Nellie Malone stated that she had married the Defendant Jerry Malone in Rains County, Texas, on Dec 12, 1911 and had lived as man and wife until October 1913 when the Defendant abandoned the Petitioner.

The Petitioner charged that the Defendant had failed to provide for her and that he would spend his money on other women, leaving the Petitioner without anything to eat; Petitioner also charged that the Defendant would compel her to give him the money she worked for and he would then spend it on gambling. Petitioner also charged that Defendant neglected and abused her, cursing her, and failed to provide the common necessities of life. Petitioner plead 3 years abandonment as grounds for the divorce.

J.K. Miller served the divorce citation on Jerry Malone, Negro, living near Virgil, Oklahoma. In the report of the delivering of the citation to Jerry Malone, it stated
"Malone has a brother by the name of Jim Ousley..."
