said W T Weeks as attesting witnesses did then and there at the special request of said Richard Ray and in his presence and in the presence of each other subscribe their names thereto attesting witnesses and the said W. T. Weeks further swears that he verily said instrument of writing hereunto annexed so subscribed, published and declared and attested as aforesaid to be the last Will and Testament of said Testator the said Richard Ray.
