Complaint
In the Name and by the Authority of the State of Texas:
I, M.M. Vincent, do solemnly swear that I have good reason to believe, and do believe that one John Trumble and one Frank Rabe on or about the 3rd day of August A.D. 1906, and before the making and filing of this Complaint, in the County of Rains and State aforesaid did then and there unlawfully in said State and County on or about the 3rd day of August A.D. 1906 the said John Trimble and Frank Rabe did unlawfully and fraudulently take from the possession of Alvin Simms one bed quilt of the value of five Dollars, the same then and there being the ---- personal property of and belonging to the said Alvin Simms without the consent of said Alvin Simms and with the intent then and there on the part of said John Trumble and Frank Rabe to deprive the said Alvin Simms of the value of the same and to appropriate the said property to the use and benefit of the said John Trumble and Frank Rabe.

Vincent, do solemnly swear that I have good reason to believe, and do believe that Oscar Sanders did on or about the 16th day of March A.D. 1907, and before the making and filing of this Complaint, in the County of Rains and State of Texas, on the day and date and in the State and county aforesaid in and upon one Ed Vincent with malice aforethought did make an assault with intent to murder the said Ed Vincent.

That we, Oscar Sanders, as Principal, and _________________ as sureties, are held and firmly bound unto the State of Texas in the penal sum of Two Hundred Dollars, for the payment of which, well and truly to be made, we do bind ourselves and each of us, our heirs, executors and administrators, jointly and severally, by these presents; Conditioned, that wheras the said Oscar Sanders who is now in the of (a) M.M. Vincent charged in due forme of law before S.S. Adams a Justice of the Peace, a Magistrate of said County, sitting as an Examining Court with the offense of (c) Assault to murder and who by the order of said Magistrate has been required to give bail in the sum of Two Hundred Dollars, conditioned for his personal appearance before the District Court of said County, to answer the charge. Now, if the said Oscar Sanders, shall well and truly make his appearance before the said District Court of said County in the town of Emory, Texas in said County on the 13th day of May 1907, and there remain from day to day, and term to term, until discharged by due course of law, then and there to answer said accusation against him, then this obligation shall become void, otherwise to remain in full force and effect.

That we, B.F. Jones, as Principal, and _________________ as sureties, are held and firmly bound unto the State of Texas in the penal sum of Five Hundred Dollars, for the payment of which, well and truly to be made, we do bind ourselves and each of us, our heirs, executors and administrators, jointly and severally, by these presents, signed and dated on this 3rd day of May 1907. The condition of the above obligation is such that, whereas, the above named Principal, B.F. Jones, has been arrested, and is now in custody under a valid warrant of arrest issued by S.S. Adams a Justice of the Peace in and for Precinct No. 1 of Rains County, Texas, charging the said B.F. Jones with the offense of rape and whereas the said Defendant B.F. Jones has waived an examining trial and proposed to give bond for his appearance to await the action of the Grand Jury of Rains County, Texas to meet on the 1eth day of May 1907, and from the conflict in the statements of the prosecutor on the 3rd day of May 1907 as to the time when she charges the offense to have been committed and being unable to find corroborating testimony the said S.S.Adams, J.P. Prect No. 1 Rains Co. Texas has fixed the bail of said defendant at $500.00
Now, if the said B.F. Jones shall well and truly make personal appearance before the said Grand Jury as aforesaid at Emory, Texas and abide their action on said charge said Grand Jury to meet the 13th day of May 1907, and there remain from day to day, and term to term, until discharged by due course of law, then and there to answer said accusation against him, then this obligation shall become void, otherwise to remain in full force and effect.

Before me, the undersigned authority, on this day personally appeared J.M. Braziel, who, after being by me duly sworn, on oath deposes and says:
That heretofore, to wit, on or about the 22 day of May A.D. 1907, and before the making and filing of this Complaint, in the County of Rains and State of Texas, Billy Voiles of said County and State, did then and there unlawfully
under the immediate influence of sudden passion arising from an adequate cause neither justified nor excused by Law did unlawfully and voluntarily kill and slay by then and there shooting the said A.L. Polk with a shot gun.

I called for the clothing on Voyles and they were given to me in a sack.
I heard the gun fire. It was just after sundown on the evening of May 22, 1907
I heard only one shot.
Lon Polk and Billie Voyles had had some hard feelings prior in to the killing related to me by Voyles as to something D.D. Heeth had said in regard to a mule.H.C. Polk
I am the father of Leon Polk and was present at the time of his death at home on 22 day of May 1907
Billy Voyles ran into the house and got Leons gun. I with Daisy, Leon Polks wife, struggled with Voyles together to get the gun from him. I saw the starting and the whole of the affair of killing.
Voyles got tickled about one of the mules breaking wind, while they were in the wagon coming home and my son seemed to take it as an insult and told Voyes he had done him, Leon Polk, wrong. And Voyles at once made a break for the gun. My son, Leon, had nothing in his hands at time of killing.
