Emett To Jones

Following is my
transcription of the Emett to Jones Deed of Trust as recorded at
Frederick Co., VA, DB 24B:136-138, 29 Nov 1794.
Note: The maiden
name of Mary Emett was "Stephens". She was the widow of John Emett, and
a daughter of Maj. Lewis Shirley Stephens and his wife, Mary
Rittenhouse.
This Indenture made this Twenty Ninth day of
November in the year of our Lord One Thousand Seven Hundred and Ninety
Four Between Mary Emett, of the County of Frederick in the Commonwealth
of Virginia, Widow, of the one part, and Barbara Jones, Administratrix,
with the will annexed of Joseph Jones, late of the said County and
Commonwealth, now deceased, of the other part. WITNESSETH:
That
the said Mary Emett, in consideration of the sum of One Hundred and
Fifteen Pounds Fourteen Shillings current money of Virginia, to her in
hand paid, by the said Barbara Jones, at or before the Sealing and
Delivery of these presents, the receipt whereof is hereby acknowledged,
and for other good causes and considerations here hereunto moving hath
granted, bargained, sold, aliened, and confirmed and by these presents
doth grant, bargain, sell, alien, and Confirm, to the said Barbara
Jones, her heirs and assigns, a certain plantation or tract of land
situate, lying, and being in the County of Frederick and Commonwealth of
Virginia, being the same that was granted by Deeds recorded in the Court
[ * ] of the District composed of the Counties of Frederick, Berkeley,
Hampshire, Hardie, and Shenando, from Lewis Stephens Senior to the said
Mary Emett, and is bounded as follows:
Beginning at three
Hickories in the line of Laurence Stephens, thence No 6 Et l62 poles to
near a white oak, then No 4l Wt 70 poles to where a Red Oak formerly
stood, then No 58 Wt 34 poles to a dead Hickory near a waggon road, then
So 32..30" Wt 188 poles to a large White Oak, then 64.. 30" Et l72 poles
to the Beginning containing One Hundred and Forty Six acres more or less
together with all and singular the appurtenances to the said tract of
land and every part thereof belonging or in any wise appertaining and
all the right, title, and interest of her the said Mary Emett as well in
equity as in law of in or to the premises and every part thereof.
To have and to hold the said tract of land with the appurtenances to
the said Barbara Jones her heirs and assigns forever, Provided always
and under this express condition, that if the said Mary Emett her heirs
executors or administrators shall on or before the twenty ninth day of
November One Thousand Seven Hundred and Ninety Six well and truly pay or
cause to be paid to the said Barbara Jones her Executors,
Administrators, or Assigns the aforesaid sum of One Hundred and Fourteen
Pounds Fourteen Shillings with legal interest thereon from the date of
this Indenture that then this Indenture and everything therein contained

*a single unreadable word. The only word
that comes to mind, but does not seem to fit the faded remains, is
"complex." The missing word may contain the letter "p", but that is no
more than a guess. An attorney friend of the transcriber has suggested
that a practice instead of crossing out an incorrect word was to
actually scrape it from the page and this may be the intention in this
case.
