Will of Joseph Crawshaw, Bradford County, FL 1905

I, Joseph Crawshaw of the County of Bradford and State of Florida being of sound and disposing mind and memory, but being mindful of the uncertainty of this life, do make, publish and declare this instrument as and for my last will and testament hereby revoking any and all wills by me at any time heretofore made.


          I direct my executor hereinafter names to pay all my just debts and funeral expenses as soon after my decease as may be done without inconvenience to him or detriment to my estate.


1st     I give devise and bequeath unto J.W. Archibald and David H. Doig of the City of Jacksonville, Duval County, Florida, or the survivor of them, the sum of Three hundred dollars ($300.oo) To have and to hold the same to them and their successors, in trust, for the following uses and with the proven hereinafter provided.


(a)     To invest the said sum of Three hundred dollars ($300.oo) in interest bearing stocks bonds or securities investing, re-investing and changing the same as often as they may deem advisable.


(b)     To use the income arising from said trust fund or such part thereof as in their judgement it may be necessary for the proper perpetual care of my lot in Evergreen Cemetery in Duval County Florida.


(c)     In the event that at any future time said trustees or their successors have the opportunity to purchase an interest share or bonds in any reliable company association or institution formed for the purpose of giving perpetual care to cemetery lots, the said trustees or their successors are hereby authorized and empowered to use the said sum of three hundred dollars ($300.oo) herein bequeathed or such part thereof as may be necessary to purchase said interest stock or bonds to secure proper perpetual care of my said cemetery lot. And in the event that all of said sum herein bequeathed is not required for such purpose the balance there remaining shall be distributed in accordance with the terms and conditions of this will.


(d)     In the event of the death or inability to act of either of said trustees the remaining trustee shall be vested with all the powers trusts and responsibilities herein granted to both and in the event of the death or inability to act of said trustees or the survivor of them then the Judge of the Circuit Court of

Duval County Florida shall appoint some competent and faithful person to carry out the provisions of this trust.


(2)     I give, devise and bequeath unto my nephew, Joseph C. Weissner, of the city of Birmingham and State of Alabama, the sum of ten dollars ($10.oo) to have and to hold the same to him and his heirs forever, in fee simple.


(3)     I give, Devise and bequeath unto my niece, Sophia Scott, ot the City of St. Louis and State of Missouri the sum of ten dollars ($10.oo) to have and to hold the same to her and her heirs forever in fee simple.


(4)     I give devise and bequeath to my niece Baby Crawshaw daughter of the late Edward Crawshaw of the City of Chicago and State of Illinois the sum of ten dollars ($10.oo) to have and to hold the same to her and her heirs forever, in fee simple.


(5)     All the rest and residue of my property of every kind nature and description real personal and mixed or wherever the same may be situated, which I now own or may hereafter acquire and of which I shall die seized and possessed, I give devise and bequeath unto my beloved sister-in-law Lucy A. Emerson of Cape Porpoise, Maine to have and to hold the same to her and her heirs and assigns forever, in fee simple.
          

The foregoing bequest to be for her own separate use and benefit and her individual receipt given for any payments or property delivered to her by my said executor, shall be sufficient quittance for any and all payments, made by him to her.
         

 I nominate, constitute and appoint my friend David H. Doig of the City of Jacksonville Duval County Florida to be the executor of this my last will and testament and I desire and request that no bond or bonds or other security be required to enable him to qualify and act as such executor. In the event of the death or inability of the said David H Doig to qualify and act as executor of this will then I nominate constitute and appoint

James W. Archibold of the City of Jacksonville Duval County, Florida to be the executor of said wil and I desire and request that no bond or bonds or other security be required to enable him to qualify and act as such executor.
          

In witness whereof I have hereunto subscribed my name and affixed my seal this 11 day of September A.D. 1903 at Lawtey Bradford County Florida in the presence of the witnesses whose names are subscribed hereto as attesting witnesses who each in my presence and in the presence of each other at my request and by express direction have hereto subscribed their names and witnesses.

The foregoing instrument was, at Lawtey, Bradford County, Florida, on the 11 day of September A.D. 1903 duly signed, sealed, published and declared by the testator therein named, the said Joseph Crawshaw as and for his last will and testament and we at his request and in his presence and in the presence of each other and by his express direction have hereto subscribed our names as attesting witnesses.

          Before me Thos. J. Dekle County Judge in and for said County personally appeared Louis H. Hill who being by me duly sworn says that he was personally present as subscribing and attesting witness with G.W. Brown George F. Scott and L.W. Sayles, who were also present as subscribing witnesses and saw the testator Joseph Crawshaw subscribe his name to the instrument of writing hereto annexed as and for his last will and testament and that the said Joseph Crawshaw did then and there in the presence of said G.W. Brown, Geo. F. Scott, & L.W. Sayles & affiant publish and declare the same to be his last Will and Testament. That the said several witnesses did then and there at the special request of said Joseph Crawshaw and in his presence and in the presence of each other subscribe their names thereto as attesting witnesses

And the said Louis H. Hill further swears that he verily believes the said instrument of writing hereto annexed so subscribed declared and attested as aforesaid to be the true last will and testament of said Testator the said Joseph Crawshaw.
