Will of Charles H. Bailey, Lawty, Bradford County, FL 1892

Know all men by these presents that I, Charles H. Bailey, of Lawty, in the County of Bradford, State of Florida, do hereby make and declare this my last will and testament, in manner following;--


First, I give, devise, and bequeath to my son Albert E. Bailey, his heirs and assigns forever, one third of whatever property consisting of real estate I may possess at the time of my death.  Also, of my personal property, the following articles:
Sofa, large Sofa, bottom easy chair, three other Sofa bottom chairs, black walnut armchair with bent frame, two engravings called respectively, "Saturday Night" and Cant you Talk" one oil painting, and one chromo, a Swiss scrue.  Marble top table, hanging lamp with prisms, sitting room clock, foot rest, two marble vases, all my books and all my silverware, excepting one dozen knives and one butter knife with celluloid handles, coffee pot, milk pitcher, sugar bowl and spoon holder.


Second: I ive devise and bequeath to my wife Emily S. Bailey, two thirds of whatever property consisting of real estate I may possess at the time of my death, all my personal property not bequeathed to my son, Albert E. Bailey. Also whatever money remaining in bank at the time of my death, not exceeding five hundred dollars. all over that sum to be given to my son, Albert E. Bailey. If there is not enough in bank to pay my doctor's bill and funeral expenses, it is to be taken out of the estate before the division of the same. All the property bequeathed to my wife, Emily S. Bailey, is to be used by her as she pleases during her lifetime, and if any is remaining at the time of her death it is to revert to my son Albert E. Bailey, his heirs and assigns forever.


Third: I hereby appoint my wife Emily S. Bailey, and Joseph Crawshaw Jr., executors of this my last Will and Testament, and my will and desire is that said executors shall not be required to give any bonds or security to the Judge of Probate for the faithful execution of the duties of executors. In witness whereof I, Charles H. Bailey, the testator, have to this my last Will and Testament, set my hand and seal, this tenth day of October in the year of our Lord eighteen hundred and eighty eight.

Signed, sealed, published and declared by the above named Charles H. Bailey, as and for his last will and testament, in the presence of us, who have hereunto subscribed our names, at his request, as witnesses thereto in the presence of said testator and of each other.

County of Bradford   }        Before me, Wm F. Malphurs, County Judge, in and for said County, Personally came Joseph Crawshaw, Jr., who being by me first duly sworn, says that he was personally present as a subscribing and attesting witness, with Joseph Crawshaw Sen. and Helen M. Crawshaw, who were also present as subscribing and attesting witnesses, and saw the Testator Charles H. Bailey of the town of Lawty and County and State aforesaid, subscribe his name to the instrument of writing hereto annexed and also heard him publish, pronounce and declare as and for his last Will and Testament. And that he said before named witnesses, did then and there at the special request of the said Testator Charles H. Bailey and in his presence and in the presence of each other, subscribed their names thereto, as attesting witnesses and the said Joseph Cranshaw further Swears that he verily believes the said instrument of writing hereto annexed and so subscribed, published declared and attested , as foresaid, to be the true last Will and Testament of said Testator Charles H. Bailey deceased.

            Order admitting Will to Probate.
The above cause coming on the be heard this (8th) eighth day of September, A.D. 1892 and it appearing to the satisfaction of the Court that the foregoing examination of above subscribing witnesses to the foregoing affidavit is sufficient proof upon which to admit said exhibited last will and testament of the said Charles H. Bailey deceased, to Probate, and it is therefore ordered, adjudged and decreed, that and the same is hereby admitted to Probate, this (8th) eighth day of September, A.D. 1892. Given under my hand and seal of said Probate Court hereto officially fixed at Starke Florida the day and year last written.
