Mr. Cowen, from the Committee of Claims, made the following
REPORT:
The Committee of Claims, to which was referred the
petition of Reuben, Lapetter, report : |
That this is a claim for the price of a slave man belonging to the
petitioner who, as he represents, was killed by a detachment
of South Carolina volunteers, under the command of Captain
Tripp, on the night of the 2d of March, 1836, at the
petitioner's residence, in Florida.
The evidence clearly shows, that the slave was shot by the
volunteers, in the belief that he was a hostile Indian.
The committee do not consider this a proper case for relief. The
United States are not bound to compensate individuals for
injuries caused by the tortious acts of those in the public
service, whether those torts are committed in mistake or
wantonness.
The committee recommend the adoption of the following resolution :
Resoved, That the prayer of the petitioner ought
not to be granted. |
